سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع- عَنِ الْأَمَةِ تَتَزَوَّجُ بِغَيْرِ إِذْنِ مَوَالِيهَا قَالَ يَحْرُمُ ذَلِكَ عَلَيْهَا وَ هُوَ زِنًى.
Al Husayn Bin Muhammad, from Moalla Bin Muhammad, from one of his companions, from Aban, from Fazl Bin Abdul Malik who said, ‘I asked Abu Abdullah asws about the slave girl getting married without the permission of her masters. He asws said: ‘That is Prohibited unto her, and it is adultery’.
قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع الرَّجُلُ كَيْفَ يُنْكِحُ عَبْدَهُ أَمَتَهُ قَالَ يَقُولُ قَدْ أَنْكَحْتُكَ فُلَانَةَ وَ يُعْطِيهَا مَا شَاءَ مِنْ قِبَلِهِ أَوْ مِنْ قِبَلِ مَوْلَاهُ وَ لَوْ مُدّاً مِنْ طَعَامٍ أَوْ دِرْهَماً أَوْ نَحْوَ ذَلِكَ.

فِي الْمَمْلُوكِ فَتَكُونُ لِمَوْلَاهُ أَوْ لِمَوْلَاتِهِ أَمَةٌ فَيُرِيدُ أَنْ يَجْمَعَ بَيْنَهُمَا أَ يُنْكِحُهُ نِكَاحاً أَوْ يُجْزِئُهُ أَنْ يَقُولَ قَدْ أَنْكَحْتُكَ فُلَانَةَ وَ يُعْطِي مِنْ قِبَلِهِ شَيْئاً أَوْ مِنْ قِبَلِ الْعَبْدِ قَالَ نَعَمْ وَ لَوْ مُدّاً وَ قَدْ رَأَيْتُهُ يُعْطِي الدِّرْهَمَ.
Muhammad Bin Yahya, from Abdullah Bin Muhammad, from Ali Bin Al Hakam, from Aban, from Muhammad Bin Muslim, (It has been narrated) from Abu Ja’far asws regarding the owned slave, so there happens to be for his master or for her mistress, a slave girl. سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الرَّجُلِ يُزَوِّجُ مَمْلُوكَتَهُ عَبْدَهُ أَ تَقُومُ عَلَيْهِ كَمَا كَانَتْ تَقُومُ فَتَرَاهُ مُنْكَشِفاً أَوْ يَرَاهَا عَلَى تِلْكَ الْحَالِ فَكَرِهَ ذَلِكَ وَ قَالَ قَدْ مَنَعَنِي أَبِي أَنْ أُزَوِّجَ بَعْضَ خَدَمِي غُلَامِي لِذَلِكَ[3].
قَالَ لِي أَبُو عَبْدِ اللَّهِ ع أَ يَسُرُّكَ أَنْ يَكُونَ لَكَ قَائِدٌ يَا أَبَا هَارُونَ قَالَ قُلْتُ نَعَمْ جُعِلْتُ فِدَاكَ قَالَ فَأَعْطَانِي ثَلَاثِينَ دِينَاراً فَقَالَ اشْتَرِ خَادِماً كَسُومِيّاً فَاشْتَرَاهُ فَلَمَّا أَنْ حَجَّ دَخَلَ عَلَيْهِ فَقَالَ لَهُ كَيْفَ رَأَيْتَ قَائِدَكَ يَا أَبَا هَارُونَ فَقَالَ خَيْراً فَأَعْطَاهُ خَمْسَةً وَ عِشْرِينَ دِينَاراً فَقَالَ لَهُ اشْتَرِ جَارِيَةً شَبَانِيَّةً فَإِ
Ali Bin Ibrahim, from his father, from Abu Is’haq Al Khannaf, from Muhammad Bin Abu Zayd, from Abu Haroun Al Makfouf who said, ‘Abu Abdullah asws said to me: ‘Would it cheer you up if there happened to be a (travel) guide for you, O Abu Haroun! I said, ‘Yes, may I be sacrificed for you asws ! So he asws gave me thirty
سَمِعْتُهُ يَقُولُ إِذَا زَوَّجَ الرَّجُلُ عَبْدَهُ أَمَتَهُ ثُمَّ اشْتَهَاهَا قَالَ لَهُ اعْتَزِلْهَا فَإِذَا طَمِثَتْ وَطِئَهَا ثُمَّ يَرُدُّهَا عَلَيْهِ إِذَا شَاءَ.
سَأَلْتُ أَبَا جَعْفَرٍ ع- عَنْ قَوْلِ اللَّهِ عَزَّ وَ جَلَّ- وَ الْمُحْصَناتُ مِنَ النِّساءِ إِلَّا ما مَلَكَتْ أَيْمانُكُمْ[1] قَالَ هُوَ أَنْ يَأْمُرَ الرَّجُلُ عَبْدَهُ وَ تَحْتَهُ أَمَتُهُ فَيَقُولَ لَهُ اعْتَزِلِ امْرَأَتَكَ وَ لَا تَقْرَبْهَا ثُمَّ يَحْبِسَهَا عَنْهُ حَتَّى تَحِيضَ ثُمَّ يَمَسَّهَا[2] فَإِذَا حَاضَتْ بَعْدَ مَسِّهِ إِيَّاهَا رَدَّهَا عَلَيْهِ بِغَيْرِ نِكَاحٍ.
سَأَلْتُهُ عَنِ الرَّجُلِ يُزَوِّجُ جَارِيَتَهُ مِنْ عَبْدِهِ فَيُرِيدُ أَنْ يُفَرِّقَ بَيْنَهُمَا فَيَفِرُّ الْعَبْدُ كَيْفَ يَصْنَعُ قَالَ يَقُولُ لَهَا اعْتَزِلِي فَقَدْ فَرَّقْتُ بَيْنَكُمَا فَاعْتَدِّي فَتَعْتَدُّ خَمْسَةً وَ أَرْبَعِينَ يَوْماً ثُمَّ يُجَامِعُهَا مَوْلَاهَا إِنْ شَاءَ وَ إِنْ لَمْ يَفِرَّ قَالَ لَهُ مِثْلَ ذَلِكَ قُلْتُ فَإِنْ كَانَ الْمَمْلُوكُ لَمْ يُجَامِعْهَا قَالَ يَقُولُ لَهَا اعْتَزِلِي
سَأَلْتُهُ عَنِ الرَّجُلِ تَكُونُ بَيْنَهُمَا الْأَمَةُ فَيُعْتِقُ أَحَدُهُمَا نَصِيبَهُ فَتَقُولُ الْأَمَةُ لِلَّذِي لَمْ يُعْتِقْ لَا أَبْغِي فَقَوِّمْنِي وَ ذَرْنِي كَمَا أَنَا أَخْدُمْكَ أَ رَأَيْتَ إِنْ أَرَادَ الَّذِي لَمْ يُعْتِقِ النِّصْفَ الْآخَرَ أَنْ يَطَأَهَا أَ لَهُ ذَلِكَ قَالَ لَا يَنْبَغِي لَهُ أَنْ يَفْعَلَ [ذَلِكَ] لِأَنَّهُ لَا يَكُونُ لِلْمَرْأَةِ فَرْجَانِ وَ لَا يَنْبَغِي لَهُ أَنْ يَسْتَخْدِمَ

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع- عَنْ رَجُلٍ اشْتَرَى جَارِيَةً يَطَؤُهَا فَبَلَغَهُ أَنَّ لَهَا زَوْجاً قَالَ يَطَؤُهَا فَإِنَّ بَيْعَهَا طَلَاقُهَا وَ ذَلِكَ أَنَّهُمَا لَا يَقْدِرَانِ عَلَى شَيْءٍ مِنْ أَمْرِهِمَا إِذَا بِيعَا[1].
Muhammad Bin Ismail, from Al Fazl Bin Shazaan, and Abu Ali Al Ashary, from Muhammad Bin Abdul Jabbar, altogether from Safwan Bin Yahya, from Ibn Muskan, from Al Hassan Bin Ziyad who said, ‘I asked Abu Abdullah asws about a man who bought a slave girl. He slept with her, and (news) reached him that for her is a husband.
سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع- عَنِ الْأَمَةِ تُبَاعُ وَ لَهَا زَوْجٌ فَقَالَ صَفْقَتُهَا طَلَاقُهَا.
Ali Bin Ibrahim, from his father, from Hammad Bin Isa, from Rabie Bin Abdullah, from Abdul Rahman Bin Abu Abdullah who said, ‘I asked Abu Abdullah asws about the slave girl who is sold and for her is a husband. So he asws said: ‘Her take-over is her divorce’.

قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع إِنَّ النَّاسَ يَرْوُونَ أَنَّ عَلِيّاً ع كَتَبَ إِلَى عَامِلِهِ بِالْمَدَائِنِ أَنْ يَشْتَرِيَ لَهُ جَارِيَةً فَاشْتَرَاهَا وَ بَعَثَ بِهَا إِلَيْهِ وَ كَتَبَ إِلَيْهِ أَنَّ لَهَا زَوْجاً فَكَتَبَ إِلَيْهِ عَلِيٌّ ع أَنْ يَشْتَرِيَ بُضْعَهَا فَاشْتَرَاهُ فَقَالَ كَذَبُوا عَلَى عَلِيٍّ ع أَ عَلِيٌّ ع يَقُولُ هَذَا.

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع- عَنْ أَمَةٍ كَانَتْ تَحْتَ عَبْدٍ فَأُعْتِقَتِ الْأَمَةُ قَالَ أَمْرُهَا بِيَدِهَا إِنْ شَاءَتْ تَرَكَتْ نَفْسَهَا مَعَ زَوْجِهَا وَ إِنْ شَاءَتْ نَزَعَتْ نَفْسَهَا مِنْهُ وَ ذَكَرَ أَنَّ بَرِيرَةَ كَانَتْ عِنْدَ زَوْجٍ لَهَا وَ هِيَ مَمْلُوكَةٌ فَاشْتَرَتْهَا عَائِشَةُ فَأَعْتَقَتْهَا فَخَيَّرَهَا رَسُولُ اللَّهِ ص وَ قَالَ إِنْ شَاءَتْ أَنْ تَقِرَّ عِنْدَ زَوْجِهَا وَ إِنْ شَاءَتْ

سَمِعْتُ أَبَا عَبْدِ اللَّهِ ع يَقُولُ إِذَا أَعْتَقْتَ مَمْلُوكَيْكَ رَجُلًا وَ امْرَأَتَهُ فَلَيْسَ بَيْنَهُمَا نِكَاحٌ وَ قَالَ إِنْ أَحْبَبْتَ أَنْ يَكُونَ زَوْجَهَا كَانَ ذَلِكَ بِصَدَاقٍ قَالَ وَ سَأَلْتُهُ عَنِ الرَّجُلِ يُنْكِحُ عَبْدَهُ أَمَتَهُ ثُمَّ أَعْتَقَهَا تُخَيَّرُ فِيهِ أَمْ لَا قَالَ نَعَمْ تُخَيَّرُ فِيهِ إِذَا أُعْتِقَتْ.

ذَكَرَ أَنَّ بَرِيرَةَ مَوْلَاةَ عَائِشَةَ كَانَ لَهَا زَوْجٌ عَبْدٌ فَلَمَّا أُعْتِقَتْ قَالَ لَهَا رَسُولُ اللَّهِ ص اخْتَارِي إِنْ شِئْتِ أَقَمْتِ مَعَ زَوْجِكِ وَ إِنْ شِئْتِ فَلَا.
A number of our companions, from Ahmad Bin Muhammad, from Usman Bin Isa, from Sama’at who said, ‘(He asws ) mentioned that Bureyra was a slave of Ayesha and had a husband for her who was a slave. So when she was emancipated, Rasool-Allah saww said to her: ‘Choose! If you so desire to you can stay with your husband, and
كَانَ زَوْجُ بَرِيرَةَ عَبْداً.
Muhammad Bin Ismail, from Al Fazl Bin Shazaan, from Ibn Abu Umeyr, from Rabie Bin Abdullah, from Bureyd Bin Muawiya, (It has been narrated) from Abu Abdullah asws having said: ‘The husband of Bureyra was a slave’.
فَقَالَ لَا يُرْجَمُ حَتَّى يُوَاقِعَ الْحُرَّةَ بَعْدَ مَا يُعْتَقُ قُلْتُ فَلِلْحُرَّةِ عَلَيْهِ الْخِيَارُ إِذَا أُعْتِقَ قَالَ لَا قَدْ رَضِيَتْ بِهِ وَ هُوَ مَمْلُوكٌ فَهُوَ عَلَى نِكَاحِهِ الْأَوَّلِ.

إِنَّ رَجُلًا مِنَ الْأَنْصَارِ أَتَى أَبَا جَعْفَرٍ ع فَقَالَ لَهُ إِنِّي قَدِ ابْتُلِيتُ بِأَمْرٍ عَظِيمٍ إِنِّي وَقَعْتُ عَلَى جَارِيَتِي ثُمَّ خَرَجْتُ فِي بَعْضِ حَوَائِجِي فَانْصَرَفْتُ مِنَ الطَّرِيقِ فَأَصَبْتُ غُلَامِي بَيْنَ رِجْلَيِ الْجَارِيَةِ فَاعْتَزَلْتُهَا فَحَبِلَتْ ثُمَّ وَضَعَتْ جَارِيَةً لِعِدَّةِ تِسْعَةِ أَشْهُرٍ فَقَالَ لَهُ أَبُو جَعْفَرٍ ع احْبِسِ الْجَارِيَةَ لَا تَبِعْهَا وَ أَنْفِقْ عَلَي

سَأَلْتُ أَبَا الْحَسَنِ ع- عَنِ الْجَارِيَةِ تَكُونُ لِلرَّجُلِ يُطِيفُ بِهَا وَ هِيَ تَخْرُجُ فَتَعْلَقُ[1] قَالَ يَتَّهِمُهَا الرَّجُلُ أَوْ يَتَّهِمُهَا أَهْلُهُ قُلْتُ أَمَّا ظَاهِرَةً فَلَا قَالَ إِذاً لَزِمَهُ الْوَلَدُ.

أَتَى رَجُلٌ رَسُولَ اللَّهِ ص فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي خَرَجْتُ وَ امْرَأَتِي حَائِضٌ فَرَجَعْتُ وَ هِيَ حُبْلَى فَقَالَ لَهُ رَسُولُ اللَّهِ ص مَنْ تَتَّهِمُ قَالَ أَتَّهِمُ رَجُلَيْنِ قَالَ ائْتِ بِهِمَا فَجَاءَ بِهِمَا فَقَالَ رَسُولُ اللَّهِ ص إِنْ يَكُ ابْنَ هَذَا فَيَخْرُجُ قَطَطاً[1] كَذَا وَ كَذَا فَخَرَجَ كَمَا قَالَ رَسُولُ اللَّهِ ص فَجَعَلَ مَعْقُلَتَهُ عَلَى قَوْمِ أُمِّهِ وَ مِيرَاثَهُ لَهُمْ
