Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from ‘Abd al-Samad from al-Husayn ibn Hammad from abu Ja’far (a.s.) who has said the following: “Whoever after an obligatory prayer and before moving his legs to a second position says, ‘I plead before Allah for forgiveness, no one deserves to be worshipped except Allah, the Living, the Guardian, the Possessor of Glory and Honor and to Him I return,’ three times Allah, the Most Majestic, the Most Holy, will forgive his sins even if they are as much as the bubbles of the ocean.’”

1. A number of our people have narrated from Ahmad ibn Muhammad from al-Husayn ibn Sa‘id from al-Qasim ibn Muhammad from Ali ibn abu Hamzah forms who has said the following: “I once asked abu ‘ Abd Allah (a.s.), about commencing a journey when the month of Ramadan has just arrived. He (the Imam) said, ‘No, except that which I tell you. Traveling to Makkah, travelling in an armed expedition for the cause of Allah, for protection of an asset that is feared for its destruction, and to say farewell to and escort a brother and it applies not only to your brother from your father and mother, are permissible.”’

Ali ibn Ibrahim has narrated from his father from Hammad from Hariz from Muhammad ibn Muslim who has said the following: “This is concerning my question before abu ‘ Abd Allah (a.s.), about a man whose son owned a certain amount of wealth and his father was needy. He (the Imam) replied, ‘He has permission to use such wealth for food; however, a mother does not have such permission but she can borrow on her own responsibility.’”

Ali ibn Ibrahim has narrated from Muhammad ibn ‘Isa ibn ‘Ubayd from [Yunus] from Hisham ibn Salim who has narrated the following: “Khattab al-A‘war asked abu Ibrahim (a.s.), when I was sitting, ‘A man worked on hire with my father and we lost him. A certain amount from his wages was left with us and we did not know any of his heirs. He (the Imam) said, ‘You must search for him.’ He said, ‘We searched but did not find him.’ He (the Imam) said, ‘Destitute people’, making a hand gesture with his both hands. The man repeated his question. He (the Imam) said, ‘Search and try hard if you can find him, otherwise, it is like your other assets until someone comes asking for it; and if something happens to you, make a will about it to give it to the one who may come asking for it (remaining wages).”’

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “I once asked abu ‘Abd Allah (a.s.), about a man who when the month of Ramadan arrives is at home and does not want to travel; then it occurs to him, when it is the month of Ramadan, to travel. He (the Imam) remained quiet and I asked several times then he (the Imam) said, ‘Staying home is better unless he has a certain need for which it is necessary for him to travel or is afraid for his assets.’”

He (the Imam) replied, ‘No, unless he is compelled by pressing needs, in which case he spends in a fair manner but it is not proper for the sons to spend the properties of their father without the permission of the father.’”

2. Yunus ibn Thabit and ibn ‘Awn has narrated from Mu‘awiyah ibn Wahab who has narrated the following: “This is about the case of a man who has a right on another man. However, he was lost and he did not know where to look for him, not knowing if he is dead or living. He does not know of anyone as his heir, or a town or lineage relation. He (the Imam) said, ‘He must search but if it becomes very long then he must give it in charity.’ He (the Imam) said, ‘You must search for him.’”

Sahl ibn Ziyad has narrated from ibn Mahbub from abu Hamzah al-Thumaliy who has said the following: “Abu Ja‘far (a.s.), has said that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, once said to a man, ‘You and your property belong to your father.’ Abu Ja’far (a.s.), then said, ‘I do not like his spending from the property of his son more than what he needs for his bare necessities; Allah, most Majestic, most Glorious, does not love destruction.’”

4. Yunus has narrated from al-Haytham abu Ruh Sahib al-Khan who has narrated the following: “I once wrote to the virtuous servant (of Allah) that I manage hotels. A man who stays in the hotel may die suddenly and I do not know his town and his heirs; and his assets remain with me. What must I do about it? 5. Sahl ibn Ziyad has narrated from ibn Mahbub from al-‘ Ala’ ibn Razin from Muhammad ibn Muslim who has said the following: “I once asked abu Ja’far (a.s.), about a man who needed to spend from the property of his son. He (the Imam) replied, ‘He has permission to use the property of his son for food as much as he wants but without excess.’ He (the Imam) said, ‘It is in the book of Ali (a.s.), that a son does not have permission to spend from the property of his father anything unless his father grants him permission. A father has permission to take from the property of his sons as he wants. He may also have carnal relations with the slave-girl of his son if his son has not yet engaged in carnal relations with her.’ He (the Imam) also mentioned that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, once said to a man, ‘You and your property belong to your father.’”

Muhammad ibn Yahya has narrated from ‘Abd Allah ibn Muhammad from Ali ibn al-Hakam from Al-Husayn ibn al-‘Ala’ who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), ‘How much can a father spend from the property of his sons?’ He (the Imam) replied, ‘He can take for his basic necessities without excess when pressing needs compel him.’ I (the narrator) then asked about the words of the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, to a man who came to him and had brought his father also. The Messenger of Allah said to him, ‘You and your property belong to your father’ He (the Imam) replied, ‘He brought his father before the Holy Prophet saying, “O Messenger of Allah, he has done injustice to me in the matters of the legacy of my mother.” The father informed him of his spending her legacy on the son and for his own expenses. Then he (the Messenger of Allah) said, “You and your property belong to your father.” The man did not own anything. Should the Messenger of Allah stop the father benefiting from the son?’”

Al-Husayn from Muhammad has narrated from Mu‘alla’ ibn Muhammad from al-Washsha’ from Aban from ibn abu Ya‘fur who has said the following: “About the case of a woman who dies before his going to bed with her, about her mahr (dower) and her inheritance, abu ‘Abd Allah (a.s.), has said, ‘If mahr (dower) is set for her, she deserves one-half of it and he inherits her legacy. If mahr (dower) is not set then mahr (dower) is not payable to her.’ About the case of a man who dies before going to bed with his wife, he (the Imam) said, ‘If he has set mahr (dower) for her she deserves one-half of it and she inherits him, but if mahr (dower) is not set she then does not have the right to demand any mahr (dower).”’

A number of our people have narrated from Sahl ibn Ziyad from Ali ibn Mahziyar from who has narrated the following: “I once asked abu Ja’far (a.s.), about the case of a house that belongs to a woman who had a son and a daughter. Her son disappeared in the ocean, the woman died and the daughter claimed that her mother had given the house to her and she sold certain parts of it. One portion was left next to the house of a man of our people, he did not like to buy it because of the disappearance of the son, and for fear that, it may not be lawful for him to buy it with no news from the son. He (the Imam) asked me, ‘For how long has he disappeared?’ I replied, ‘It is many years.’ He (the Imam) said, ‘One must wait for ten years, then buy it.’ I then asked, ‘Is it lawful to buy it after ten years?’ He (the Imam) said, ‘Yes, it is lawful.’”

Abu Ali al-Ash ‘ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan from Ishaq ibn ‘Ammar who has narrated the following: “I once asked him (the Imam) (a.s.), about the case of a man who had several sons, of whom one disappeared and he did not know where he was. The man died. What must be done with the share of the legacy for the son who has disappeared? He (the Imam) said, ‘It must be kept aside until he comes? I then said, ‘The man is lost (the father died) he did not come? He (the Imam) said, ‘If the heirs are trusted for his asset, they can distribute among themselves; and when he comes then give it to him?” A number of our people have narrated from Sahl ibn Ziyad from Ahmad ibn Muhammad ibn abu Nasr from Hammad from Ishaq ibn ‘Ammar from abu Ibrahim ‘Alayhi al-Salam, a similar Hadith.

8. Humayd ibn Ziyad from al-Hassan ibn Muhammad ibn Sama‘ah, from ibn Ribat and ‘Abd Allah ibn Jabalah from Ishaq ibn ‘Ammar who has narrated the following: “I once asked abu al-Hassan, al-Awwal (a.s.), about the case of a man who has several sons, of whom one disappeared and he did not know where he was. The man died. What must be done with his share of legacy from his father? He (the Imam) said, ‘It must be kept aside until he comes? I then asked if there is Zakat on his assets. He (the Imam) said, ‘No, there is no Zakat until he comes? I then asked if he must pay Zakat when he comes. He (the Imam) said, ‘No, until one year passes with the asset in his possession? I then said, ‘The man is lost and he has not come back? He (the Imam) said, ‘If the heirs of the man can be trusted about his assets, they can distribute it among themselves and when he comes give it to him?”

Humayd has narrated from ibn Sama‘ah from Ahmad ibn al-Hassan from Mu‘awiyah ibn Wahab from ‘Ubayd ibn Zurarah who has said the following: “About the case of a woman whose husband dies before going to bed with her, abu ’Abd Allah (a.s.), has said, ‘She is like a divorced woman with whom he has not gone to bed. If mahr (dower) is set for her she deserves one-half of it, otherwise, she does not have the right to demand mahr (dower) but she has the right to inherit.’ I asked about waiting period. He (the Imam) said, ‘Do not ask about it.’”

Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from ‘Uthman ibn ‘Isa from Sama‘ah, who has narrated the following: “Abu ‘Abd Allah (a.s.), has said, ‘The heirs must keep the assets of one who is lost for the duration of four years’ searching. If he is not found, his assets are distributed among the heirs. If he has children, the assets must be withheld and the expenses of his children must be provided during the four years?”

Humayd has narrated from ibn Sama‘ah and abu al-‘Abbas al-Razzaz from Ayyub ibn Nuh and Muhammad ibn ’Isma‘il has narrated from al-Fadl ibn Shadhan from all from Safwan ibn Yahya from ibn Muskan from al-Hassan al-Sayqal and abu Abbas who has said the following: “About the case of a woman whose husband dies before going to bed with her, abu ‘Abd Allah (a.s.), has said, ‘She deserves one-half of mahr (dower), complete inheritance and she must count the waiting period.’”

3. Yunus has narrated from Nasr ibn Habib Sahib al-Khan who has narrated the following: “I once wrote to the virtuous servant (of Allah) about two hundred and four dirham which remained with me. I own a hotel. The owner of dirham has died and I do not know any heirs for him. I need your opinion on this matter and what must I do about it; I am depressed thereby. He (the Imam) wrote and said, ‘You can work with it and give it as charity little by little until it is complete.’”
