فِي الْمُدَبَّرَةِ إِذَا مَاتَ مَوْلَاهَا أَنَّ عِدَّتَهَا أَرْبَعَةُ أَشْهُرٍ وَ عَشْرٌ مِنْ يَوْمِ يَمُوتُ سَيِّدُهَا إِذَا كَانَ سَيِّدُهَا يَطَؤُهَا قِيلَ لَهُ فَالرَّجُلُ يُعْتِقُ مَمْلُوكَتَهُ قَبْلَ مَوْتِهِ بِسَاعَةٍ أَوْ بِيَوْمٍ ثُمَّ يَمُوتُ قَالَ فَقَالَ هَذِهِ تَعْتَدُّ بِثَلَاثِ حِيَضٍ أَوْ ثَلَاثَةِ قُرُوءٍ مِنْ يَوْمَ أَعْتَقَهَا سَيِّدُهَا.

Muhammad, from Ahmad, from Ibn Mahboub, from Dawood Al Raqy, (It has been narrated) from Abu Abdullah asws regarding the Al-Mudabbira (promised freedom upon the death of her master), when her master dies, that her waiting period is of four months and ten (days) from the day of the death of her master, if her master had copulated with her’. It was said to him asws , ‘Supposing the man who emancipates his owned slave girl before his death, by an hour, or by a day, then he dies’. So he asws said: ‘This one would observer the waiting period of three menstruations, or three Quroos (pure periods), from the day her master emancipated her’.

[4]المشهور بين الاصحاب أنّه لو كان المولى يطؤها ثمّ دبرها اعتدت بعد وفاته باربعة أشهر و عشرة أيّام و لو اعتقها في حياته اعتدت بثلاثة أقراء و مستندهم هذه الرواية و نازع ابن إدريس في الامرين اما الأول فلان جعل عتقها بعد موته لا يصدق عليها انها زوجة و العدة مختصة بها كما تدل عليه الآية، و أمّا الثاني فلان المعتقة غير مطلقة فلا يلزمها عدة المطلقة.( آت)ص 172
