Divorce of a Pregnant Woman

سَأَلْتُهُ عَنِ الْحُبْلَى إِذَا طَلَّقَهَا زَوْجُهَا فَوَضَعَتْ سِقْطاً تَمَّ أَوْ لَمْ يَتِمَّ أَوْ وَضَعَتْهُ مُضْغَةً قَالَ كُلُّ شَيْ‌ءٍ وَضَعَتْهُ يَسْتَبِينُ أَنَّهُ حَمْلٌ تَمَّ أَوْ لَمْ يَتِمَّ فَقَدِ انْقَضَتْ عِدَّتُهَا وَ إِنْ كَانَتْ مُضْغَةً.

“I once asked abu al-Hassan (a.s.), about the case of a woman who is pregnant: if her husband divorces her and she gives birth prematurely or by abortion or it is just a lump. سَأَلْتُهُ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ وَ هِيَ حُبْلَى وَ كَانَ فِي بَطْنِهَا اثْنَانِ فَوَضَعَتْ وَاحِداً وَ بَقِيَ وَاحِدٌ قَالَ قَالَ تَبِينُ بِالْأَوَّلِ وَ لَا تَحِلُّ لِلْأَزْوَاجِ حَتَّى تَضَعَ مَا فِي بَطْنِهَا.

“I once asked abu ‘Abd Allah (a.s.), about the case of a man who divorces his pregnant wife with two children in her womb. She gives birth to one and one remains. He (the Imam) said, ‘She becomes stranger with the birth of one child and she is not lawful for marriage until the birth of the other child.’”*
