قَالا فِي صَدَقَةِ الْإِبِلِ فِي كُلِّ خَمْسٍ شَاةٌ إِلَى أَنْ تَبْلُغَ خَمْساً وَ عِشْرِينَ فَإِذَا بَلَغَتْ ذَلِكَ فَفِيهَا ابْنَةُ مَخَاضٍ‌ ثُمَّ لَيْسَ فِيهَا شَيْ‌ءٌ حَتَّى تَبْلُغَ خَمْساً وَ ثَلَاثِينَ فَإِذَا بَلَغَتْ خَمْساً وَ ثَلَاثِينَ فَفِيهَا ابْنَةُ لَبُونٍ ثُمَّ لَيْسَ فِيهَا شَيْ‌ءٌ حَتَّى تَبْلُغَ خَمْساً وَ أَرْبَعِينَ فَإِذَا بَلَغَتْ خَمْساً وَ أَرْبَعِينَ‌ فَفِيهَا حِقَّةٌ طَرُوقَةُ الْفَحْلِ ثُمَّ لَيْسَ فِيهَا شَيْ‌ءٌ حَتَّى تَبْلُغَ سِتِّينَ فَإِذَا بَلَغَتْ سِتِّينَ فَفِيهَا جَذَعَةٌ ثُمَّ لَيْسَ فِيهَا شَيْ‌ءٌ حَتَّى تَبْلُغَ خَمْساً وَ سَبْعِينَ فَإِذَا بَلَغَتْ خَمْساً وَ سَبْعِينَ فَفِيهَا ابْنَتَا لَبُونٍ ثُمَّ لَيْسَ فِيهَا شَيْ‌ءٌ حَتَّى تَبْلُغَ تِسْعِينَ فَإِذَا بَلَغَتْ تِسْعِينَ فَفِيهَا حِقَّتَانِ طَرُوقَتَا الْفَحْلِ ثُمَّ لَيْسَ فِيهَا شَيْ‌ءٌ حَتَّى تَبْلُغَ عِشْرِينَ وَ مِائَةً فَإِذَا بَلَغَتْ عِشْرِينَ وَ مِائَةً فَفِيهَا حِقَّتَانِ طَرُوقَتَا الْفَحْلِ فَإِذَا زَادَتْ وَاحِدَةٌ عَلَى عِشْرِينَ وَ مِائَةٍ فَفِي كُلِّ خَمْسِينَ حِقَّةٌ وَ فِي كُلِّ أَرْبَعِينَ ابْنَةُ لَبُونٍ ثُمَّ تَرْجِعُ الْإِبِلُ عَلَى أَسْنَانِهَا وَ لَيْسَ عَلَى النَّيِّفِ شَيْ‌ءٌ وَ لَا عَلَى الْكُسُورِ شَيْ‌ءٌ وَ لَيْسَ عَلَى الْعَوَامِلِ شَيْ‌ءٌ إِنَّمَا ذَلِكَ عَلَى السَّائِمَةِ الرَّاعِيَةِ قَالَ قُلْتُ مَا فِي الْبُخْتِ السَّائِمَةِ شَيْ‌ءٌ قَالَ مِثْلُ مَا فِي الْإِبِلِ الْعَرَبِيَّةِ

1. Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Hariz from Zurarah, Muhammad ibn Muslim, abu Basir, Burayd al-‘ljliy and al-Fudayl who has said the following: “Abu Ja‘far, and abu ’Abd Allah, ‘Alayhim al-Salam, have said that the amount of Zakat on camel is one sheep for every five camels, until they number twenty-five in which case it is one Ibnatu Makhad. Thereafter there is no increase in Zakat until the number reaches thirty-five, in which case Zakat is one Ibnatu Labun. Thereafter there is no increase in Zakat until the number reaches forty-five, in which case Zakat is one Hiqqah Taruqah al-Fahl. Thereafter there is no increase in Zakat until the number reaches sixty, in which case Zakat is one Jadha‘ah. Thereafter there is no increase in Zakat until the number reaches seventy-five, in which case Zakat is Ibnata Labun. Thereafter there is no increase in Zakat until the number reaches ninety, in which case Zakat is Hiqqatan Taruqat al-Fahl. Thereafter there is no increase in Zakat until the number reaches one hundred twenty, in which case Zakat is Hiqqatan Taruqata al-Fahl. If one more camel increases, thereafter, on every fifty, Zakat is one Hiqqah and on every forty, Zakat is one Ibnatu Labun. All additional camels from this point on are calculated according to the numbers already mentioned. Zakat is not due on what is between two numbers as well as on fractions, or working camels. Only camels that graze in pastures are subject to Zakat. He (the narrator) has said that he then asked, Is non- Arabic camel which grazes subject to Zakat? 5 He (the Imam) said, It is just like Arabic camels.”

[2]قال في التهذيبين: قوله عليه السلام:« فاذا بلغت ذلك ففيها ابنة مخاض» أراد و زادت واحدة و انما لم يذكر في اللفظ لعلمه بفهم المخاطب قال: و لو لم يحتمل ذلك لجاز لنا أن نحمله على التقية كما صرّح به في رواية البجليّ بقوله هذا فرق بيننا و بين الناس أقول: الأول بعيد و الثاني سديد.( فى) و المراد برواية البجليّ الرواية الآتية تحت رقم 2.ص 531

[1]نقل الفيض- رحمه اللّه- عن استاذه في العلوم النقلية السيّد ماجد بن هاشم البحرانيّ- طاب ثراه- أنه قال: المراد برجوع الإبل على اسنانها استيناف النصاب الكلى و اسقاط اعتبار الأسنان السابقة كانه إذا اسقط اعتبار الأسنان و استونف النصاب الكلى تركت الإبل على اسنانها و لم تعتبر كما يقال: رجعت الشي‌ء على حاله اي تركته عليه و لم اغيره و هو و إن كان بعيدا بحسب اللفظ الا أن السياق يقتضيه و تعقيب ذكر انصبه الغنم لقوله و سقط الامر الأول ثمّ تعقيبه بمثل ما عقب به نصب الإبل و البقر من نفى الوجوب عن النيف يرشد إليه لانه جعل اسقاط الاعتبار بالاسنان السابقة في الغنم مقابلا لرجوع الإبل على اسنانها واقعا موقعه و هو يقتضى اتّحادهما في المؤدى و ربما امكن حمله على استيناف النصب السابقة فيما تجدد ملكه في اثناء الحول كما أول به المرتضى- رضي اللّه عنه- ما رواه من استيناف الفريضة بعد المائة و العشرين و قد يقال: أراد برجوعها على اسنانها استيناف الفرائض السابقة بعد بلوغ المائة و العشرين بأن يؤخذ للخمس الزائدة بعد المائة و العشرين شاة و للعشر شاتان و هكذا إلى الخمس و العشرين فيؤخذ بنت مخاض و هكذا كما هو قول ابى حنيفة و يكون محمولا على التقية و الوجه هو الأول لما ذكرنا انتهى كلام أستادنا- رحمه اللّه-.ص 532

قَالَ أَبُو عَبْدِ اللَّهِ ع‌ الطِّينُ حَرَامٌ كُلُّهُ كَلَحْمِ الْخِنْزِيرِ وَ مَنْ أَكَلَهُ ثُمَّ مَاتَ فِيهِ لَمْ أُصَلِّ عَلَيْهِ إِلَّا طِينَ الْقَبْرِ فَإِنَّ فِيهِ شِفَاءً مِنْ كُلِّ دَاءٍ وَ مَنْ أَكَلَهُ لِشَهْوَةٍ لَمْ يَكُنْ لَهُ فِيهِ شِفَاءٌ.

1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from abu Yahya al-Wasitiy from a man who has said the following: “Abu ‘ Abd Allah (a.s.), has said, ’Eating clay is unlawful in its entirety, like the flesh of pork. If one eats it and dies, I will not perform Salat (prayer) for him except the clay from the grave (of al-Husayn (a.s.) ) in which there is cure for all kinds of illnesses but if one eats it because of strong desire, then there is no cure in it.’”

2. Ali ibn Ibrahim has narrated from his father and Muhammad ibn ’Isma‘il from al-Fadl ibn Shadhan all from Ibn Abi ‘Umayr from ‘Abd al-Rahman ibn af-Hajjaj who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘On five Qala’is (young she camel) Zakat is one sheep and Zakat is not due on less than five camels. On ten Zakat is two sheep, on fifteen Zakat is three sheep, on twenty Zakat is four sheep, on twenty-five Zakat is five sheep and on twenty-six Zakat is one Bintu Makhad up to thirty- five. 5 ‘Abd al-Rahman has said that this is the difference between us and the people. If one is increased Zakat is one Bintu Labun up to forty-five. With the increase of one more camel Zakat is one Hiqqah up to sixty, thereafter if one more camel is increased Zakat is one Jadha‘ah up to seventy-five, thereafter if one more camel is increased Zakat is Binta Labun up to ninety. When camels become many, then for every fifty Zakat is one Hiqqah.”

3. A number of our people have narrated from Sahl ibn Ziyad ibn Mahbub from Ibrahim ibn Mehzam from Talhah ibn Zayd who has said the following: “Abu ‘Abd Allah (a.s.), has said that ’Amir al-Mu’minin has said, ‘One who continues eating clay has a share in his own murder.’”

Ali ibn Ibrahim has narrated from his father from al-Nawfaliy from al-Sakuniy who has narrated the following: “Abu ‘Abd Allah (a.s.), has said that ’Amir al-Mu’minin, Ali (a.s.), accepted the testimony of a man whose hand and foot was cut off, he had repented and his repentance had become known . 555

4. A number of our people have narrated from Ahmad ibn Muhammad from al-Hassan ibn Ali from Hisham ibn Salim who has said the following: “Abu ‘Abd Allah (a.s.), has said that Allah, most Majestic, most Glorious, created Adam from clay and has made it unlawful for his offspring to eat clay.’”

5. A number of our people have narrated from Sahl ibn Ziyad from ibn Faddal from ibn al-Qaddah who has said the following: “About the case of a man who ate clay ’Amir al-Mu’minin (a.s.), prohibited and said, ‘Do not eat clay; if you eat clay and die, you have helped to murder yourself.’”

5. Ali ibn Ibrahim has narrated from his father from Tsma‘il ibn Marrar from Yunus from certain persons of his people who has narrated the following: “I once asked abu ‘Abd Allah (a.s.), about the case of a man who accuses married woman: if his testimony after his being subjected to penalty and his repenting is admissible. He (the Imam) said, ‘Yes, it is admissible . 5 I then asked, ‘What is his repentance ? 5 He (the Imam) said, ‘He comes before the Imam and calls his soul a liar and says that he had fabricated against so and so and retracts what he had said , 555

إِنَّ التَّمَنِّيَ‌ عَمَلُ الْوَسْوَسَةِ وَ أَكْثَرُ مَصَايِدِ الشَّيْطَانِ أَكْلُ الطِّينِ وَ هُوَ يُورِثُ السُّقْمَ فِي الْجِسْمِ وَ يُهَيِّجُ الدَّاءَ وَ مَنْ أَكَلَ طِيناً فَضَعُفَ عَنْ قُوَّتِهِ الَّتِي كَانَتْ قَبْلَ أَنْ يَأْكُلَهُ وَ ضَعُفَ عَنِ الْعَمَلِ الَّذِي كَانَ يَعْمَلُهُ قَبْلَ أَنْ يَأْكُلَهُ حُوسِبَ عَلَى مَا بَيْنَ قُوَّتِهِ وَ ضَعْفِهِ وَ عُذِّبَ عَلَيْهِ.

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Ysma‘il ibn Muhammad from his grandfather Ziyad ibn abu Ziyad who has said the following: “Abu Ja‘far (a.s.), has said, ‘Wishing and longing is an act of Satan. Eating clay is of the greater part of the hunting devices of Satan. It causes illness in the body and accelerates pain. If one because of eating clay loses his power that he had before eating clay and fails to work as he did before eating clay he will be made to suffer proportionate to the amount of power that he had lost because of eating clay.’”

6. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from ibn Sinan who has narrated the following: “I once asked abu ‘Abd Allah (a.s.), about the case of a man who is subjected to penalty; then he repents: if his testimony becomes acceptable. He (the Imam) said, ‘If he repents which is retracting what he has said and calls himself a liar before the Imam of the Muslims. When he does this then it is necessary for the Imam to accept his testimony thereafter .

Ali ibn Ibrahim has narrated from his father from al-Nawfaliy from al-Sakuniy who has said the following: “Abu ‘Abd Allah (a.s.), has said that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said, ‘If one eats clay and dies he has helped to kill himself.’”

9. Ali ibn Muhammad has narrated from certain persons of our people from Ja‘far ibn Ibrahim al-Hadramiy from Sa‘d ibn Sa‘d who has said the following: “I once asked abu al-Hassan (a.s.), about clay. He (the Imam) said, ‘ It is unlawful like dead animals, blood, flesh of pigs except the clay from the grave of al-Husayn (a.s.), in which there is cure for all kinds of illness and security from all kinds of fear.”’
