سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الْحُرِّ يَتَزَوَّجُ الْأَمَةَ أَوْ عَبْدٍ يَتَزَوَّجُ حُرَّةً قَالَ فَقَالَ لِي لَيْسَ يُسْتَرَقُّ الْوَلَدُ إِذَا كَانَ أَحَدُ أَبَوَيْهِ حُرّاً إِنَّهُ يُلْحَقُ بِالْحُرِّ مِنْهُمَا أَيَّهُمَا كَانَ أَباً كَانَ أَوْ أُمّاً.

قَضَى أَمِيرُ الْمُؤْمِنِينَ ع فِي امْرَأَةٍ أَمْكَنَتْ نَفْسَهَا مِنْ عَبْدٍ لَهَا فَنَكَحَهَا أَنْ تُضْرَبَ مِائَةً وَ يُضْرَبَ الْعَبْدُ خَمْسِينَ جَلْدَةً وَ يُبَاعَ بِصُغْرٍ مِنْهَا[2] قَالَ وَ يَحْرُمُ عَلَى كُلِّ مُسْلِمٍ أَنْ يَبِيعَهَا عَبْداً مُدْرِكاً بَعْدَ ذَلِكَ.

سَأَلْتُهُ‌[3] عَنِ الْمَرْأَةِ الْحُرَّةِ تَكُونُ تَحْتَ الْمَمْلُوكِ فَتَشْتَرِيهِ هَلْ يُبْطِلُ ذَلِكَ نِكَاحَهُ قَالَ نَعَمْ لِأَنَّهُ عَبْدٌ مَمْلُوكٌ‌ لا يَقْدِرُ عَلى‌ شَيْ‌ءٍ.

رَأَى رَسُولُ اللَّهِ ص امْرَأَةً فَأَعْجَبَتْهُ فَدَخَلَ عَلَى أُمِّ سَلَمَةَ وَ كَانَ يَوْمُهَا فَأَصَابَ مِنْهَا وَ خَرَجَ إِلَى النَّاسِ وَ رَأْسُهُ يَقْطُرُ فَقَالَ أَيُّهَا النَّاسُ إِنَّمَا النَّظَرُ مِنَ الشَّيْطَانِ فَمَنْ وَجَدَ مِنْ ذَلِكَ شَيْئاً فَلْيَأْتِ أَهْلَهُ.

قَالَ رَسُولُ اللَّهِ ص‌ إِذَا نَظَرَ أَحَدُكُمْ إِلَى الْمَرْأَةِ الْحَسْنَاءِ فَلْيَأْتِ أَهْلَهُ فَإِنَّ الَّذِي مَعَهَا مِثْلُ الَّذِي مَعَ تِلْكَ فَقَامَ رَجُلٌ فَقَالَ يَا رَسُولَ اللَّهِ فَإِنْ لَمْ يَكُنْ لَهُ أَهْلٌ فَمَا يَصْنَعُ قَالَ فَلْيَرْفَعْ نَظَرَهُ إِلَى السَّمَاءِ وَ لْيُرَاقِبْهُ وَ لْيَسْأَلْهُ مِنْ فَضْلِهِ.
