بَابٌ فِيمَا يُصَابُ مِنَ الْبَهَائِمِ وَ غَيْرِهَا مِنَ الدَّوَابِ‌

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي نَجْرَانَ عَنْ عَاصِمِ بْنِ حُمَيْدٍ عَنْ مُحَمَّدِ بْنِ قَيْسٍ عَنْ أَبِي جَعْفَرٍ ع قَالَ:

قَضَى أَمِيرُ الْمُؤْمِنِينَ ع فِي عَيْنِ فَرَسٍ فُقِئَتْ عَيْنُهَا بِرُبُعِ ثَمَنِهَا يَوْمَ فُقِئَتْ عَيْنُهَا.

Ali Bin Ibrahim, from his father, from Ibn Abu Najran, from Aasim Bin Humeyd, from Muhammad Bin Qays, (It has been narrated) from Abu Ja’far asws having said: ‘Amir Al-Momineen asws judged regarding an eye of a horse which was blinded (by someone), by a quarter of its price on the day its eye was blinded (price when horse had both eyes)’.

[2]المشهور بين الاصحاب لزوم الارش في الجناية على أعضاء الحيوان مطلقا من غير تفصيل و ذهب الشيخ في الخلاف إلى أن كل ما في البدن منه اثنان و فيهما القيمة في أحدهما نصفها و عمل بمضمون هذه الأخبار ابن الجنيد و ابن البرّاج و ابن حمزة في الوسيلة و يحيى بن سعيد في الجامع و غيرهم و سائر الاصحاب ذكروها رواية. و حملها في المختلف على غير الغاصب في احدى العينين بشرط نقص القدر عن الارش و اللّه يعلم، و قال في الشرائع: لا تقدير في قيمة شي‌ء من أعضاء الدابّة بل رجع الى الارش السوقى و روى في عين الدابّة ربع قيمتها و حكى الشيخ في المبسوط و الخلاف عن الاصحاب في عين الدابّة نصف قيمتها و في العينين كمال قيمتها و كذا في كل ما في البدن منه اثنان و الرجوع إلى الارش.( آت)ص 367

A number of our companions, from Sahl Bin Ziyad, from Muhammad Bin Al Hassan Bin Shamoun, from Abdullah Bin Abdul Rahman, from Misma’a, (It has been narrated) from Abu Abdullah asws that Amir Al-Momineen asws , a matter was raised to him asws of a man who killed a pig, so he asws made him responsible for its price, and a matter was raised to him asws of a man who had broken a guitar (musical instrument), so he asws invalidated it (dismissed the case)’.

Rasool-Allah saww ordered it to be paid to the Clan of Juzayma’.

دِيَةُ الْكَلْبِ السَّلُوقِيِّ أَرْبَعُونَ دِرْهَماً جَعَلَ ذَلِكَ رَسُولُ اللَّهِ ص وَ دِيَةُ كَلْبِ الْغَنَمِ كَبْشٌ وَ دِيَةُ كَلْبِ الزَّرْعِ جَرِيبٌ مِنْ بُرٍّ وَ دِيَةُ كَلْبِ الْأَهْلِيِّ قَفِيزٌ مِنْ تُرَابٍ لِأَهْلِهِ.

Ali, from his father, from Muhammad Bin Hafs, from Ali Bin Abu Hamza, from Abu Baseer, (It has been narrated) from one of the two (5 th or 6 th Imam asws ) having said: ‘Wergild of the greyhound dog is forty Dirhams, Rasool-Allah saww made it to be that, and wergild of the shepherd dog, and the wergild of the plantation guard dog being a ‘ Jareyb ’ (unit of measurement) from the wheat; and wergild of domesticated dog being a ‘ Qafeez ’ (Unit of measurement) from the soil of its owners’.

النَّوْفَلِيُّ عَنِ السَّكُونِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ

قَالَ رَسُولُ اللَّهِ ص‌ فِي جَنِينِ الْبَهِيمَةِ إِذَا ضُرِبَتْ فَأَزْلَقَتْ عُشْرُ ثَمَنِهَا.

Al Nowfaly, from Al Sakuny, (It has been narrated) from Abu Abdullah asws having said: ‘Rasool-Allah saww said regarding a foetus of the animal when it is truck, so it aborts it, (the compensation is) being one-tenth of its price’.

قَضَى أَمِيرُ الْمُؤْمِنِينَ ع فِي فَرَسَيْنِ اصْطَدَمَا فَمَاتَ أَحَدُهُمَا فَضَمَّنَ الْبَاقِيَ دِيَةَ الْمَيِّتِ.

Ahmad Bin Muhammad Al Kufy, from Ibrahim Bin Al Hassan, from Muhammad Bin Khalaf, from Musa Bin Ibrahim Al Marouzy, (It has been narrated) from Abu Al-Hassan Musa asws having said: ‘Amir Al-Momineen asws judged regarding two horses collided, so one of the two dies. So the responsibility is upon the (owner of the) remaining one, wergild of the dead (horse)’.
