Waiting Period for a Divorced Woman and Where She must have it

لَا يَنْبَغِي لِلْمُطَلَّقَةِ أَنْ تَخْرُجَ إِلَّا بِإِذْنِ زَوْجِهَا حَتَّى تَنْقَضِيَ عِدَّتُهَا ثَلَاثَةَ قُرُوءٍ أَوْ ثَلَاثَةَ أَشْهُرٍ إِنْ لَمْ تَحِضْ‌[1].

“Abu ‘Abd Allah (a.s.), has said, ‘A divorced woman must not go out without the permission of her husband until her waiting period is complete after three Hayd (menses)-free periods or three months, if she does not experience Hayd (menses).’”

الْمُطَلَّقَةُ تَعْتَدُّ فِي بَيْتِهَا وَ لَا يَنْبَغِي لَهَا أَنْ تَخْرُجَ حَتَّى تَنْقَضِيَ عِدَّتُهَا وَ عِدَّتُهَا ثَلَاثَةُ قُرُوءٍ[3] أَوْ ثَلَاثَةُ أَشْهُرٍ إِلَّا أَنْ تَكُونَ تَحِيضُ.

‘When a man divorces his wife in a manner because of which he cannot go back to her, she becomes stranger to him in the hour divorce is pronounced and she takes control of her affairs and he has no way to her. الْمُطَلَّقَةُ تَشَوَّفَتْ لِزَوْجِهَا مَا كَانَ لَهُ عَلَيْهَا رَجْعَةٌ[1] وَ لَا يَسْتَأْذِنُ عَلَيْهَا.

“Abu Ja‘far (a.s.), has said, ‘A woman who is divorced and her husband has the right to go back to her, can beautify herself before her husband and he does not need to ask permission to go to her.’”

It is narrated from the narrator of the previous Hadith from Wuhayb ibn Hafs from abu Basir who has said the following: “I once asked one of the two Imam, (abu Ja‘far or abu ‘Abd Allah), ‘Alayhim al-Salam, about the case of a woman who is divorced and about where she counts her waiting period. فِي الْمُطَلَّقَةِ تَعْتَدُّ فِي بَيْتِهَا وَ تُظْهِرُ لَهُ زِينَتَهَا لَعَلَّ اللَّهَ يُحْدِثُ بَعْدَ ذلِكَ أَمْراً.

“About the case of a divorced woman, one of the two Imam, (abu Ja‘far or abu ‘Abd Allah), ‘Alayhim al-Salam, has said that she completes her waiting period in her house and she can beautify herself; perhaps Allah brings about something thereafter.’”

الْمُطَلَّقَةُ تَكْتَحِلُ وَ تَخْتَضِبُ وَ تَطَيَّبُ وَ تَلْبَسُ مَا شَاءَتْ مِنَ الثِّيَابِ لِأَنَّ اللَّهَ عَزَّ وَ جَلَّ يَقُولُ- لَعَلَّ اللَّهَ يُحْدِثُ بَعْدَ ذلِكَ أَمْراً لَعَلَّهَا أَنْ تَقَعَ فِي نَفْسِهِ فَيُرَاجِعَهَا.

“Abu ‘ Abd Allah (a.s.), has said, ‘A divorced woman can use kohl, dyes, perfumes and wear whatever she likes because Allah, most Majestic, most Glorious, says, . .perhaps Allah may bring about something thereafter.’ Perhaps something happens in his mind and he goes back to her.’”
