سَأَلْتُ أَبَا جَعْفَرٍ ع عَنِ الرَّجُلِ يَأْذَنُ لِعَبْدِهِ أَنْ يَتَزَوَّجَ الْحُرَّةَ أَوْ أَمَةَ قَوْمٍ الطَّلَاقُ إِلَى السَّيِّدِ أَوْ إِلَى الْعَبْدِ قَالَ الطَّلَاقُ إِلَى الْعَبْدِ.

Muhammad, from Ahmad, from Ibn Mahboub, from Jameel Bin Salih, from Abu Baseer who said, ‘I asked Abu Ja’far asws about the man who permits his slave that he marries the free woman, or a slave girl, would the divorced be fixed to the master or to the slave?’ He asws said: ‘The divorce is up to the slave’.
