بَابُ الرَّجُلِ يَدْفَعُ عَنْ نَفْسِهِ اللِّصَ‌

أَحْمَدُ بْنُ مُحَمَّدٍ الْكُوفِيُّ عَنْ مُحَمَّدِ بْنِ أَحْمَدَ الْقَلَانِسِيِّ عَنْ أَحْمَدَ بْنِ الْفَضْلِ عَنْ عَبْدِ اللَّهِ بْنِ جَبَلَةَ عَنْ فَزَارَةَ عَنْ أَنَسٍ أَوْ هَيْثَمِ بْنِ الْبَرَاءِ قَالَ:

قُلْتُ لِأَبِي جَعْفَرٍ ع اللِّصُّ يَدْخُلُ فِي بَيْتِي يُرِيدُ نَفْسِي وَ مَالِي قَالَ اقْتُلْ فَأُشْهِدُ اللَّهَ وَ مَنْ سَمِعَ أَنَّ دَمَهُ فِي عُنُقِي‌.

1. Ahmad ibn Muhammad al-Kufiy has narrated from Muhammad ibn Ahmad al-Qalanisiy from Ahmad ibn al-Fadl from ‘Abd Allah ibn Jabalah from Fazarah from Anas or Haytham ibn al-Bara’ who has said the following: “I asked abu Ja’far (a.s.), about a thief who may enter my house to harm my life or properties.’ He (the Imam) said, ’Eliminate him. Allah and those who hear me are my witness; his blood (life) is on my neck (my responsibility).”’

[2]هذا الخبر يدلّ على جواز قتل اللصّ للدفع عن النفس أو المال كما هو المذهب و قال الشهيد الثاني- رحمه اللّه-: لا إشكال في أصل الجواز مع القدرة و عدم لحوق ضرر و الأقوى وجوب الدفع عن النفس و الحريم مع الإمكان و لا يجوز الاستسلام فان عجز و رجا السلامة بالكف و الهرب وجب و اما المدافعة عن المال فان كان مضطر إليه و غلب على ظنه السلامة وجب و الا فلا.( آت)ص 51

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ النَّوْفَلِيِّ عَنِ السَّكُونِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ

قَالَ أَمِيرُ الْمُؤْمِنِينَ ص‌ إِنَّ اللَّهَ عَزَّ وَ جَلَّ لَيَمْقُتُ الرَّجُلَ يَدْخُلُ عَلَيْهِ اللِّصُّ فِي بَيْتِهِ فَلَا يُحَارِبُ.

2. Ali ibn Ibrahim has narrated from his father from al-Nawfaliy from al-Sakuniy who has said the following: “Abu ’Abd Allah (a.s.), has said that Amir al-Mu’minin (a.s.), has said, ‘Allah, the most Majestic, the most Glorious, hates a man who does not fight back the thief who has entered his house.’”

بِإِسْنَادِهِ‌ أَنَّ أَمِيرَ الْمُؤْمِنِينَ ع أَتَاهُ رَجُلٌ فَقَالَ

يَا أَمِيرَ الْمُؤْمِنِينَ إِنَّ لِصّاً دَخَلَ عَلَى امْرَأَتِي فَسَرَقَ حُلِيَّهَا فَقَالَ أَمِيرُ الْمُؤْمِنِينَ ع أَمَا إِنَّهُ لَوْ دَخَلَ عَلَى ابْنِ صَفِيَّةَ لَمَا رَضِيَ بِذَلِكَ حَتَّى يَعُمَّهُ بِالسَّيْفِ.

3. The narrator of the previous through his chain of narrators has said the following: “Once a man came to Amir al-Mu’minin (a.s.), and said, ’O Amir al-Mu’minin, a thief entered in the house of my wife and stole her ornaments. Amir al-Mu’minin (a.s.), said, ‘Had he (the thief) entered the house of the son of a clean woman he would not agree with less than overwhelming him (thief) by his sword.’”

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ رَجُلٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ

قَالَ أَمِيرُ الْمُؤْمِنِينَ ع‌ إِذَا دَخَلَ عَلَيْكَ اللِّصُّ الْمُحَارِبُ فَاقْتُلْهُ فَمَا أَصَابَكَ فَدَمُهُ فِي عُنُقِي.

4. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Aban ibn ‘Uthaman from a man formal-Halabiy who has said the following: “Abu ‘Abd Allah (a.s.), has said that Amir al-Mu’minin (a.s.), has said, ‘If a fighting thief enters your house, eliminate him. Whatever responsibility his blood (life) may bring is on my neck (my responsibility).”’
