إِنَّ سَمُرَةَ بْنَ جُنْدَبٍ كَانَ لَهُ عَذْقٌ‌[2] فِي حَائِطٍ لِرَجُلٍ مِنَ الْأَنْصَارِ وَ كَانَ مَنْزِلُ الْأَنْصَارِيِّ بِبَابِ الْبُسْتَانِ وَ كَانَ يَمُرُّ بِهِ إِلَى نَخْلَتِهِ وَ لَا يَسْتَأْذِنُ فَكَلَّمَهُ الْأَنْصَارِيُّ أَنْ يَسْتَأْذِنَ إِذَا جَاءَ فَأَبَى سَمُرَةُ فَلَمَّا تَأَبَّى جَاءَ الْأَنْصَارِيُّ إِلَى رَسُولِ اللَّهِ ص فَشَكَا إِلَيْهِ وَ خَبَّرَهُ الْخَبَرَ فَأَرْسَلَ إِلَيْهِ رَسُولُ اللَّهِ ص

قَضَى رَسُولُ اللَّهِ ص بَيْنَ أَهْلِ الْمَدِينَةِ فِي مَشَارِبِ النَّخْلِ أَنَّهُ لَا يُمْنَعُ نَفْعُ الشَّيْ‌ءِ وَ قَضَى ص بَيْنَ أَهْلِ الْبَادِيَةِ أَنَّهُ لَا يُمْنَعُ فَضْلُ مَاءٍ لِيُمْنَعَ بِهِ فَضْلُ كَلَإٍ وَ قَالَ لَا ضَرَرَ وَ لَا ضِرَارَ.
