Ali ibn Ibrahim has narrated from his father from and Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad all from Ibn Abi ‘Umayr from Hammad from af-Halabiy who has said the following: “I once asked abu ‘ Abd Allah (a.s.), about a man who applies cupping when he is fasting. He (the Imam) said, ‘I am afraid for him. Is he not afraid for himself?’ I asked, ‘What is feared for him?’ He (the Imam) said, ‘Fear from fainting or stir up of the gallbladder.’ I then asked, ‘What if he is strong and is not afraid of anything?’ He (the Imam) said, ‘Yes, if he likes.’”

Ali ibn Ibrahim has narrated from his father and Muhammad ibn ’Isma‘il has narrated from al-Fadl ibn Shadhan from all from Ibn Abi ‘Umayr from ‘ Abd al-Rahman ibn al-Hajjaj who has narrated the following: “Abu ‘Abd Allah (a.s.), once asked me, ‘Does ibn abu Layla 5 reverse his judgments? 5 I replied, ‘I have come to know that he issued a judgment about the assets of man and woman when one of them died and the living heirs claim it as well as the heirs of the dead, or when she is divorced then the men claim it as well as women. It is about four cases. He (the Imam) asked, ‘What are they? 5 I replied, ‘The first is that he issued judgment by the words of Ibrahim al-Nakha‘iy. He (Ibrahim) would give the items that were especially for women to women and those for men to men and whatever was for both men and women, divide between them half-and-half. Then I came to know that he said, “Men are the owner of the house and women are additions on them. She is the plaintiff. All items belong to men except those especially for women which are for women. 55 He then issued a judgment that if I had not experienced it I would not mention. A woman from us died and left behind her husband and assets. I took the case before him. He then asked us to list the goods. When he read it, he then said to the husband, “This is for both man and woman so we give it to the woman, except the balance because it is of the assets of man and it is for you. 55 5 He (the Imam) asked, ‘What is his judgment now? 5 I replied, ‘He has reversed and now he says according to the words of Ibrahim al-Nakha‘iy that the house is for man. 5 I then asked him (the Imam) what he (the Imam) said in the case. He (the Imam) said, ‘It is the case that you experienced and that he then reversed. 5 1 then asked, ‘Do the items belong to the woman? 5 He (the Imam) said, ‘Consider, if she were to present proof; how much proof would she need? 5 1 replied, ‘She needed two witnesses. 5 He (the Imam) said, ‘Were you to ask from between the two mountains - we were in Makkah in those days - they tell you that the items and assets that are given as gifts publicly from the house of the woman to the house of her husband is what she has brought (belongs to her). He is the plaintiff and if he thinks that he has increased anything to it he must present testimony.

He (the Imam) said, ‘It is not harmful as long as he is not afraid of becoming weak.’”

Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Musa ibn Sa‘dan from al-Husayn ibn abu al-‘Ala’ from Ishaq ibn ‘Ammar who has said the following: “I once asked abu al-Hassan, Alayhi al-Salam, about the case of a man who is a debtor and pays a certain amount out of his profit to his creditor for fear of the creditor’s demand for payment, but there is no such condition between them. He (the Imam) said, ‘It is not harmful as long as it is not a condition.’”

Ali ibn Ibrahim has narrated from his father from ‘Uthman ibn ‘Isa from Sama‘ah ibn Mehran who has said the following: “I once asked him (the Imam) (a.s.), about the case of a woman who is divorced and about where she must complete her waiting period. He (the Imam) said, ‘She completes her waiting period in her house and must not go out. If she wants to visit she must go after midnight but not during the day. She does not have the right to perform al-Hajj until her waiting period is complete.’ I asked about one whose husband dies; if her case is the same. He (the Imam) said, ‘Yes, it is the same but she can perform al-Hajj if she wants.’”

Her waiting period is three Hayd-( menses)-free periods or three months except if she experiences Hayd (menses).”’

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from Sa‘d ibn abu Khalaf who has said the following: “I once asked abu al-Hassan, Musa ibn Ja‘far, ‘Alayhim al-Salam, something about divorce. He (the Imam) said, ‘When a man divorces his wife in a manner because of which he cannot go back to her, she becomes stranger to him in the hour divorce is pronounced and she takes control of her affairs and he has no way to her. She can complete her waiting period where she wants. He does not owe her maintenance.’ He (the narrator) has said that I then said, ‘Does Allah, most Majestic, most Glorious, not say, ‘. . . do not send them out of their houses and they must not go out’? He (the Imam) said, ‘It means she is divorced after being divorced. She is the one who must not be sent out of her house and must not go out of her house until the third divorce. When the third divorce is pronounced she becomes stranger to him and he does not owe her maintenance. A woman whom a man divorces once then leaves so that her waiting period is complete is the kind of woman who must stay in the house of her husband and she must be paid maintenance and lodging until waiting period is complete.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn Khalid from al-Qasim ibn ‘Urwah from Zurarah who has said the following: “Abu ‘ Abd Allah (a.s.), has said, ‘A divorced woman can use kohl, dyes, perfumes and wear whatever she likes because Allah, most Majestic, most Glorious, says, . .perhaps Allah may bring about something thereafter.’ Perhaps something happens in his mind and he goes back to her.’”

قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع إِنِّي دَفَعْتُ إِلَى أَخِي جَعْفَرٍ مَالًا فَهُوَ يُعْطِينِي مَا أُنْفِقُهُ وَ أَحُجُّ مِنْهُ وَ أَتَصَدَّقُ وَ قَدْ سَأَلْتُ مَنْ قِبَلَنَا فَذَكَرُوا أَنَّ ذَلِكَ فَاسِدٌ لَا يَحِلُّ وَ أَنَا أُحِبُّ أَنْ أَنْتَهِيَ إِلَى قَوْلِكَ فَقَالَ لِي أَ كَانَ يَصِلُكَ قَبْلَ أَنْ تَدْفَعَ إِلَيْهِ مَالَكَ قُلْتُ نَعَمْ قَالَ فَخُذْ مِنْهُ مَا يُعْطِيكَ فَكُلْ مِنْهُ وَ اشْرَبْ وَ حُجَّ وَ تَصَدَّقْ فَإِذَا قَدِمْتَ الْعِرَاقَ فَقُلْ جَعْفَرُ بْنُ مُحَمَّدٍ أَفْتَانِي بِهَذَا.

2. A number of our people have narrated from Ahmad ibn Muhammad from Sahl ibn Ziyad from ibn Mahbub from Hudhayl ibn Hayyan, brother of Ja’far ibn Hayyan al-Sayrafiy who has said the following: “I once said to abu ‘Abd Allah, Alayhi al-Salam, ‘I have given a certain amount of assets to my brother Ja’far and he gives me what I pay for my expenses, for performing al-Hajj and giving charity. I asked certain people for both of us and they mentioned that it is invalid and unlawful. I like to take your words as the final ones.’ He (the Imam) asked, ‘Did he give you such things before you gave him the assets you just mentioned?’ I replied, ‘Yes, he did so.’ He (the Imam) then said, ‘You can take what he gives you, use it for food, drink, al-Hajj and charity, and when you go back to Iraq tell him that Ja’far ibn Muhammad has given me this fatwa.’”

A number of our people have narrated from Sahl ibn Ziyad from ibn abu Nasr from Dawud ibn Sarhan who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Waiting period for a divorced woman is three Hayd (menses)-free periods or three months if she does not experience Hayd (menses).”’ Humayd has narrated from ibn Sama‘ah from Ja‘far ibn Sama‘ah from Dawud ibn Sarhan from abu ‘Abd Allah, ‘Alayhi al-Salam, a similar Hadith.

فِي بَيْتِهَا إِذَا كَانَ طَلَاقاً لَهُ عَلَيْهَا رَجْعَةٌ لَيْسَ لَهُ أَنْ يُخْرِجَهَا وَ لَا لَهَا أَنْ تَخْرُجَ حَتَّى تَنْقَضِيَ عِدَّتُهَا. - عَنْهُ عَنْ عَبْدِ اللَّهِ بْنِ جَبَلَةَ عَنْ عَلِيِّ بْنِ أَبِي حَمْزَةَ وَ مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ عَلِيِّ بْنِ أَبِي حَمْزَةَ عَنْ أَبِي بَصِيرٍ مِثْلَهُ.

9. It is narrated from the narrator of the previous Hadith from Wuhayb ibn Hafs from abu Basir who has said the following: “I once asked one of the two Imam, (abu Ja‘far or abu ‘Abd Allah), ‘Alayhim al-Salam, about the case of a woman who is divorced and about where she counts her waiting period. He (the Imam) said, ‘She completes it in her home if divorce is in a manner where he has the right to go back to her. He cannot send her out and it is not for her to go out until waiting period is complete.’” It is narrated from the narrator of the previous Hadith from ‘Abd Allah ibn Jabalah from Ali ibn abu Hamzah and Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Ali ibn abu Hamzah from abu Basir a similar Hadith.
