رَوَى أَبَانٌ عَنْ جَمِيلٍ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ

إِذَا أَقَامَ الْمُدَّعِي الْبَيِّنَةَ فَلَيْسَ عَلَيْهِ يَمِينٌ وَ إِنْ لَمْ يُقِمِ الْبَيِّنَةَ فَرَدَّ عَلَيْهِ الَّذِي ادُّعِيَ عَلَيْهِ الْيَمِينَ فَأَبَى فَلَا حَقَّ لَهُ.

English translationBab Ul Qaim Publications

Hadith.3342 - Aban narrated from Jamil, from Abu Abdullah (as), who said: "If the claimant presents evidence, then no oath is required from him. However, if he does not present evidence and the defendant offers to take an oath, but the claimant refuses, then he has no right to his claim."

[1]رواه الكليني ج 7 ص 417 بسند فيه ارسال عن أبان عن البقباق عنه عليه السلام و الضمير في« أبى» راجع الى المدّعى يعنى المدعى ان لم يقم البينة و طلب المدّعى عليه منه اليمين فأبى أن يحلف فلا حقّ له. ثم اعلم أن« عن جميل» فى السند كان مصحّف« عن رجل».ص 63
