فِي رِوَايَةِ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ ع قَالَ:

لَا تُنْكَحُ ابْنَةُ الْأَخِ وَ لَا ابْنَةُ الْأُخْتِ عَلَى عَمَّتِهَا وَ لَا عَلَى خَالَتِهَا إِلَّا بِإِذْنِهِمَا وَ تُنْكَحُ الْعَمَّةُ وَ الْخَالَةُ عَلَى ابْنَةِ الْأَخِ وَ ابْنَةِ الْأُخْتِ بِغَيْرِ إِذْنِهِمَا.

Hadith.4438 - And in a narration from Muhammad ibn Muslim, from Abu Ja'far Imam Muhammad ibn Ali Al-Baqir (as), who said: "The daughter of a brother and the daughter of a sister cannot be married alongside their paternal or maternal aunt except with their permission. However, the paternal and maternal aunt can be married alongside the daughter of a brother or the daughter of a sister without requiring their permission."

[3]يدل على ما هو المشهور من اشتراط جواز تزويج بنت الاخت على الخالة و بنت الأخ على العمة على اذنهما و عدم الاشتراط في عكسه، و خالف في ذلك ابن أبي عقيل و ابن الجنيد على الظاهر من كلامهما و قالوا بجواز الجمع مطلقا.ص 412
