قُلْتُ جُعِلْتُ فِدَاكَ لِلْمُسْلِمِينَ عِيدٌ غَيْرَ الْعِيدَيْنِ قَالَ نَعَمْ يَا حَسَنُ أَعْظَمُهُمَا وَ أَشْرَفُهُمَا قُلْتُ وَ أَيُّ يَوْمٍ هُوَ قَالَ هُوَ يَوْمٌ نُصِبَ أَمِيرُ الْمُؤْمِنِينَ صَلَوَاتُ اللَّهِ وَ سَلَامُهُ عَلَيْهِ فِيهِ عَلَماً لِلنَّاسِ قُلْتُ جُعِلْتُ فِدَاكَ وَ مَا يَنْبَغِي لَنَا أَنْ نَصْنَعَ‌ فِيهِ قَالَ تَصُومُهُ يَا حَسَنُ وَ تُكْثِرُ الصَّلَاةَ عَلَى مُحَمَّدٍ وَ آلِهِ وَ تَبَرَّأُ إِلَى اللَّهِ مِمَّنْ ظَلَمَهُمْ فَإِنَّ الْأَنْبِيَاءَ صَلَوَاتُ اللَّهِ عَلَيْهِمْ كَانَتْ تَأْمُرُ الْأَوْصِيَاءَ بِالْيَوْمِ الَّذِي كَانَ يُقَامُ فِيهِ الْوَصِيُّ أَنْ يُتَّخَذَ عِيداً قَالَ قُلْتُ فَمَا لِمَنْ صَامَهُ قَالَ صِيَامُ سِتِّينَ شَهْراً وَ لَا تَدَعْ صِيَامَ يَوْمِ سَبْعٍ وَ عِشْرِينَ مِنْ رَجَبٍ فَإِنَّهُ هُوَ الْيَوْمُ الَّذِي نَزَلَتْ فِيهِ النُّبُوَّةُ عَلَى مُحَمَّدٍ ص وَ ثَوَابُهُ مِثْلُ سِتِّينَ شَهْراً لَكُمْ.

1. Ali ibn Ibrahim has narrated from his father from al-Qasim ibn Yahya from his grandfather al-Hassan ibn Rashid from abu ‘ Abdillah (a.s.), I said to him: ’May I be sacrificed for you, is there another ‘Id for the Muslims, besides the two ‘Ids?‘ He replied, ‘Yes, O Hassan, there is a greater and more important ‘Id than these.’ I then asked, ‘And what day is that?’ He replied, ‘It is the day when ’Amir al-Mu’minin (a.s.) was appointed as the banner and lighthouse for people.’ I then said, ‘May I be sacrificed for you, what then should we do on this (day)?’ He replied, ‘Fast, O Hassan, increase your blessings upon Muhammad and his family, and denounce before Allah those who did injustice to them. Verily, the prophets, may the blessings of Allah be upon them, would command the successors to celebrate the day when they were appointed as a successor, as ‘Id.’ I then asked, ‘What happens if one fasts on such day?’ He replied, ‘Fasting on this day is equal to fasting for sixty months. Do not ignore fasting on the twenty-seventh of the month of Rajab, for it is the day when prophethood came down up on Muhammad (sw). Its reward is equal to sixty months (of fasting) for you.”’

1. Muhammad ibn Yahya has narrated from Muhammad ibn Ahmad from Ya’qub Yazid from al-Ghifariy from al-Qasim ibn Muhammad ibn Ishaq from his father from his grandfather who has said the following: “He (the Imam) (a.s.), has said that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said, ‘Of the signs of happiness of Allah, most High, with His creatures is the existence of a just ruler and low prices. Of the signs of unhappiness of Allah, most High with His creatures is the existence of an unjust ruler and high prices.’”

لَا يَحِلُّ خُلْعُهَا حَتَّى تَقُولَ لِزَوْجِهَا وَ اللَّهِ لَا أُبِرُّ لَكَ قَسَماً وَ لَا أُطِيعُ لَكَ أَمْراً وَ لَا أَغْتَسِلُ لَكَ مِنْ جَنَابَةٍ وَ لَأُوطِئَنَّ فِرَاشَكَ وَ لآَذَنَنَّ عَلَيْكَ بِغَيْرِ إِذْنِكَ‌ وَ قَدْ كَانَ النَّاسُ يُرَخِّصُونَ فِيمَا دُونَ هَذَا فَإِذَا قَالَتِ الْمَرْأَةُ ذَلِكَ لِزَوْجِهَا حَلَّ لَهُ مَا أَخَذَ مِنْهَا فَكَانَتْ عِنْدَهُ عَلَى تَطْلِيقَتَيْنِ بَاقِيَتَيْنِ وَ كَانَ الْخُلْعُ تَطْلِيقَةً وَ قَالَ يَكُونُ الْكَلَامُ مِنْ عِنْدِهَا وَ قَالَ لَوْ كَانَ الْأَمْرُ إِلَيْنَا لَمْ نُجِزْ طَلَاقاً إِلَّا لِلْعِدَّةِ.

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “Abu ‘Abd Allah (a.s.), has stated this Hadith. ‘Al-Khul‘ (divorce for payment) is not lawful until she says to her husband, “By Allah, I will not honor your turn, will not obey your order, will not take Ghusl (bath) for you because of sexual intercourse, will not sit on your furnishing and I will give permission without your permission.” People applied KhuV for less than that. The woman’s saying that to her husband makes it lawful for him to receive payment from her. She remains for him for two more divorces and al-Khul‘ is one divorce.’ He (the Imam) said, ‘The statements come from her.’ He (the Imam) said, ‘Had the matter been in our hands we would not allow divorce except with waiting period.’”

A number of our people have narrated from Ahmad ibn Muhammad ibn ‘Isa from Dawud from those whom he has mentioned who has narrated the following: “Abu ‘Abd Allah (a.s.), has said that in the time of ’Amir al-Mu’minin a man died and had no heirs. ’Amir al-Mu’minin gave his legacy to his Hamshahrijah (his fellow countryman). 5 ”

بَعَثَ اللَّهُ عَزَّ وَ جَلَّ مُحَمَّداً ص‌ رَحْمَةً لِلْعالَمِينَ‌ فِي سَبْعٍ وَ عِشْرِينَ مِنْ رَجَبٍ فَمَنْ صَامَ ذَلِكَ الْيَوْمَ كَتَبَ اللَّهُ لَهُ صِيَامَ سِتِّينَ شَهْراً وَ فِي خَمْسَةٍ وَ عِشْرِينَ مِنْ ذِي الْقَعْدَةِ وُضِعَ الْبَيْتُ وَ هُوَ أَوَّلُ رَحْمَةٍ وُضِعَتْ عَلَى وَجْهِ الْأَرْضِ فَجَعَلَهُ اللَّهُ عَزَّ وَ جَلَ‌ مَثابَةً لِلنَّاسِ‌ وَ أَمْناً فَمَنْ صَامَ ذَلِكَ الْيَوْمَ كَتَبَ اللَّهُ لَهُ صِيَامَ سِتِّينَ شَهْراً وَ فِي أَوَّلِ يَوْمٍ مِنْ ذِي الْحِجَّةِ وُلِدَ إِبْرَاهِيمُ خَلِيلُ الرَّحْمَنِ ع فَمَنْ صَامَ ذَلِكَ الْيَوْمَ كَتَبَ اللَّهُ لَهُ صِيَامَ سِتِّينَ شَهْراً.

2. A number of our people have narrated from Sahl ibn Ziyad from certain individuals of our people who have said the following: “Abu al-Hassan, the 1st (a.s.), has said ‘Allah, the Most Majestic, the Most Glorious, sent Muhammad (SAW), as a mercy for the worlds on the twenty-seventh of the month of Rajab. Allah counts one’s fasting during this day as fasting for sixty months. On the twenty- fifth of Dhul al-Qa’dah, the House was established, and it was the first instance of mercy established on earth. Allah, the Most Majestic, the Most Glorious, made a place to gain rewards and a place of inviolability. Allah counts one’s fasting during this day as fasting for sixty months. On the first day of Dhul Hajjah, Ibrahim, the friend of the Beneficent was born. Allah counts one’s fasting during this day as fasting for sixty months.”

It is narrated from the narrator of the previous Hadith from his father and A number of our people have narrated from Ahmad ibn Muhammad from ibn Khalid all from ‘Uthman ibn ‘Isa from Sama‘ah who has said the following: “I once asked him (the Imam) (a.s.), about the case of a woman divorced by means of al- Khul‘. He (the Imam) said, ‘It is not lawful for him until she says, ‘I will not honor your turn, follow any of the laws of Allah about you, will not take Ghusl (bath) for you because of sexual intercourse, will not step on your furnishings, will allow to enter your house, without your knowledge, such people whom you dislike. They do not speak to her and she is the one who makes such statements. When she finalizes al-Khul ‘ she becomes stranger and he can take from her assets as much as he can. He does not have the right to take all that the contesting and denouncing wife gives.’”

Sahl ibn Ziyad has narrated from ‘Abd al-Rahman ibn Salim from his father who has said the following: “I once asked abu ‘Abd Allah (a.s.), ‘Are there for Muslims other ‘Id besides, Friday, the tenth of the month of Dhul Hajjah and the first day of the month of Shawwal?’ He (the Imam) replied, ‘Yes, there is such a day, in fact, it is of greater importance.’ I then asked, ‘I pray to Allah to keep my soul in service for your cause, which days are they?’ He replied, ‘One is the day during which the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, announced the appointment of ’Amir al-Mu’minin (as the executor of his will), saying, “Whoever’ s guardian I am, Ali also is his guardian.’” I then asked, ‘Which day is this day?’ He replied, ‘What do you have to do with the day; the year goes around, however, it is the eighteenth of the month of Dhul Hajjah.’ I then asked, ‘What should we do during this day?’ He replied, ‘You should pay attention to Allah, majestic is whose mention, by fasting, worshipping and speaking of Muhammad and his family, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause. The Messenger of Allah advised ’Amir al-Mu’minin to celebrate this day as ‘Id. This is what the prophets would do. They would advise the executors (of their wills) to celebrate this day as a day of ’Id.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn al-‘Abbas ibn Ma’ruf from al-Hajjal from certain persons of his people from abu Hamzah al-Thumaliy who has said the following: “Ali ibn Al-Husayn (a.s.), has said, ‘Allah, most Majestic, most Glorious, has assigned an angel who regulates prices by His command.’”

الْمُخْتَلِعَةُ الَّتِي تَقُولُ لِزَوْجِهَا اخْلَعْنِي وَ أَنَا أُعْطِيكَ مَا أَخَذْتُ مِنْكَ فَقَالَ لَا يَحِلُّ لَهُ أَنْ يَأْخُذَ مِنْهَا شَيْئاً حَتَّى تَقُولَ وَ اللَّهِ لَا أُبِرُّ لَكَ قَسَماً وَ لَا أُطِيعُ لَكَ أَمْراً وَ لآَذَنَنَّ فِي بَيْتِكَ بِغَيْرِ إِذْنِكَ وَ لَأُوطِئَنَّ فِرَاشَكَ غَيْرَكَ فَإِذَا فَعَلَتْ ذَلِكَ مِنْ غَيْرِ أَنْ يَعْلَمَهَا حَلَّ لَهُ مَا أَخَذَ مِنْهَا وَ كَانَتْ تَطْلِيقَةً بِغَيْرِ طَلَاقٍ يَتْبَعُهَا فَكَانَتْ بَائِناً بِذَلِكَ وَ كَانَ خَاطِباً مِنَ الْخُطَّابِ.

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from abu Ayyub from Muhammad ibn Muslim who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘The woman who is divorced by means of al-Khul‘, who says to her husband, ‘Divorce me and I pay what I have received from you.’ He (the Imam) said, ‘It is not lawful for him to receive such payment until she says, ‘By Allah, I will not honor your turn, will not obey any of your orders, will allow people to enter your house without your permission and will allow others to sleep in your bed.’ When she does this without informing him, then receiving payment from her is lawful, she is divorced once without any other divorce to follow, and she becomes a stranger. He is then one of those who can propose marriage with her.’”

A number of our people have narrated from Sahl ibn Ziyad from Yusuf al-Sukht from Hamdan ibn al-Nadr from Muhammad ibn ‘Abd Allah al-Sayqal who has said the following: “Abu al-Hassan, meaning al-Rida (a.s.), once came out to us on the twenty-fifth day of the month of Dhul Qa’dah and said, ‘Fast, for today I have awoken while fasting.’ We then said, ‘May we be sacrificed for you, which day is it?’ He replied, ‘It is the day during which the mercy (of Allah) was spread, the earth was extended, al-Ka‘bah was placed in it, and Adam (AS) descended therein.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ’Isma‘il has narrated from af-Fadl ibn Shadhan from abu al-Sabbah af-Kinaniy who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘If a man divorces his wife in the manner of al-Khul‘, it then is one divorce with which she becomes stranger to him and he then is one of those who may propose marriage. Al-KhuT is not lawful for him unless she is the one who demands for divorce from him without being beaten by her husband. That she says, ‘I will not honor your turn, will not take Ghusl (bath) for you because of sexual intercourse, I will allow people whom you dislike to enter your house, allow your bed to be used by others and will not obey any of the laws of Allah about you.’ When this happens from her side, then it is fine for him to receive the payment from her.’”

A number of our people have narrated from Ahmad ibn Muhammad ibn Khalid from ‘Abd al- Rahman ibn Hammad from Yunus ibn Ya’qub from Sa‘d from a man who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘When things were given in the control of Joseph ibn Ya’qub (a.s.), he placed the grain in houses (storage) and issued an order to his servants to sell for a price of such and such amount. Prices were fixed. When he learned that prices are high he disliked to speak of high prices and then said, ‘Go and sell without mentioning prices.’ The agent before going far away returned to him. He said, ‘Go and sell.’ He disliked speaking of high prices. The agent went back and the first buyer came. The agent measured for him and when it was still less than the amount of the previous day by one measurement the buyer said, ‘It is enough; I only wanted this much for this much.’ The agent realized that prices are still high. Then another buyer came and asked him to measure for him. He measured for him and it still was one less than the measurement for the previous buyer when this buyer said, ‘This much is enough. I only wanted this much (grain) for this much (money).’ The agent realized that prices are still high and so on until it came down to one for one.’”

[1]هذه الأخبار تدلّ على أن السعر بيد اللّه تعالى و قد اختلف المتكلمون في ذلك فذهبت الأشاعرة إلى أنه ليس المسعر إلّا اللّه تعالى بناء على أصلهم من أن لا مؤثر في الوجود إلّا اللّه و اما الإماميّة و المعتزلة فقد ذهبوا إلى أن الغلاء و الرخص قد يكونان بأسباب راجعة إلى اللّه و قد يكونان باسباب ترجع الى اختيار العباد و أمّا الاخبار الدالة على أنهما من اللّه فالمعنى أن أكثر أسبابهما راجعة الى قدرة اللّه أو أن اللّه تعالى لما لم يصرف العباد عما يختارونه من ذلك مع ما يحدث في نفوسهم من كثرة رغباتهم أو غناهم بحسب المصالح فكانهما وقعا بارادته تعالى كما مرّ القول فيما وقع من الآيات و الاخبار الدالة على أن افعال العباد بارادة اللّه تعالى و مشيته و هدايته و اضلاله و توفيقه و خذلانه و يمكن حمل بعض تلك الاخبار على المنع من التسعير و النهى عنه بل يلزم الوالى أن لا يجبر الناس على السعر و يتركهم و اختيارهم فيجرى السعر على ما يريد اللّه تعالى. قال العلامة رحمه اللّه في شرحه على التجريد: السعر هو تقدير العوض الذي يباع به الشي‌ء و ليس هو الثمن و لا المثمن و هو ينقسم الى رخص و غلاء فالرخص هو السعر المنحط عما جرت به العادة مع اتّحاد الوقت و المكان و الغلاء زيادة السعر عما جرت به العادة مع اتّحاد« بقية الحاشية في الصفحة الآتية»« بقية الحاشية من الصفحة الماضية» الوقت و المكان و انما اعتبرنا الزمان و المكان لانه لا يقال: ان الثلج قد رخص سعره في الشتاء عند نزوله لانه ليس أوان سعره و يجوز أن يقال: رخص في الصيف إذا نقص سعره عما جرت عادته في ذلك الوقت و لا يقال: رخص سعره في الجبال التي يدوم نزوله فيها لأنّها ليست مكان بيعه و يجوز أن يقال: رخص سعره في البلاد التي اعتيد بيعه فيها و اعلم أن كل واحد من الرخص و الغلاء قد يكون من قبله تعالى بأن يقلل جنس المتاع المعين و يكثر رغبة الناس إليه فيحصل الغلاء لمصلحة المكلفين و قد يكثر جنس ذلك المتاع و يقلل رغبة الناس إليه تفضلا منه و إنعاما أو لمصلحة دينية فيحصل الرخص و قد يحصلان من قبلنا بأن يحمل السلطان الناس على بيع جميع تلك السلعة بسعر غال ظلما منه أو لاحتكار الناس أو لمنع الطريق خوف الظلمة أو لغير ذلك من الأسباب المستندة الينا فيحصل الغلاء و قد يحمل السلطان الناس على بيع السلعة برخص ظلما منه أو يحملهم على بيع ما في أيديهم من جنس ذلك المتاع فيحصل الرخص.( آت)ص 163

Abu ‘Abd Allah (a.s.), then said, ’Less than such expressions was permitted for women and when she said such things to her husband then al-Khul ‘ became lawful for her husband for whatever payment he received. She is then for two more divorces and al-Khul‘ is one divorce. The expressions must come from her side.’ He (the Imam) then said, ’Had the matter been in our hands divorce could only take place in the manner with the waiting period.’”

Humayd has narrated from ibn Sama‘ah from ‘Abd Allah ibn Jabalah from Jamil from Muhammad ibn Muslim who has said the following: “Abu Ja’far (a.s.), has said that when a woman says, ‘By Allah I will not obey any of your commands with or without explanation’, then whatever payment he receives from her becomes lawful for him and he cannot do ruju’ (go back to her).”’

9. Humayd ibn Ziyad has narrated from al-Hassan ibn Muhammad ibn Sama’ah from Ja’far ibn Sama’ah thatJamil wanted al-Khul ‘ for his daughter from a certain persons of our people; that Jamil said to that man, ‘What do you say, do you agree with what you have received and leave her free?’ He replied, ‘Yes, I agree.’ Jamil then said to them, ‘You can get up and go.’ They asked, ‘O abu Ali, do you not want that divorce follows it?’ He replied, ‘No, I do not need it.’ Ja’far ibn Sama’ah would say that it must be followed by divorce in the manner with waiting period. He presented narration of Musa ibn Bakr from the virtuous servant of Allah as proof. He (the Imam) (a.s.), has said that Ali (a.s.), has said, ‘When a woman divorced in the manner of al-Khul‘ it must be followed by divorce as long as she is in waiting period.’”

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from certain persons of his people who has said the following: “Abu ‘Abd Allah (a.s.), has said that a woman involved in al-Khul‘ cannot become lawful for him until she repents because of her statements that she has expressed when proceeding for al- Khul S’”
