Borrowing Dirhams (Coins) to Keep the Good ones Among them

سَأَلْتُهُ عَنِ الرَّجُلِ يَسْتَقْرِضُ الدَّرَاهِمَ الْبِيضَ عَدَداً ثُمَّ يُعْطِي سُوداً وَ قَدْ عَرَفَ أَنَّهَا أَثْقَلُ مِمَّا أَخَذَ وَ تَطِيبُ نَفْسُهُ أَنْ يَجْعَلَ لَهُ فَضْلَهَا فَقَالَ لَا بَأْسَ بِهِ إِذَا لَمْ يَكُنْ فِيهِ شَرْطٌ وَ لَوْ وَهَبَهَا لَهُ كُلَّهَا صَلَحَ.

“This is concerning my question before abu ‘ Abd Allah (a.s.), about the case of a man who took a loan of white dirham by numbers, then gave black ones, knowing that they are heavier than what he had taken and he was pleased to make the extra for him. He (the Imam) said, it is not unlawful if there is no stipulation or

سُئِلَ أَبُو عَبْدِ اللَّهِ ع- عَنْ رَجُلٍ أَقْرَضَ رَجُلًا دَرَاهِمَ فَرَدَّ عَلَيْهِ أَجْوَدَ مِنْهَا بِطِيبَةِ نَفْسِهِ وَ قَدْ عَلِمَ الْمُسْتَقْرِضُ وَ الْقَارِضُ أَنَّهُ إِنَّمَا أَقْرَضَهُ لِيُعْطِيَهُ أَجْوَدَ مِنْهَا قَالَ لَا بَأْسَ إِذَا طَابَتْ نَفْسُ الْمُسْتَقْرِضِ.

“Once abu ‘Abd Allah (a.s.), was asked about the case of a man who gave a loan to another man who paid it back with better dirhams without compulsion, and the creditor knew it as well as the debtor that the loan was given to receive payment with the better dirhams. He (the Imam) said, it is not unlawful.’”

إِذَا أَقْرَضْتَ الدَّرَاهِمَ ثُمَّ أَتَاكَ بِخَيْرٍ مِنْهَا فَلَا بَأْسَ إِذَا لَمْ يَكُنْ بَيْنَكُمَا شَرْطٌ.

3. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘If you give dirhams as a loan, then the party pays you back with better ones, it is not unlawful, if there is no stipulation between you.’”

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الرَّجُلِ يُقْرِضُ الرَّجُلَ الدَّرَاهِمَ الْغِلَّةَ فَيَأْخُذُ مِنْهُ الدَّرَاهِمَ الطَّازَجِيَّةَ[1] طَيِّبَةً بِهَا نَفْسُهُ فَقَالَ لَا بَأْسَ وَ ذَكَرَ ذَلِكَ عَنْ عَلِيٍّ ع.

“This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who gave impure dirhams as a loan to another man, who then paid him back with better dirhams without compulsion. He (the Imam) said, it is not unlawful and it is from Ali (a.s.).’”

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الرَّجُلِ يَسْتَقْرِضُ مِنَ الرَّجُلِ الدَّرَاهِمَ فَيَرُدُّ عَلَيْهِ الْمِثْقَالَ أَوْ يَسْتَقْرِضُ الْمِثْقَالَ فَيَرُدُّ عَلَيْهِ الدَّرَاهِمَ فَقَالَ إِذَا لَمْ يَكُنْ شَرْطٌ فَلَا بَأْسَ وَ ذَلِكَ هُوَ الْفَضْلُ إِنَّ أَبِي رَحِمَهُ اللَّهُ كَانَ يَسْتَقْرِضُ الدَّرَاهِمَ الْفُسُولَةَ فَيُدْخِلُ عَلَيْهِ الدَّرَاهِمَ الْجِلَالَ‌[2] فَقَالَ يَا بُنَيَّ رُدَّهَا عَلَى الَّذِي ا

“This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who borrowed from another man dirham and returned with a Mithqal (a certain unit of weight) or borrowed a Mithqal and paid back with dirham. سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الرَّجُلِ يَكُونُ عَلَيْهِ جُلَّةٌ مِنْ بُسْرٍ فَيَأْخُذُ مِنْهُ جُلَّةً مِنْ رُطَبٍ وَ هِيَ أَقَلُّ مِنْهَا قَالَ لَا بَأْسَ قُلْتُ فَيَكُونُ لِي عَلَيْهِ جُلَّةٌ مِنْ بُسْرٍ فَآخُذُ مِنْهُ جُلَّةً مِنْ تَمْرٍ وَ هِيَ أَكْثَرُ مِنْهَا قَالَ لَا بَأْسَ إِذَا كَانَ مَعْرُوفاً بَيْنَكُمَا[3].
