عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادِ بْنِ عِيسَى عَنْ حَرِيزٍ عَنْ زُرَارَةَ وَ مُحَمَّدِ بْنِ مُسْلِمٍ وَ أَبِي بَصِيرٍ وَ بُرَيْدٍ الْعِجْلِيِّ وَ الْفُضَيْلِ عَنْ أَبِي جَعْفَرٍ وَ أَبِي عَبْدِ اللَّهِ ع

قَالا فِي الْبَقَرِ فِي كُلِّ ثَلَاثِينَ بَقَرَةً تَبِيعٌ‌ حَوْلِيٌّ وَ لَيْسَ فِي أَقَلَّ مِنْ ذَلِكَ شَيْ‌ءٌ وَ فِي أَرْبَعِينَ بَقَرَةً بَقَرَةٌ مُسِنَّةٌ وَ لَيْسَ فِيمَا بَيْنَ الثَّلَاثِينَ إِلَى الْأَرْبَعِينَ شَيْ‌ءٌ حَتَّى تَبْلُغَ أَرْبَعِينَ فَإِذَا بَلَغَتْ أَرْبَعِينَ فَفِيهَا مُسِنَّةٌ وَ لَيْسَ فِيمَا بَيْنَ الْأَرْبَعِينَ إِلَى السِّتِّينَ شَيْ‌ءٌ فَإِذَا بَلَغَتِ السِّتِّينَ فَفِيهَا تَبِيعَانِ إِلَى سَبْعِينَ فَإِذَا بَلَغَتْ سَبْعِينَ فَفِيهَا تَبِيعٌ وَ مُسِنَّةٌ إِلَى ثَمَانِينَ فَإِذَا بَلَغَتْ ثَمَانِينَ فَفِي كُلِّ أَرْبَعِينَ مُسِنَّةٌ إِلَى تِسْعِينَ فَإِذَا بَلَغَتْ تِسْعِينَ فَفِيهَا ثَلَاثُ تَبَائِعَ حَوْلِيَّاتٍ فَإِذَا بَلَغَتْ عِشْرِينَ وَ مِائَةً فَفِي كُلِّ أَرْبَعِينَ مُسِنَّةٌ ثُمَّ تَرْجِعُ الْبَقَرُ عَلَى أَسْنَانِهَا وَ لَيْسَ عَلَى النَّيِّفِ شَيْ‌ءٌ وَ لَا عَلَى الْكُسُورِ شَيْ‌ءٌ وَ لَا عَلَى الْعَوَامِلِ شَيْ‌ءٌ إِنَّمَا الصَّدَقَةُ عَلَى السَّائِمَةِ الرَّاعِيَةِ وَ كُلُّ مَا لَمْ يَحُلْ عَلَيْهِ الْحَوْلُ عِنْدَ رَبِّهِ فَلَا شَيْ‌ءَ عَلَيْهِ حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ فَإِذَا حَالَ عَلَيْهِ الْحَوْلُ وَجَبَ عَلَيْهِ

1. Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Hariz from Zurarah, Muhammad ibn Muslim, abu Basir, Burayd al-‘ljliy and al-Fudayl who have said the following: “Abu Ja‘far, and abu ’Abd Allah, ‘Alayhim al-Salam, have said, ‘The amount of Zakat on cows is one Tabi‘ (a one year old cow) Hawliy for every thirty cows. Zakat is not due on less than this number of cows. Zakat on forty cows is one Musinnah (a young cow that is just growing teeth) Baqarah. Zakat is not due on what is between forty up to sixty. When it becomes sixty, Zakat is two Tabi‘ up to seventy. When it becomes seventy, Zakat is one Tabi‘ and one Musinnah up to eighty, in which case Zakat on every forty, is one Musinnah up to ninety in which case Zakat is three Tabi‘ Hawliy. When it becomes one hundred twenty, Zakat on every forty is one Musinnah; and thereafter the cows are counted according to their ages. Zakat is not due on what is between two numbers. (It is like the case of camels) Zakat is not due on fractions or working cows. Zakat is obligatory only on grazing cows, which are not fed by the owner. Zakat is not due for cows on which one year has not passed. When one year passes, then Zakat is obligatory.”’

[1]في النهاية: التبيع: ولد البقر اول سنة و بقرة متبع اي معها ولدها و قال الأزهري: البقر و الشاة يقع عليهما اسم المسن و ليس معناه كبرها كالرجل المسن و لكن معناه طلوع سنها في السنة الثالثة و قال في حديث الزكاة: ليس في العوامل شي‌ء العوامل من البقر جمع عاملة و هي التي يستقى عليها و يحرث و تستعمل في الاشغال و هذا الحكم مطرد في الإبل.( آت)ص 534

كُنَّا مَعَ أَبِي عَبْدِ اللَّهِ ع بِالْحِيرَةِ حِينَ قَدِمَ عَلَى أَبِي جَعْفَرٍ الْمَنْصُورِ فَخَتَنَ بَعْضُ الْقُوَّادِ ابْناً لَهُ وَ صَنَعَ طَعَاماً وَ دَعَا النَّاسَ وَ كَانَ أَبُو عَبْدِ اللَّهِ ع فِيمَنْ دُعِيَ فَبَيْنَا هُوَ عَلَى الْمَائِدَةِ يَأْكُلُ وَ مَعَهُ عِدَّةٌ عَلَى الْمَائِدَةِ فَاسْتَسْقَى رَجُلٌ مِنْهُمْ مَاءً فَأُتِيَ بِقَدَحٍ فِيهِ شَرَابٌ لَهُمْ فَلَمَّا أَنْ صَارَ الْقَدَحُ فِي يَدِ الرَّجُلِ قَامَ أَبُو عَبْدِ اللَّهِ ع عَنِ الْمَائِدَةِ فَسُئِلَ عَنْ قِيَامِهِ فَقَالَ قَالَ رَسُولُ اللَّهِ ص مَلْعُونٌ مَنْ جَلَسَ عَلَى مَائِدَةٍ يُشْرَبُ عَلَيْهَا الْخَمْرُ وَ فِي رِوَايَةٍ أُخْرَى مَلْعُونٌ مَلْعُونٌ مَنْ جَلَسَ طَائِعاً عَلَى مَائِدَةٍ يُشْرَبُ عَلَيْهَا الْخَمْرُ.

1. A number of our people have narrated from Ahmad ibn abu ‘Abd Allah from Harun ibn al-Jahm who has said the following: “We were with abu ‘Abd Allah (a.s.), in al-Hirah when he (the Imam) visited abu Ja‘far, al-Mansur, and one of his commanders had a circumcision feast for his child. Food was prepared and people were invited. Abu ‘Abd Allah (a.s.), was one of the people invited. When he was on the table to have food from a group of people near by, a man asked for water but a bowl of wine was brought for him. When the bowl reached the hand of the man abu ‘Abd Allah (a.s.), stood up to leave the table. He (the Imam) was asked about the reason for getting up and he (the Imam) said, ‘The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said, ‘Condemned is one who sits on a table where wine is served.’ In another Hadith it is said, ‘Condemned is he, condemned is he who sits on a table voluntarily where wine is served.’”

لَمْ أُشْهِدْهُ‌ فَقَالَ تَجُوزُ شَهَادَةُ أَعْدَلِهِمَا وَ لَوْ كَانَ أَعْدَلُهُمَا وَاحِداً لَمْ تَجُزْ شَهَادَتُهُ عَدَالَةً فِيهِمَا.

1. Ali ibn Ibrahim has narrated from Muhammad ibn ‘Isa from Yunus from b Sinan who has narrated the following: “This is about the case of a man who bears testimony to the testimony of another witness but then the man says that he had not appointed him as witness. Abu ‘ Abd Allah (a.s.), has said, ‘The testimony of the one who is more just is admissible but if such man of justice is one man then his testimony is not acceptable because of fairness for both.’”

[1]أي اعلم أنّه كاذب فيما ينسب الى، أو لا أعلم الآن حقية ما يقول و يمكن أن يقرأ من باب الافعال و لعله أظهر كما فهمه القوم، و اما الحكم فالشيخ في النهاية و جماعة عملوا بمدلول الخبرين و قالوا: كذب الفرع الأصل تعمل بشهادة أعدلهما فان تساويا طرح الفرع و الأشهر بين المتأخرين هو أنّه ان كان قبل حكم الحاكم لا عبرة بشهادة الفرع مع تكذيب الأصل و إن كان بعده نفذ حكم الحاكم و لا عبرة بقول الأصل فيحملون هذين الخبرين على ما إذا شك الأصل قبل حكم الحاكم فينفذ بعده مطلقا و منهم من قال به بعد الحكم فيبطل شهادة الفرع قبل مطلقا و الأول أقوى لصحة الخبر( آت)ص 399

2. It is narrated from Zurarah who has said the following: “I once asked abu Ja‘far (a.s.), about buffalos if there is Zakat for it. He (the Imam) said, ‘It is like cows.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa, from al-Husayn ibn Sa‘id from al-Nadr ibn Suwayd from al-Qasim ibn Sulayman from Jarrah al-Mad’iniy who has said the following: “Abu ‘Abd Allah (a.s.), has said that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said, ‘Whoever believes in Allah and the Day of Judgment, must not eat at a table where wine exists.’”
