بَابُ الْخَلِيَّةِ وَ الْبَرِيئَةِ وَ الْبَتَّةِ

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ جَمِيلِ بْنِ دَرَّاجٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ:

سَأَلْتُ أَبَا جَعْفَرٍ ع عَنِ الرَّجُلِ يَقُولُ لِامْرَأَتِهِ أَنْتِ مِنِّي خَلِيَّةٌ أَوْ بَرِيئَةٌ أَوْ بَتَّةٌ أَوْ حَرَامٌ قَالَ لَيْسَ بِشَيْ‌ءٍ.

1. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Jamil ibn Darraj from Muhammad ibn Muslim who has said the following: “I once asked abu Ja‘far (a.s.), about the case of a man who says to his wife, ’You from my side are free, cleared and severed’ or ‘you are unlawful.’ He (the Imam) said, ‘It does not have any valid effect.’”

[1]الخلية أي خالية من الزوج و كذا البريئة أي بريئة. و قوله:« بتة» أي مقطوعة الوصلة، و تنكير البتة جوزه الفراء و الاكثر على أنّه لا يستعمل الا معرفا باللام. و قال الجوهريّ: يقال:ص 135

عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ خَالِدٍ وَ عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ جَمِيعاً عَنْ عُثْمَانَ بْنِ عِيسَى عَنْ سَمَاعَةَ قَالَ:

سَأَلْتُهُ عَنْ رَجُلٍ قَالَ لِامْرَأَتِهِ أَنْتِ مِنِّي بَائِنٌ وَ أَنْتِ مِنِّي خَلِيَّةٌ وَ أَنْتِ مِنِّي بَرِيئَةٌ قَالَ لَيْسَ بِشَيْ‌ءٍ.

2. A number of our people have narrated from Ahmad ibn Muhammad from ibn Khalid and Ali ibn Ibrahim has narrated from his father all from ‘Uthman ibn ‘Isa from Sama‘ah who has said the following: “I once asked him (the Imam) (a.s.), about the case of a man who says to his wife, ‘You from my side are free and cleared.’ He (the Imam) said, ‘It does not have any valid effect.’”

3.
