خَرَجَ أَبُو عَبْدِ اللَّهِ ع مِنَ الْمَدِينَةِ فِي أَيَّامٍ بَقِينَ مِنْ شَعْبَانَ فَكَانَ يَصُومُ ثُمَّ دَخَلَ عَلَيْهِ شَهْرُ رَمَضَانَ وَ هُوَ فِي السَّفَرِ فَأَفْطَرَ فَقِيلَ لَهُ تَصُومُ شَعْبَانَ وَ تُفْطِرُ شَهْرَ رَمَضَانَ فَقَالَ نَعَمْ شَعْبَانُ إِلَيَّ إِنْ شِئْتُ صُمْتُ وَ إِنْ شِئْتُ لَا وَ شَهْرُ رَمَضَانَ عَزْمٌ مِنَ اللَّهِ عَزَّ وَ جَلَّ عَلَيَّ الْإِفْطَارُ.

1. A number of our people have narrated from Sahl ibn Ziyad from Mansur ibn al-‘Abbas from Muhammad ibn ‘Abd Allah ibn Wash from ‘Isma‘il ibn Sahl from a man who has said the following: “Once abu ‘Abd Allah (a.s.), commenced a journey just a few days before the end of the month of al-Sha‘ban and he (the Imam) was fasting. The month of Ramadan then started while he (the Imam) was still on his journey but he stopped fasting. He (the Imam) was asked, ‘How is it that you have been fasting in the month of al-Sha‘ban and stopped fasting in the month of Ramadan?’ He (the Imam) said, ‘In the case of the month of al-Sha‘ban it is up to me to fast or not to fast: however, in the case of the month of Ramadan it is the commandment of Allah, most Majestic, most Glorious, to stop fasting (on a journey).’”

A number of our people have narrated from Ahmad ibn Muhammad from ibn Khalid and Ali ibn Ibrahim has narrated from his father from all from ‘Uthman ibn ‘Isa from Sama‘ah who has said the following: “I once asked him (the Imam) (a.s.), about the divorce of a boy who is not mature yet, and his charity. He (the Imam) said, ‘If he divorces according to Sunnah and places charity in the proper place where it rightly belongs, it is not unlawful and it is permissible.’”

وَ أَخْبِرْنِي عَنِ الْخُنْثَى وَ قَوْلِ أَمِيرِ الْمُؤْمِنِينَ ع فِيهِ يُوَرَّثُ الْخُنْثَى مِنَ الْمَبَالِ مَنْ يَنْظُرُ إِلَيْهِ إِذَا بَالَ وَ شَهَادَةُ الْجَارِّ إِلَى نَفْسِهِ لَا تُقْبَلُ مَعَ أَنَّهُ عَسَى أَنْ تَكُونَ امْرَأَةً وَ قَدْ نَظَرَ إِلَيْهَا الرِّجَالُ أَوْ عَسَى أَنْ يَكُونَ رَجُلًا وَ قَدْ نَظَرَ إِلَيْهِ النِّسَاءُ وَ هَذَا مِمَّا لَا يَحِلُّ فَأَجَابَهُ أَبُو الْحَسَنِ الثَّالِثُ ع عَنْهَا أَمَّا قَوْلُ عَلِيٍّ ع فِي الْخُنْثَى أَنَّهُ يُوَرَّثُ مِنَ الْمَبَالِ فَهُوَ كَمَا قَالَ وَ يَنْظُرُ قَوْمٌ عُدُولٌ يَأْخُذُ كُلُّ وَاحِدٍ مِنْهُمْ مِرْآةً وَ يَقُومُ الْخُنْثَى خَلْفَهُمْ عُرْيَانَةً فَيَنْظُرُونَ فِي الْمِرْآةِ فَيَرَوْنَ شَبَحاً فَيَحْكُمُونَ عَلَيْهِ‌.

1. Ali ibn Muhammad has narrated from Muhammad ibn Sa‘id al-Azarbayijaniy and Muhammad ibn Yahya from ‘Abd Allah ibn Ja‘far from al-Hassan ibn Ali ibn Kaysan all from Musa ibn Muhammad son of brother of abu al-Hassan, al-Thalith (a.s.), who has narrated the following: “Yahya ibn Aktham asked him (the Imam) questions; among the questions that he asked one was about hermaphrodite and the words of ’ Amir al-Mu’minin that a hermaphrodite inherits according to the manner of urinating and that who must look at the child (the person) when urinating and that the testimony of one who is unfair to himself is not accepted. That perhaps such person is a female and a man looks at her or that the person is a female and a man has looked at her, which is not lawful. Abu al-Hassan, al-Thalith (a.s.), answered him saying, ‘The words of ’ Amir al-Mu’minin that a hermaphrodite inherits according to the manner of urinating, are as they are. People of justice must look at hermaphrodite, each one takes a mirror, and the hermaphrodite stands behind them. They see a form and judge accordingly.”’

2. A number of our people have narrated from Ahmad ibn Muhammad ibn Khalid from certain individuals of our people in a marfu’ manner from the Imam (a.s.) who has said the following: “Say before beginning the prayer, ‘O Lord, I give the lead to Muhammad Your Prophet for the help I need and turn to You through him for my request, grant me respect through him (and his Ahl al-Bayt) in this world and in the next and to be of the people close (to You), O Lord, deem my prayer through them acceptable, my sins forgiven and my call for help through them answered, O the Beneficent, the Merciful.’”

2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ahmad ibn Hilal from ‘Amr ibn ‘Uthman from ‘Adhafir who has said the following: “I once said to abu ‘Abd Allah (a.s.), that I fast these three days of the month but perhaps I travel or become ill, am I required to complete its Qada’ (compensatory fast)? He (the Imam) said, ‘Qada’ (compensatory fast) is obligatory for obligatory fast which is missed. In the case of optional fast it is up to you.’ I then asked, ‘Is it up to one’s choice even when on a journey and in illness?’ He (the Imam) said, ‘In the case of illness Allah, most Majestic, most Glorious, has exempted you, but in the case of journey you can complete its Qada’ (compensatory fast) and if you did not do so it is not harmful.’”

شَهِدْتُ أَبَا عَبْدِ اللَّهِ ع وَ اسْتَقْبَلَ الْقِبْلَةَ قَبْلَ التَّكْبِيرِ وَ قَالَ اللَّهُمَّ لَا تُؤْيِسْنِي مِنْ رَوْحِكَ وَ لَا تُقَنِّطْنِي مِنْ رَحْمَتِكَ وَ لَا تُؤْمِنِّي مَكْرَكَ فَإِنَّهُ لَا يَأْمَنُ‌ مَكْرَ اللَّهِ إِلَّا الْقَوْمُ الْخاسِرُونَ‌- قُلْتُ جُعِلْتُ فِدَاكَ مَا سَمِعْتُ بِهَذَا مِنْ أَحَدٍ قَبْلَكَ فَقَالَ إِنَّ مِنْ أَكْبَرِ الْكَبَائِرِ عِنْدَ اللَّهِ الْيَأْسَ مِنْ رَوْحِ اللَّهِ وَ الْقُنُوطَ مِنْ رَحْمَةِ اللَّهِ وَ الْأَمْنَ مِنْ مَكْرِ اللَّهِ.

3. It is narrated from him (narrator of the Hadith above) from his father from ‘Abd Allah ibn al-Qasim from Safwan al-Jammal who has said the following: “I observed Abu ‘Abdillah (a.s.) facing the Qiblah (direction of Ka’bah) before saying Takbir (Allah is greater than can be described) saying, ‘O Lord, do not cause me to lose hope in Your favors and to despair me of Your kindness, or become careless about Your displeasure; no one except the losing people become careless toward the displeasure of Allah.’ I then said, ‘May Allah keep my soul in service for your cause, I have not heard this from anyone before.’ The Imam said, ‘Of the greatest major sins before Allah is to lose hope of the favors of Allah, despair of the mercy of Allah and to become careless about the displeasure of Allah.’”

He (the Imam) said, ‘No, he is not required to fast.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ‘Isa from Mansur from Hisham ibn Salim who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who consumes Riba ’ and he considers it lawful. He (the Imam) replied, ‘It does not harm him as long as he does not consume it knowing that it is unlawful, in which case he will face the condition of one who is mentioned in the words of Allah, most Majestic, most Glorious.

[3]الربا: معاوضة متجانسين مكيلين او موزونين بزيادة في أحدهما و إن كانت حكيمة كحال بمؤجل، أو مع إبهام قدره و ان كان باختلافهما رطبا و يابسا و أكثر اطلاقه على تلك الزيادة.( فى) و الزنية- بالفتح و الكسر-: الزنا.ص 144

[1]قال العلامة في التذكرة: يجب على آخذ الربا المحرم رده على مالكه ان عرفه و لو لم يعرف المالك تصدق عنه لانه مجهول المالك و لو وجد المالك قد مات سلم الى الوراث فان جهلهم تصدق به ان لم يتمكن من استعلامهم و لو لم يعرف المقدار و عرف المالك صالحه و لو لم يعرف المقدار و لا المالك أخرج خمسه و حل له الباقي هذا إذا فعل الربا متعمدا أمّا إذا فعله جاهلا بتحريمه فالاقوى أنّه أيضا كذلك و قيل: لا يجب عليه رده لقوله تعالى:« فَمَنْ جاءَهُ مَوْعِظَةٌ مِنْ رَبِّهِ فَانْتَهى‌ فَلَهُ ما سَلَفَ» و هو يتناول ما أخذه على وجه الربا و لما روى عن الصادق عليه السلام. انتهى.ص 145

3. Humayd ibn Ziyad has narrated from ibn Sama‘ah ‘Abd Allah ibn Jabalah from Ali ibn abu Hamzah from abu Basir who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘Divorce by a child and one who is drunk do not have any valid effect.’”

4. Ahmad ibn Muhammad has narrated from al-Marzuban ibn ‘Imran who has said the following: “I once asked al-Rida’ (a.s.), that I like to travel; can I fast in the month in which I am on a journey? He (the Imam) said, ‘No, you cannot do so.’ ‘Can I complete its Qada’ (compensatory fast) when I come home?’ I asked. He (the Imam) said, ‘No, just as you cannot fast in the same way you cannot carry out its Qada’ (compensatory fast).”’

4. Ahmad ibn Muhammad from has narrated from al-Washsha’ from abu al-Mighra’ from al-Halabiy, who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘Any kind of Riba ’ people have consumed in ignorance then repented, such repentance is accepted if such repentance is found in them.’ He (the Imam) then said, ‘If a man inherits goods, from his father and knows that there is Riba ’ in it but is mixed in trade with other lawful goods it is lawful and clean for him and he has permission to consume such properties. If however, he comes to know the Riba ’ item, he then must separate his capital and return the Riba’ property. If one earns a great deal of property in which there is a great deal of Riba’ but does not know such property exactly and afterwards comes to know it and wants to remove it, what is passed is for him but he must stay away from Riba ’ in coming times.’”

5. A number of our people have narrated from Sahl ibn Ziyad from Ali ibn Bilal from al-Hassan ibn Bassam al-Jammal from a man who has said the following: “I once was with abu ‘Abd Allah (a.s.), between Makkah and al-Madinah in the month of al-Sha‘ban and he (the Imam) was fasting; then we saw the crescent of the month of Ramadan and he (the Imam) stopped fasting. I then said, ‘I pray to Allah to keep my soul in service for your cause, yesterday was of the month of al-Sha‘ban and you were fasting, but today is of the month of Ramadan and you are not fasting. He (the Imam) said, ‘That was optional and it is up to us to do what we want, but this is obligatory and we have no choice but to do what we are commanded to do.’”

5. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “Abu ‘Abd Allah (a.s.), has said that once a man came to my father and said, ‘I have inherited a certain amount of property and I knew the owner from whom I inherited received Raba’ and I know with certainty there is Riba’ in it and I do not feel happy to consume it because of my knowledge about it. I asked the scholars of law of Iraq about it and they said, ‘It is not lawful to consume it.’ Abu Ja‘far (a.s.), said, ‘If you know exactly Riba’ property in it and you know the owner also, you must separate it and return to the owner. If it is mixed you can consume it in good health and pleasure. It is your property but you must stay away from what the previous owner would do. The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, granted relief to what is passed and prohibited from Riba ’ in coming times. If one is ignorant he is exempt, until he comes to know of the unlawfulness of Riba Once a person learns that Riba ’ is unlawful and punishment becomes necessary if one consumes Riba’ just as it (punishment) is necessary for one who has consumed Riba’.’”

6. Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Ibrahim ibn ‘Umar af-Yamaniy who has said the following: “Abu ‘Abd Allah (a.s.), has said that Riba’ is of two kinds: One kind is that which is consumed and the other kind is not consumed. The gift that one presents to someone in order to receive Thawab (rewards from Allah) is better. Of this kind is the Riba’ which is consumed as it is mentioned in the words of Allah, most Majestic, most Glorious, ’The Riba’ in which you are involved so it increases in people’s property does not increase before Allah.’ (30:38) The other kind of Riba’ is that which Allah, most Majestic, most Glorious, has prohibited and has warned those involved in it with punishment in the fire.”

He (the Imam) asked, ’Do you know why He has done so?’ I (the narrator) replied, ’No, I do not know.’ He (the Imam) said, ‘It is because He wants people not to deny performing good and benevolent deeds.’”

A number of our people have narrated from Sahl ibn Ziyad and Ahmad ibn Muhammad from all from ibn Mahbub from Khalid ibn Jarir from abu al-Rabi‘ al-Shamiy who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who received Riba’ in ignorance, then he wanted to stay away from Riba’. He (the Imam) said ’What is passed is for him and he must stay away in the coming times.’ He (the Imam) then said, ’Once a man visited abu Ja’far (a.s.), and said, “I have inherited a certain amount of property and noticed that the owner of that property was involved in Riba’. I asked the scholars of law of Iraq and Hijaz and they said that consuming it is not lawful.” Abu Ja’far (a.s.), said, “If you know the Riba’ item distinctly and know the owners of such property, you must return it to them, if you know it is Riba’, take away your capital and leave the rest. If the property is mixed, you can consume them in good health and with pleasure; the property is your property and stay away from what your companion was involved in. The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, exempted what had passed of Riba’. One who is ignorant is exempt and is allowed to consume such property. Once he comes to know then it becomes unlawful for him to consume. Ahmad ibn Muhammad from has narrated from ibn Faddal from ibn Bukayr from ‘Ubayd ibn Zurarah from who has said the following: “Abu ‘Abd Allah (a.s.), was informed about a man who consumed Riba ’ and called it fresh milk. Abu ‘Abd Allah (a.s.), said, ‘Had Allah, most Majestic, most Glorious, made it possible for me I most certainly would strike his neck.’”

Ali ibn Ibrahim has narrated from his father from ibn abu Najran from ‘Asim ibn Hamid from m h ibn Qays, who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said that Amir al-Mu’minin, ‘Alayhi al-Salam, has said, ‘One who consumes Riba’, one who feeds Riba ’ and one who documents it, are all the same (in committing this sins).”’

A number of our people have narrated from Sahl ibn Ziyad from Muhammad ibn al-Husayn from a number of his people from ibn Bukayr who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Divorce by a child is [not] permissible if he understands as well as his will and charity and even if he does not experience wet dream.’” Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad Ahmad ibn Muhammad from Muhammad ibn al-Husayn all from ibn Faddal from ibn Bukayr from ‘Abd Allah ‘Alayhi al-Salam, a similar Hadith.
