أَبُو عَلِيٍّ الْأَشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ عَنْ صَفْوَانَ بْنِ يَحْيَى عَنْ إِسْحَاقَ بْنِ عَمَّارٍ قَالَ:

سَأَلْتُ أَبَا الْحَسَنِ ع عَنْ جَارِيَةٍ لَمْ تَحِضْ خَرَجَتْ مَعَ زَوْجِهَا وَ أَهْلِهَا فَحَاضَتْ فَاسْتَحْيَتْ أَنْ تُعْلِمَ أَهْلَهَا وَ زَوْجَهَا حَتَّى قَضَتِ الْمَنَاسِكَ وَ هِيَ عَلَى تِلْكَ الْحَالِ فَوَاقَعَهَا زَوْجُهَا ثُمَّ رَجَعَتْ إِلَى الْكُوفَةِ فَقَالَتْ لِأَهْلِهَا كَانَ مِنَ الْأَمْرِ كَذَا وَ كَذَا قَالَ عَلَيْهَا سَوْقُ بَدَنَةٍ وَ عَلَيْهَا الْحَجُّ مِنْ قَابِلٍ وَ لَيْسَ عَلَى زَوْجِهَا شَيْ‌ءٌ.

1. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Yahya from Ishaq ibn ‘Ammar who has said the following: “I once asked abu Ibrahim (a.s.), about the case of a girl (young woman) who did not experience Hayd (menses), traveled with her husband and family and began to experience Hayd (menses); but felt embarrassed to tell her husband or family until they completed all acts and she was in that condition. Her husband had sexual intercourse with her. They returned to al-Kufah and she told it (her story) to her family. He (the Imam) said, ‘She owes to drive a badanah and al-Hajj in future. Her husband is not obligated for anything in this matter.’”

إِنَّ رَجُلًا مِنَ الْأَنْصَارِ عَلَى عَهْدِ رَسُولِ اللَّهِ ص خَرَجَ فِي بَعْضِ حَوَائِجِهِ فَعَهِدَ إِلَى امْرَأَتِهِ عَهْداً أَلَّا تَخْرُجَ مِنْ بَيْتِهَا حَتَّى يَقْدَمَ قَالَ وَ إِنَّ أَبَاهَا مَرِضَ فَبَعَثَتِ الْمَرْأَةُ إِلَى النَّبِيِّ ص فَقَالَتْ إِنَّ زَوْجِي خَرَجَ وَ عَهِدَ إِلَيَّ أَنْ لَا أَخْرُجَ مِنْ بَيْتِي حَتَّى يَقْدَمَ وَ إِنَّ أَبِي قَدْ مَرِضَ فَتَأْمُرُنِي أَنْ أَعُودَهُ فَقَالَ رَسُولُ اللَّهِ ص لَا اجْلِسِي فِي بَيْتِكِ وَ أَطِيعِي زَوْجَكِ قَالَ فَثَقُلَ فَأَرْسَلَتْ إِلَيْهِ ثَانِياً بِذَلِكَ فَقَالَتْ فَتَأْمُرُنِي أَنْ أَعُودَهُ فَقَالَ اجْلِسِي فِي بَيْتِكِ وَ أَطِيعِي زَوْجَكِ قَالَ فَمَاتَ أَبُوهَا فَبَعَثَتْ إِلَيْهِ إِنَّ أَبِي قَدْ مَاتَ فَتَأْمُرُنِي أَنْ أُصَلِّيَ عَلَيْهِ فَقَالَ لَا اجْلِسِي فِي بَيْتِكِ وَ أَطِيعِي زَوْجَكِ قَالَ فَدُفِنَ الرَّجُلُ فَبَعَثَ إِلَيْهَا رَسُولُ اللَّهِ ص أَنَّ اللَّهَ قَدْ غَفَرَ لَكِ وَ لِأَبِيكِ بِطَاعَتِكِ لِزَوْجِكِ.

1. A number of our people have narrated from Ahmad ibn Muhammad from ibn Khalid from his father from ‘Abd Allah ibn al-Qasim al-Hadramiy from ‘Abd Allah ibn Sinan who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘In the time of the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, a man left for a journey and instructed his wife not to leave her house until he comes back. He (the Imam) said that her father became ill so the woman sent someone to the Holy Prophet saying, ‘My husband has gone on a journey and has instructed me not to leave the house until he comes back but my father has become ill; if you command me to visit him and return home. 5 The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, said, ‘No, you must stay home and obey your husband.’ He (the Imam) has said that her father’s illness became serious and she sent a messenger the second time asking, ‘If you command me to visit him.’ He (the Messenger of Allah) said, ‘No, you must stay home and obey your husband.’ He (the Imam) has said that her father died and she sent a messenger to him (the Messenger of Allah) if she can join in his funeral for Salat (prayer).’ He (the Messenger of Allah) said, ‘No, you must stay home and obey your husband.’ He (the Imam) has said that her father was buried and the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, sent her a message that said, ‘Allah has forgiven you and your father because of your obeying your husband.’”

سَمِعْتُ أَبَا عَبْدِ اللَّهِ ع يَقُولُ‌ إِذَا طَافَتِ الْمَرْأَةُ الْحَائِضُ ثُمَّ أَرَادَتْ أَنْ تُوَدِّعَ الْبَيْتَ فَلْتَقِفْ عَلَى أَدْنَى بَابٍ مِنْ أَبْوَابِ الْمَسْجِدِ وَ لْتُوَدِّعِ الْبَيْتَ‌.

2. Muhammad ibn Yahya has narrated from Salmah ibn al-Khattab from Ali ibn al-Husayn from Muhammad ibn Ziyad from Hammad from a man who has said the following: “I once heard abu ‘Abd Allah (a.s.), say, ‘A woman experiencing Hayd (menses) who has performed Tawaf then wants to say farewell to the House, should stand near any of the doors of the Masjid and say farewell to the House.’”

[2]لعل المراد أنّها إذا فرغت من الطواف و هي طاهرة ثمّ حاضت و أرادت أن تودع البيت في حال الحيض فلتقف إلخ لا انها طافت و هي حائض لان المرأة إذا فرغت من الطواف ثمّ حاضت بعده يصحّ أن يقال عليها: طافت المرأة الحائض كما لا يخفى و اللّه اعلم( كذا في هامش المطبوع) و في التحرير على ما نقل في المرآة الحائض و النفساء و لا وداع عليهما و لا فدية عنه بل يستحب لها ان تودع من ادنى باب من أبواب المسجد و لا تدخله إجماعا.ص 450

سَمِعْتُ أَبَا عَبْدِ اللَّهِ ع يَقُولُ‌ خَطَبَ رَسُولُ اللَّهِ ص النِّسَاءَ فَقَالَ يَا مَعَاشِرَ النِّسَاءِ تَصَدَّقْنَ وَ لَوْ مِنْ حُلِيِّكُنَّ وَ لَوْ بِتَمْرَةٍ وَ لَوْ بِشِقِّ تَمْرَةٍ فَإِنَّ أَكْثَرَكُنَّ حَطَبُ جَهَنَّمَ إِنَّكُنَّ تُكْثِرْنَ اللَّعْنَ وَ تَكْفُرْنَ الْعَشِيرَةَ فَقَالَتِ امْرَأَةٌ مِنْ بَنِي سُلَيْمٍ لَهَا عَقْلٌ يَا رَسُولَ اللَّهِ أَ لَيْسَ نَحْنُ الْأُمَّهَاتُ الْحَامِلَاتُ الْمُرْضِعَاتُ أَ لَيْسَ مِنَّا الْبَنَاتُ الْمُقِيمَاتُ وَ الْأَخَوَاتُ الْمُشْفِقَاتُ فَرَقَّ لَهَا رَسُولُ اللَّهِ ص فَقَالَ حَامِلَاتٌ وَالِدَاتٌ مُرْضِعَاتٌ رَحِيمَاتٌ لَوْ لَا مَا يَأْتِينَ إِلَى بُعُولَتِهِنَّ مَا دَخَلَتْ مُصَلِّيَةٌ مِنْهُنَّ النَّارَ.

2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Ali ibn abu Hamzah from abu Basir who has said the following: “I once heard abu ‘Abd Allah (a.s.), saying that once the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, gave a speech for women and said, ‘O the community of women, you must give charity even if it is from your jewelries, a date or a piece of a date because the majority of you will be the fuel for the fire of hell if you frequently abuse and curse your associate (husband).’ A woman from banu Salim who had reason said, ‘O Messenger of Allah, we are mothers, who carry in our wombs and breastfeed. From us are daughters who highly value (parents and relatives) and kind sisters.’ The Messenger of Allah was moved emotionally and said, ‘Childbearing, birth-giving, breastfeeding and kindhearted ones, only if they do not bring to their husband’s (bed) something that will make them to feel the heat of fire (due to involving themselves in indecent acts).”’

3. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Yahya from ‘Abd al-Rahman ibn al-Hajjaj who has said the following: “I once sent a message to abu ‘Abd Allah (a.s.), that one of first time al-Hajj performing women with us has begun experiencing Hayd. What must she do? He (the Imam) said, ‘She must wait until al-Tarwiyah (eight of Dhu al-Hajj ah), if she is clean by that time, she says Talbiyah, otherwise, she must assume the state of Ihram before it is al-Tarwiyah (eight of Dhu al-Hajjah).”’

خَرَجَ رَسُولُ اللَّهِ ص- يَوْمَ النَّحْرِ إِلَى ظَهْرِ الْمَدِينَةِ عَلَى جَمَلٍ عَارِي الْجِسْمِ فَمَرَّ بِالنِّسَاءِ فَوَقَفَ عَلَيْهِنَّ ثُمَّ قَالَ يَا مَعَاشِرَ النِّسَاءِ تَصَدَّقْنَ وَ أَطِعْنَ أَزْوَاجَكُنَّ فَإِنَّ أَكْثَرَكُنَّ فِي النَّارِ فَلَمَّا سَمِعْنَ ذَلِكَ بَكَيْنَ ثُمَّ قَامَتْ إِلَيْهِ امْرَأَةٌ مِنْهُنَّ فَقَالَتْ يَا رَسُولَ اللَّهِ ص فِي النَّارِ مَعَ الْكُفَّارِ وَ اللَّهِ مَا نَحْنُ بِكُفَّارٍ فَنَكُونَ مِنْ أَهْلِ النَّارِ فَقَالَ لَهَا رَسُولُ اللَّهِ ص إِنَّكُنَّ كَافِرَاتٌ بِحَقِّ أَزْوَاجِكُنَّ.

3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from ‘Abd Allah ibn Ghalib from Jabir al-Juhfi who has said the following: “Abu Ja‘far (a.s.), has said that once on the tenth of the month of Dhul al-Hajj the Messenger of Allah (s.), moved out of the city of al-Madinah toward the backside of it on a camel without a saddle and passed by women, stopped higher than them and said, ‘O community of women, you must give charity and obey your husbands; the majority of you will be in the fire.’ When they heard it they wept and one woman from them stood up and asked, ‘O Messenger of Allah, will we be in the fire with the unbelievers? By Allah, we are not unbelievers to be punished and to become of the people of the fire.’ The Messenger of Allah said, ‘This will happen if you deny the rights of your husbands.’”

إِذَا طَافَتِ الْمَرْأَةُ طَوَافَ النِّسَاءِ وَ طَافَتْ أَكْثَرَ مِنَ النِّصْفِ فَحَاضَتْ نَفَرَتْ إِنْ شَاءَتْ‌.

4. Humayd ibn Ziyad has narrated from ibn Sama‘ah from more than one person from Aban ibn ‘Uthman from Fudayl ibn Yasar who has said the following: “Abu Ja‘far (a.s.), has said, ‘If a woman has performed Tawaf al-Nisa’, more than half of it, then begins experiencing Hayd (menses), she can leave if she wanted.’”

لَيْسَ لِلْمَرْأَةِ أَمْرٌ مَعَ زَوْجِهَا فِي عِتْقٍ وَ لَا صَدَقَةٍ وَ لَا تَدْبِيرٍ وَ لَا هِبَةٍ وَ لَا نَذْرٍ فِي مَالِهَا إِلَّا بِإِذْنِ زَوْجِهَا إِلَّا فِي زَكَاةٍ أَوْ بِرِّ وَالِدَيْهَا أَوْ صِلَةِ قَرَابَتِهَا.

4. Ibn Mahbub from ‘ Abd Allah ibn Sinan who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘A woman does not have permission with the existence of her husband to set free a slave, give charity, contract with a slave, give gift or make a vow in her assets without the permission of her husband except payment of Zakat or doing good to parents or keeping good relations with her relatives.”’

كُنْتُ عِنْدَ أَبِي عَبْدِ اللَّهِ ع فَدَخَلَ عَلَيْهِ رَجُلٌ لَيْلًا فَقَالَ أَصْلَحَكَ اللَّهُ امْرَأَةٌ مَعَنَا حَاضَتْ وَ لَمْ تَطُفْ طَوَافَ النِّسَاءِ فَقَالَ لَقَدْ سُئِلْتُ عَنْ هَذِهِ الْمَسْأَلَةِ الْيَوْمَ فَقَالَ أَصْلَحَكَ اللَّهُ أَنَا زَوْجُهَا وَ قَدْ أَحْبَبْتُ أَنْ أَسْمَعَ ذَلِكَ مِنْكَ فَأَطْرَقَ كَأَنَّهُ يُنَاجِي نَفْسَهُ وَ هُوَ يَقُولُ لَا يُقِيمُ عَلَيْهَا جَمَّالُهَا وَ لَا تَسْتَطِيعُ أَنْ تَتَخَلَّفَ عَنْ أَصْحَابِهَا تَمْضِي وَ قَدْ تَمَّ حَجُّهَا.

5. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from abu Ayyub al-Khazzaz who has said the following: “I was with abu ‘Abd Allah (a.s.), when a man during the night came to him (the Imam) and said, ‘May Allah keep you well, there is a woman with us who experiences Hayd (menses) and has not performed Tawaf al-Nisa’. He (the Imam) said, ‘She has already asked this question today.’ He said, ‘May Allah keep you well, I am her husband and I love to hear it from you.’ He (the Imam) looked down as if speaking to himself and saying, ‘Her beauty will not remain and she cannot stay behind from her companions; she can go, her al-Hajj is complete.’”

Ali ibn Ibrahim has narrated from his father from al-Nawfaliy from al-Sakuniy who has said the following: “Abu ‘Abd Allah (a.s.), has said that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said, ‘Any woman who goes out of her house without the permission of her husband loses her right of maintenance until she comes back.’”
