عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ مُحَمَّدِ بْنِ حَكِيمٍ عَنْ أَبِي مَسْرُوقٍ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ:

قُلْتُ إِنَّا نُكَلِّمُ النَّاسَ فَنَحْتَجُّ عَلَيْهِمْ بِقَوْلِ اللَّهِ عَزَّ وَ جَلَّ- أَطِيعُوا اللَّهَ وَ أَطِيعُوا الرَّسُولَ وَ أُولِي الْأَمْرِ مِنْكُمْ‌ فَيَقُولُونَ نَزَلَتْ فِي أُمَرَاءِ السَّرَايَا فَنَحْتَجُّ عَلَيْهِمْ بِقَوْلِهِ عَزَّ وَ جَلَّ- إِنَّما وَلِيُّكُمُ اللَّهُ وَ رَسُولُهُ‌ إِلَى آخِرِ الْآيَةِ فَيَقُولُونَ نَزَلَتْ فِي الْمُؤْمِنِينَ وَ نَحْتَجُّ عَلَيْهِمْ بِقَوْلِ اللَّهِ عَزَّ وَ جَلَّ- قُلْ‌ لا أَسْئَلُكُمْ عَلَيْهِ أَجْراً إِلَّا الْمَوَدَّةَ فِي الْقُرْبى‌ فَيَقُولُونَ نَزَلَتْ فِي قُرْبَى الْمُسْلِمِينَ قَالَ‌ فَلَمْ أَدَعْ شَيْئاً مِمَّا حَضَرَنِي ذِكْرُهُ مِنْ هَذِهِ وَ شِبْهِهِ إِلَّا ذَكَرْتُهُ فَقَالَ لِي إِذَا كَانَ ذَلِكَ فَادْعُهُمْ إِلَى الْمُبَاهَلَةِ قُلْتُ وَ كَيْفَ أَصْنَعُ قَالَ أَصْلِحْ نَفْسَكَ ثَلَاثاً وَ أَظُنُّهُ قَالَ وَ صُمْ وَ اغْتَسِلْ وَ ابْرُزْ أَنْتَ وَ هُوَ إِلَى الْجَبَّانِ فَشَبِّكْ أَصَابِعَكَ مِنْ يَدِكَ الْيُمْنَى فِي أَصَابِعِهِ ثُمَّ أَنْصِفْهُ وَ ابْدَأْ بِنَفْسِكَ وَ قُلِ اللَّهُمَّ رَبَّ السَّمَاوَاتِ السَّبْعِ وَ رَبَّ الْأَرَضِينَ السَّبْعِ عَالِمَ الْغَيْبِ وَ الشَّهَادَةِ الرَّحْمَنَ الرَّحِيمَ إِنْ كَانَ أَبُو مَسْرُوقٍ جَحَدَ حَقّاً وَ ادَّعَى بَاطِلًا فَأَنْزِلْ عَلَيْهِ حُسْبَاناً مِنَ السَّمَاءِ أَوْ عَذَاباً أَلِيماً[1] ثُمَّ رُدَّ الدَّعْوَةَ عَلَيْهِ فَقُلْ وَ إِنْ كَانَ فُلَانٌ جَحَدَ حَقّاً وَ ادَّعَى بَاطِلًا فَأَنْزِلْ عَلَيْهِ حُسْبَاناً مِنَ السَّمَاءِ أَوْ عَذَاباً أَلِيماً ثُمَّ قَالَ لِي فَإِنَّكَ لَا تَلْبَثُ أَنْ تَرَى ذَلِكَ فِيهِ فَوَ اللَّهِ مَا وَجَدْتُ خَلْقاً يُجِيبُنِي إِلَيْهِ‌[2].

1. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Muhammad ibn Hakim from abu Masruq who has said the following: “Once I said to Abu ‘Abdillah (a.s.) ‘We speak to people and in support of our (Shi’a Muslim) belief refer them to the words of Allah, the Most Majestic, the Most Holy, ‘O believers, obey Allah, His Messenger, and your leaders (who possess Divine Authority)...’ (4:59) They say, ‘It applies to the commanders of the missions of armed forces.’ “We then refer them to the words of Allah, the Most Majestic, the Most Holy, ‘Only Allah, His Messenger, and the true believers who are steadfast in prayer and pay alms, while they kneel during prayer, are your guardians.’ (5:55) They say, ‘This applies to the believing people (as a whole).’ “We refer them to the words of Allah, the Most Majestic, the Most Holy, ‘(Muhammad), say, “I do not ask you for any payment for my preaching to you except (your) love of (my near) relatives...’” (42:23) They say, ‘It applies to the relatives of the Muslims.’ “I (the narrator) then mentioned all such references that I knew of and the Imam said, ‘If such is the case, call them for Al- Mubahalah (pleading before Allah for help against the enemy).’ I then asked, ‘How should I do that?’ The Imam said, ‘Correct your soul three days,’ I think he said, ‘Fast, take a shower and both of you go in the mountains, crisscross the fingers of your right hand with his fingers, then yield for justice against yourself (begin with yourself) and say, “O Lord, the Cherisher of the seven heavens and seven earths, the One who possesses the knowledge of the unseen and seen, the Beneficent, the Merciful, if abu Masruq has denied anyone’s rights or has claimed falsehood, send upon him misfortune from the sky or a painful punishment.” Then turn it to him and say, ‘If so and so has rejected a truth or made a false claim, send upon him a misfortune from the sky or a painful punishment.’ Then the Imam said to me, ‘You will very shortly see it in him.’ The narrator has said, ‘I swear by Allah I could not find any creature, who could accept my call for Al-Mubahalah (pleading before Allah for help against the enemy).”’

1. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “I once asked abu ‘ Abd Allah (a.s.), about the case of a fasting woman who tastes to examine the salt of a cooking pot. He (the Imam) said, ‘It is not harmful.’” He (the narrator) has said that he asked him (the Imam) about a fasting woman who has a child and she chews the bread to feed him. He (the Imam) said, ‘It is not harmful. So also is the case of a bird that belongs to her.’”

He (the Imam) replied, There is no offense in the earning by such means, if it is not with an established pre-condition.’”

1. A number of our people have narrated from Sahl ibn Ziyad and Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad all from ibn Mahbub from ‘ Abd al-Rahman ibn al-Hajjaj who has narrated the following: “I once asked abu ‘Abd Allah (a.s.), about the case of a people who drown with a ship or a house falls on them and they die; and it is not known who has died first. He (the Imam) said, ‘They inherit each other and that is how it is in the book of Ali (a.s.).”’ Ali ibn Ibrahim has narrated from Muhammad ibn ‘Isa from Yunus from ‘Abd al-Rahman ibn al- Hajjaj a similar Hadith except that he has said, ‘This is how we found in the book of Ali (a.s.).’

2. Sahl ibn Ziyad has narrated from Ahmad ibn Muhammad ibn abu Basir from Hanan ibn Sadir who has said the following: “Once we visited abu ‘Abd Allah (a.s.), when Farqad al-Hajjam was also with us. He (Farqad) asked him (the Imam) saying, ’May Allah keep my soul in the service of your cause, I perform a certain kind of work and I have asked more than one person about the legal status of what I do and they think it is a detestable work. I like to ask you. If it is as they say I will stop performing such works. Instead I will find some other kind of work. I will take your word as the word in the matter.’ He (the Imam) asked, ’What kind of work is it?’ He (the man) replied, ‘It is cupping.’ He (the Imam) said, ‘You can use the income thereof for living, give charity, pay the expenses of your Hajj and marriage thereof, O brother, (in faith). The Holy Prophet had used cupping services and paid for them. Had it been unlawful he would not pay for it.’ He (the man) then asked, saying, ‘I pray to Allah to keep my soul in service for your cause, I have a he-goat. People hire it for goat grooming. What do you say about the income thereof?’ He (the Imam) replied, ’You can use the income thereof; it is lawful, although people may dislike it.’ I (Hanan) then asked, ’Why people dislike it when it is lawful?’ He (the Imam) replied, ‘It is because people scorn each other about it.’”

2. A number of our people have narrated from Sahl ibn Ziyad from Ahmad ibn Muhammad from ibn abu Nasr al-Bazantiy from ‘Abd al-Karim from Muhammad ibn Hakim who has said the following: “I once asked the virtuous servant of Allah about the case of a young girl who does not experience Hayd (menses) when girls like her become pregnant and her husband has divorced her. He (the Imam) said, ’Her waiting period is three months.’”

Ali ibn Ibrahim has narrated from his father from and Muhammad ibn ’Isma‘il has narrated from al-Fadl ibn Shadhan from all Ibn Abi ‘Umayr from ‘Abd al-Rahman ibn al-Hajjaj who has narrated the following: “I once asked abu ‘Abd Allah, Alayhi al-Salam, about a people on whom a house falls and they all die. It is not known who has died first. He (the Imam) said, ‘They all inherit each other.’ I then said, ‘Abu Hanifah has introduced something in it.’ He (the Imam) asked, ‘What has he introduced?’ I said, ‘Two men who were brothers, one of them was my Mawla’ (slave) and the other was a Mawla’ of another man. One of them had one hundred thousand dirham and the other did not have anything. They embarked on a ship but they drowned and it is not known which one died first, the legacy belongs to the heirs of the one who had nothing and the heirs of the one who had the asset does not receive anything.’ Abu ‘Abd Allah, Alayhi al-Salam, said, ‘He (abu Hanifah) has heard it (the answer) and that is the way it is.’”

Ahmad has narrated from certain individuals of our people about al-Mubahalah this: “Crisscross the fingers of your hand with his fingers and say, ‘O Lord, if so and so has rejected a truth or has professed a falsehood, make him suffer misfortune from the sky or a painful punishment by Your command and then (the parties) renounce each other seventy times.’”

Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Ahmad ibn al-Nadr from ‘Amr ibn Shamir who has said the following: “Abu Ja’far (a.s.), has said that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, did use cupping services. A Mawla’ (slave) of banu Bayada performed cupping service for the Messenger of Allah and paid for such services. Had it been unlawful he would not pay for it. When cupping was complete the Messenger of Allah asked, ‘Where is the blood?’ He (the slave) replied, ‘I drank it, O Messenger of Allah.’ The Messenger of Allah said, ‘You should not have done so. Allah, most Majestic, most Glorious, has made it a curtain between you and the fire but do not do it again.’”

Sahl ibn Ziyad has narrated from Ahmad from ‘Abd al-Karim from abu Basir who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘Waiting period of a woman who does not experience Hayd (menses) and the one who experiences Istihadah who does not be become clean is three months. Waiting period of one whose Hayd (menses) is straight is three Quru’ (Hayd free periods). Al-Quru’ (Hayd free period) is the time of accumulation of blood between two Hayd (menses).”’

Ali ibn Ibrahim has narrated from Muhammad ibn ‘Isa from Yunus from ‘Abd al-Rahman ibn al-Hajjaj and Humayd ibn Ziyad from ibn Sama‘ah from Muhammad ibn abu from ‘Abd al-Rahman ibn al-Hajjaj who has narrated the following: “I once asked abu ‘Abd Allah, Alayhi al-Salam, about the case of a man and a woman on whom a wall falls and they die. He (the Imam) said, ‘The man inherits from the woman and the woman inherits from the man.’ I then said that abu Hanifah has introduced something in it.’ He (the Imam) asked, ‘What has he introduced in it?’ I said that in the case of two non- Arab men who were brothers and had no heirs except their Mawla’ (Master) of whom one had one hundred thousand dirham, which was well known, and the other did not have anything. They embarked on a ship and they were drowned. The one hundred thousand dirham was taken out for distribution. He said that it all must be given to the Mawali of the one who had nothing. He (the Imam) said, ‘I do not deny what he has introduced; it is true and that is how it is.’ He (the Imam) then said, ‘The asset must be given to the Mawali of the one who did not anything . The other brother did not have anything so that the Mawali of the other could inherit anything.’”

He (the Imam) said, ‘She must wait for a period of time equal to that when she experienced Hayd normally; thus she counts her waiting period for three Hayd-free periods. Thereafter she can marry if she so wants.’”

Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Hariz who has narrated the following: “One of the two Imam, (abu Ja‘far or abu ‘Abd Allah), ‘Alayhim al-Salam, has said that Amir al- Mu’minin issued a judgment in Yemen about a people on whom a house had collapsed and only two children were left, of whom one was owned and the other was free. He (the Imam) by means of raffle gave the assets to the one whose name came out and set the other one free.’”

Ali ibn Ibrahim has narrated from his father and Muhammad ibn ‘Isma’il from al-Fadl ibn Shadhan from Ibn Abi ‘Umayr from Mu‘awiyah ibn ‘Ammar who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the legal status of the income from cupping. He (the Imam) replied, There is no offense in it.’ I then asked about income from he-goat for goat-grooming. He (the Imam) replied, ’Even though Arab people consider it scornful, there is no offense in receiving such income.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from al-‘Ala’ from Muhammad ibn Muslim who has said the following: “One of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhim al-Salam, has said that the waiting period for women of the following condition is three months. Of such women is one who experiences Hayd (menses) once every three, six or seven months. Another is one who experiences Istihadah and has not reach the age of experiencing Hayd (menses) also one who experiences Hayd (menses) in one month but not in the other month as well as one who has no hope to have a child. Another is one in her menopause who thinks that she is not of such age and the one who sees a yellowish discharge whose Hayd (menses) is not straight’”

A number of our people have narrated from Ahmad ibn abu ‘Abd Allah in a marfu‘ manner from ’Amir al-Mu’minin who has narrated the following: “About the case of a man and a woman who die together because of plague on one bed and the hand and leg of the man are found on the woman, ’ Amir al-Mu’minin issued a judgment that gave the assets to the man because of his death after the woman.’”

A number of our people have narrated from Ahmad ibn Muhammad from Muhammad ibn ’Isma‘il from Hammad ibn ‘Isa from al- Husayn ibn al-Mukhtar who has narrated the following: “Once abu ‘Abd Allah (a.s.), said to abu Hanifah, ‘O abu Hanifah, what do you say about the case of a people who all die because of the fall of a house? Only two children remain, of whom one is free and the other is a slave of his companion but it is not known which is which’ Abu Hanifah said, ‘One-half of this and one-half of this is set free and the asset must be divided between the two.’ Abu ‘Abd Allah (a.s.), said, ‘It is not as that. By means of raffle whoever ’s name comes out is free and this one is set free to become the Mawla ’ (master) for him.’”

Ali has narrated from his father from Ibn Abi ‘Umayr from Hammad ibn ‘Uthaman from al-Halabiy who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘The waiting period of a woman who does not experience Hayd (menses) and one who experiences Istihadah which does not become clean for three months, their waiting period is three months. Waiting period of a woman whose Hayd is straight is three Hayd-free periods.’ I then asked about the meaning of the words of Allah, most Majestic, most Glorious, ‘. . . if you have doubt.’ He (the Imam) said, ‘This ‘doubt’ is about what is more than one month, thus, she counts her waiting period for three months and ignores Hayd. Whatever of Hayd is in a month which does not increase in Hayd her waiting period is three cycles of Hayd.”’

[2]قوله:« ما زاد على شهر» أي زاد حيضها على شهر يعنى تحيض في أزيد من شهر و ينبغي تخصيصه بما إذا لم يكن حيضها في أقل من ثلاثة أشهر ثلاث حيض على نهج واحد ليتوافق الاخبار.« و ما كان في الشهر» يعنى ما كان حيضها في الشهر.« ثم تزد» يعنى المرأة.« فى الحيض» أى رؤية الحيض.« عليه» أي على الشهر.« ثلاث حيض» يعنى الى ثلاث حيض متوالية. فعدتها ثلاث حيض لاستقامة حيضها حينئذ و يكفى الدخول في الثالثة كما عرفت. و قال في الاستبصار:ص 100

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Hassan ibn Ali ibn Faddal from ibn Bukayr from Zurarah who has said the following: “One of the two Imam, (abu Ja‘far or abu ‘Abd Allah), ‘Alayhim al-Salam, has stated this Hadith. ‘Of the two issues whichever comes first, it marks the end of her waiting period: one is passing of three months in which she does not see Hayd (menses), thus her waiting period ends. If three Hayd-free periods pass this also marks the end of her waiting period.’”

Muhammad has narrated from Ahmad from Ali ibn al-Hakam from Musa ibn Bakr from Zurarah who has said the following: “He (the Imam) (a.s.), has said, ‘If she waits and does not find the Hayd (menses)-free period except three months then if her Hayd (menses) is not straight. If she experiences Hayd in a month several times such woman’s waiting period is like the waiting period of one who experiences Istihadah, whose ‘Iddah (waiting period) is three months. If she experiences Hayd straightly, thus, in every month is one Hayd and between two Hayd (menses) one month of time it is the Hayd-free period.’”
