قُلْتُ لِأَبِي الْحَسَنِ الْأَوَّلِ ع رَجُلٌ مَاتَ وَ عَلَيْهِ زَكَاةٌ وَ أَوْصَى أَنْ تُقْضَى عَنْهُ الزَّكَاةُ وَ وُلْدُهُ مَحَاوِيجُ إِنْ دَفَعُوهَا أَضَرَّ ذَلِكَ بِهِمْ ضَرَراً شَدِيداً فَقَالَ يُخْرِجُونَهَا فَيَعُودُونَ بِهَا عَلَى أَنْفُسِهِمْ وَ يُخْرِجُونَ مِنْهَا شَيْئاً فَيُدْفَعُ إِلَى غَيْرِهِمْ.
5. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Ali ibn Yaqtin who has said the following: “I once asked abu al-Hassan, al-Awwal (a.s.), about a man who has died and he owes Zakat. He has made a will about payment of Zakat and his children are needy. If such payment is made it will harm them a great deal. He (the Imam) said, ‘They take the amount of Zakat out of the legacy and pay it to themselves, except something out of it to pay to others.’”

سَمِعْتُهُ يَقُولُ لَا يُعْطَى أَحَدٌ مِنَ الزَّكَاةِ أَقَلَّ مِنْ خَمْسَةِ دَرَاهِمَ وَ هُوَ أَقَلُّ مَا فَرَضَ اللَّهُ عَزَّ وَ جَلَّ مِنَ الزَّكَاةِ فِي أَمْوَالِ الْمُسْلِمِينَ فَلَا يُعْطُوا أَحَداً مِنَ الزَّكَاةِ أَقَلَّ مِنْ خَمْسَةِ دَرَاهِمَ فَصَاعِداً.
1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Hassan ibn Mahbub from abu Wallad al-Hannat who has said the following: “I once heard abu ’Abd Allah (a.s.), say, ’Less than five dirham of Zakat must not be given to anyone. This is the minimum that Allah, most Majestic, most Glorious, has made obligatory on the assets of the Muslims. Do not give anyone less than five dirham but give more and so on.’”

قُلْتُ لَهُ أُعْطِي الرَّجُلَ مِنَ الزَّكَاةِ ثَمَانِينَ دِرْهَماً قَالَ نَعَمْ وَ زِدْهُ قُلْتُ أُعْطِيهِ مِائَةً قَالَ نَعَمْ وَ أَغْنِهِ إِنْ قَدَرْتَ أَنْ تُغْنِيَهُ.
2. It is a narration from him (narrator of previous Hadith) by Ahmad from ‘Abd al-Malik ibn ‘Utaybah from Ishaq ibn ‘Ammar who has said the following: “I once asked abu al-Hassan (a.s.), ’Can eighty dirham be given as Zakat to someone? He (the Imam) said, ‘Yes, and increase it.’ I then asked, ‘Can one hundred dirham be given as Zakat to someone?’ He (the Imam) said, ‘Yes, you can make him rich if you can do so.’”

3. Ahmad ibn Idris has narrated from Muhammad ibn Ahmad from Ahmad ibn al-Hassan ibn Ali ibn Faddal from ‘Amr ibn Sa‘id from Musaddiq ibn Sadaqah from ‘Ammar ibn Musa who has said the following: “Abu ‘Abd Allah (a.s.), was once asked about how much Zakat can be given to one person. He (the Imam) said, that abu Ja‘far (a.s.), has said, ‘When you pay make him rich.’”

4. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Sa‘id ibn Ghazwan who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘Pay from Zakat until you make him rich (sufficient for his one year’s expenses).”’

قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع الرَّجُلُ يَمُوتُ وَ يَتْرُكُ الْعِيَالَ أَ يُعْطَوْنَ مِنَ الزَّكَاةِ قَالَ نَعَمْ حَتَّى يَنْشَوْا وَ يَبْلُغُوا وَ يَسْأَلُوا مِنْ أَيْنَ كَانُوا يَعِيشُونَ إِذَا قُطِعَ ذَلِكَ عَنْهُمْ فَقُلْتُ إِنَّهُمْ لَا يَعْرِفُونَ قَالَ يُحْفَظُ فِيهِمْ مَيِّتُهُمْ وَ يُحَبَّبُ إِلَيْهِمْ دِينُ أَبِيهِمْ فَلَا يَلْبَثُوا أَنْ يَهْتَمُّوا بِدِينِ أَبِيهِمْ فَإِذَا بَلَغُوا وَ عَدَلُوا إِلَى غَيْرِكُمْ فَلَا تُعْطُوهُمْ.

Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Hariz from abu Basir who has said the following: “I once asked abu ’Abd Allah (a.s.), about a man who dies and leaves behind dependents. Can Zakat be given to them? He (the Imam) said, ‘Yes, until they grow up, become adults and ask (themselves) by what means could they live and survive if that Zakat was cut off from them. I then said, ‘They do not know. He (the Imam) said, ‘The memories of their dead must be preserved and the religion of their father must be made beloved to them, so that they pay attention to the religion of their father; and if they become adults and decide to go to others; then do not give them any Zakat.”

[1]في النهاية: نشأ الصبى ينشأ نشأ فهو ناشئ إذا كبر و شب و لم يتكامل. و قوله:« إذا قطع» متعلق بالسؤال فان ذلك يوجب محبة منهم للشيعة و لمذهبهم لانه كان تعيشهم من مالهم ثمّ يحبب اليهم و يعرض عليهم دين ابيهم أعنى التشيع فان اختاروا و الا يقطع عنهم.( آت)ص 549
[2]أي يعطى الاطفال حفظا لشأن أبيهم المؤمن فان حفظ حرمة الميت كحفظ حرمة الحى و قوله عليه السلام:« فلا يلبثوا أن يهتموا» أي لا يتوقفوا في الاهتمام بدين أبيهم بل يتلقون بالقول اذا نشئوا فيه.( كذا في هامش المطبوع)ص 549
