عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادِ بْنِ عِيسَى عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ:

مَنْ دَخَلَ مَكَّةَ مُتَمَتِّعاً فِي أَشْهُرِ الْحَجِّ لَمْ يَكُنْ لَهُ أَنْ يَخْرُجَ حَتَّى يَقْضِيَ الْحَجَّ فَإِنْ عَرَضَتْ لَهُ حَاجَةٌ إِلَى عُسْفَانَ أَوْ إِلَى الطَّائِفِ أَوْ إِلَى ذَاتِ عِرْقٍ خَرَجَ مُحْرِماً وَ دَخَلَ مُلَبِّياً بِالْحَجِّ فَلَا يَزَالُ عَلَى إِحْرَامِهِ فَإِنْ رَجَعَ إِلَى مَكَّةَ رَجَعَ مُحْرِماً وَ لَمْ يَقْرَبِ الْبَيْتَ حَتَّى يَخْرُجَ مَعَ النَّاسِ إِلَى مِنًى عَلَى إِحْرَامِهِ وَ إِنْ شَاءَ كَانَ وَجْهُهُ ذَلِكَ إِلَى مِنًى قُلْتُ فَإِنْ جَهِلَ وَ خَرَجَ إِلَى الْمَدِينَةِ أَوْ إِلَى نَحْوِهَا بِغَيْرِ إِحْرَامٍ ثُمَّ رَجَعَ فِي إِبَّانِ الْحَجِّ فِي أَشْهُرِ الْحَجِّ يُرِيدُ الْحَجَّ أَ يَدْخُلُهَا مُحْرِماً أَوْ بِغَيْرِ إِحْرَامٍ فَقَالَ إِنْ رَجَعَ فِي شَهْرِهِ دَخَلَ بِغَيْرِ إِحْرَامٍ وَ إِنْ دَخَلَ فِي غَيْرِ الشَّهْرِ دَخَلَ مُحْرِماً- قُلْتُ فَأَيُّ الْإِحْرَامَيْنِ وَ الْمُتْعَتَيْنِ مُتْعَةِ الْأُولَى أَوِ الْأَخِيرَةِ قَالَ الْأَخِيرَةُ وَ هِيَ عُمْرَتُهُ وَ هِيَ الْمُحْتَبَسُ بِهَا الَّتِي وُصِلَتْ بِحَجِّهِ قُلْتُ فَمَا فَرْقٌ بَيْنَ الْمُفْرَدَةِ وَ بَيْنَ عُمْرَةِ الْمُتْعَةِ إِذَا دَخَلَ فِي أَشْهُرِ الْحَجِّ قَالَ أَحْرَمَ بِالْعُمْرَةِ وَ هُوَ يَنْوِي الْعُمْرَةَ ثُمَّ أَحَلَّ مِنْهَا وَ لَمْ يَكُنْ عَلَيْهِ دَمٌ وَ لَمْ يَكُنْ مُحْتَبِساً بِهَا لِأَنَّهُ لَا يَكُونُ يَنْوِي الْحَجَ‌.

1. Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘One who enters Makkah in the months of al-Hajj for al- Hajj al-Tamattu‘ (advantageous) must not leave Makkah until he completes al-Hajj. If he for an urgent reason needs to go to ‘Usfan or to Ta’if or to Dhat ‘Irq, he must go in the state of Ihram and enter Makkah saying Talbiyah for al-Hajj. He then continues with his Ihram. If he returns to Makkah, he does so in the state of Ihram and must not go near the House until he goes out with people to Mina’ with his Ihram, as if Mina is his destination.’ I then asked, ‘What happens if he out of ignorance goes to al-Madinah or similar places without Ihram, then returns close to the time for al-Hajj in the months of al-Hajj wanting to perform al-Hajj? Must he enter Makkah in the state of Ihram or without it?’ He (the Imam) said, ‘If he returns in the same month he enters without Ihram, but if he enters in another month he must enter in the state of Ihram.’ I then asked, ‘Which one of the two Ihram and two Mut‘ah is it, the first or the later Mut‘ah is the one?’ He (the Imam) said, ‘The last one which is al-‘Umrah and it is on hold which connects with al-Hajj.’ I then asked, ‘What is then the difference between al-‘Umrah of al-Hajj al-Tamattu‘ (advantageous) and al-‘Umrah alone if he enters in the months of al- Hajj?’ He (the Imam) said, ‘He assumed the state of Ihram for al-‘Umrah and wanted al-‘Umrah; then came out of that Ihram in which case was no offering on him (as penalty), and was not on hold with it because he did not have the intention of performing al-Hajj.’”

[1]« كان وجهه ذلك إلى منى» يعنى لم يرجع إلى مكّة و يذهب كما كان إلى منى لما لم يجز للمتمتع ان يخرج من مكّة بعد عمرته حتّى يقضى مناسك حجه إلّا أن يكون له عذر في الخروج بالشروط المذكورة فمن فعل ذلك من غير عذر فكانه أفسد عمرته التي يريد أن يوصلها بحجه إلّا أن يرجع في ذلك الشهر بعينه فان أخر إلى شهر آخر فلا بدّ من عمرة اخرى يوصلها بحجه.« فاى الاحرامين و المتعتين» يعنى بهما العمرتين هي عمرته أي منعته و سؤاله عن الفرق بين العمرتين مسألة اخرى.ص 442

1. A number of our people have narrated from Ahmad ibn Muhammad from ibn Mahbub from Malik ibn ‘Atiyyah from Muhammad ibn Muslim who has said the following: “Abu Ja‘far (a.s.), has said that once a woman came to the Holy Prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, and asked, ‘What is the right of husband on a woman?’ He (the Messenger of Allah) said to her, ‘She must yield to and obey him and must not oppose and disobey him. She must not give charity from his house without his permission and must not fast optionally without his permission. If she goes out of his house without his permission, the angels of skies and earth condemn her as well the angels of wrath and angels of mercy until she returns to her home.’ She then asked, ‘O Messenger of Allah, who has the greatest right on a man?’ He (the Messenger of Allah) replied, ‘His father has the greatest right.’ She then asked, ‘O Messenger of Allah, who has the greatest right on a woman?’ He (the Messenger of Allah) replied, ‘Her husband has the greatest right on her.’ She then asked, ‘How is it that I do not have as much right on him as he has on me?’ He (the Messenger of Allah) said, ‘No, not even one out of one hundred.’ She then said, ‘I swear by the One who has sent you as a prophet in all truth; I will never allow any man to have a hold of my neck.’”

2. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Yahya from Ishaq ibn ‘Ammar who has said the following: “I once asked abu al-Hassan (a.s.), about a man who is for al-Hajj al-Tamattu‘ (advantageous). He comes and completes his Mut‘ah, then he for a certain work goes to al-Madinah or to Dhat ‘Irq or to a certain other place. He (the Imam) said, ‘He returns to Makkah for al-‘Umrah if it is in the months in which Mut‘ah is performed; for every month there is al-‘Umrah and he is bound with al-Hajj.’ I then asked, ‘What can happen if he enters in the month in which he left?’ He (the Imam) said, ‘My father (a.s.), was residing here and he once went to meet certain ones of these people. When he returned and reached Dhat ‘Irq he assumed the state of Ihram for al-Hajj. He entered in the state of Ihram for al-Hajj.’”

[2]قوله:« من ذات عرق» ظاهره جواز الاحرام بحج التمتع من الميقات في تلك الصورة و مال إليه الشيخ- رحمه اللّه- في التهذيب حيث قال: و من خرج من مكّة بغير احرام و عاد في الشهر الذي خرج فيه فالأفضل أن يدخلها محرما بالحج و يجوز له أن يدخلها بغير إحرام انتهى. و المشهور بين الاصحاب عدم جواز الاحرام الامن مكّة و يحتمل أن يكون إحرامه عليه السلام للتقية اذ ظاهر أن المراد بقوله عليه السلام:« بعض هؤلاء» بعض العامّة بل ولاتهم و كان ترك الاحرام دليلا على احرامه بحج التمتع فلذا أحرم عليه السلام تقيّة. و قال في الدروس: و لو رجع في شهره دخلها محلا فان أحرم فيه من الميقات بالحج فالمروى عن الصادق عليه السلام أنّه فعله من ذات عرق و كان قد خرج من مكّة.( آت)ص 442

2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Muhammad ibn al-Fudayl from Sa‘d ibn abu ‘Amr al-Jallab who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘If a woman passes a night and her husband is angry with her because of a right to which she does not yield, her Salat (prayer) is not accepted until he becomes happy with her. If a woman wears perfume for other than her husband, her Salat (prayer) is not accepted until she washes them clean just as she takes a Ghusl (bath) because of going to bed.’”

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “I once asked abu ‘Abd Allah (a.s.), about a man who is for al-Hajj al-Tamattu‘ (advantageous) but wants to go to Ta’if. He (the Imam) said, ‘He must commence al-Hajj from Makkah and I do not like for him to go out without Ihram. He must not go beyond Ta’if; it is not far from Makkah.’”

One is a runaway slave, a woman whose husband is not happy with her and one who drags his gown on the ground out of pride.’”

Ibn abu ‘Umayr has narrated from Hafs ibn al-Bakhtariy who has said the following: “About a man who completes Mut‘ah then because of a certain work wants to go out, he (the Imam) said, ‘He must take Ghusl (bath) for Ihram and say Talbiyah for al-Hajj, then go for his work and if he cannot return to Makkah he must go straight to ‘Arafat.’”

5. Al-Husayn ibn Muhammad has narrated from Mu‘alla’ ibn Muhammad from those whom he has mentioned from Aban from those who narrated to him who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘One who is for al-Hajj al-Tamattu‘ (advantageous) is on hold. He cannot go out of Makkah until he goes out for al-Hajj, unless his slave runs away or his stumper is lost, in which case he can go out of Makkah in the state of Ihram but he must reach ‘Arafat in time.’”

5. Muhammad ibn Yahya has narrated from ‘Abd Allah ibn Muhammad from Ali ibn al-Hakam from Aban ibn ‘Uthman from al-Hassan ibn al-Mundhir who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘Salat (prayer) of three kinds of people is not accepted. One is a runaway slave from his masters until he places his hand in their hands, a woman who passes the night when her husband is angry with her and a man who leads a people in Salat (prayer) and they dislike him.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from Malik ibn ‘Atiyyah from Sulayman ibn Khalid who has said the following: “Abu ‘ Abd Allah (a.s.), has said that once a people came to the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, and said, ‘O Messenger of Allah, we saw a people who prostrate for each other.’ The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, said, ‘If I were to command anyone to prostrate for others I would command the woman to prostrate for her husband.’”

جَاءَتِ امْرَأَةٌ إِلَى رَسُولِ اللَّهِ ص فَقَالَتْ يَا رَسُولَ اللَّهِ مَا حَقُّ الزَّوْجِ عَلَى الْمَرْأَةِ قَالَ أَكْثَرُ مِنْ ذَلِكَ‌ فَقَالَتْ فَخَبِّرْنِي عَنْ شَيْ‌ءٍ مِنْهُ فَقَالَ لَيْسَ لَهَا أَنْ تَصُومَ إِلَّا بِإِذْنِهِ يَعْنِي تَطَوُّعاً وَ لَا تَخْرُجَ مِنْ بَيْتِهَا إِلَّا بِإِذْنِهِ وَ عَلَيْهَا أَنْ تَطَيَّبَ بِأَطْيَبِ طِيبِهَا وَ تَلْبَسَ أَحْسَنَ ثِيَابِهَا وَ تَزَيَّنَ بِأَحْسَنِ زِينَتِهَا وَ تَعْرِضَ نَفْسَهَا عَلَيْهِ غُدْوَةً وَ عَشِيَّةً وَ أَكْثَرُ مِنْ ذَلِكَ حُقُوقُهُ عَلَيْهَا.

A number of our people have narrated from Ahmad ibn Muhammad from ibn Khalid from al-Jamuraniy from ibn abu Hamzah from “Amr ibn Jubayr al-‘Arzamiy who has said the following: “Abu ‘Abd Allah (a.s.), has said that once a woman came to the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, and asked, ‘O Messenger of Allah, what is the right of husband on the wife?’ He (the Messenger of Allah) said, ‘Should I tell you a great deal about it?’ She said, ‘Tell me something about it.’ He (the Messenger of Allah) said, ‘She must not fast an optional fast without his permission, must not go out of her house without his permission, must wear the best of perfumes for him and the best of her dresses, wear the best of make up for him, make herself available for him in the mornings and evenings; and his rights on her are more than this.’”

أَتَتِ امْرَأَةٌ إِلَى رَسُولِ اللَّهِ ص فَقَالَتْ مَا حَقُّ الزَّوْجِ عَلَى الْمَرْأَةِ فَقَالَ أَنْ تُجِيبَهُ إِلَى حَاجَتِهِ وَ إِنْ كَانَتْ عَلَى قَتَبٍ وَ لَا تُعْطِيَ شَيْئاً إِلَّا بِإِذْنِهِ فَإِنْ فَعَلَتْ فَعَلَيْهَا الْوِزْرُ وَ لَهُ الْأَجْرُ وَ لَا تَبِيتَ لَيْلَةً وَ هُوَ عَلَيْهَا سَاخِطٌ قَالَتْ يَا رَسُولَ اللَّهِ وَ إِنْ كَانَ ظَالِماً قَالَ نَعَمْ قَالَتْ وَ الَّذِي بَعَثَكَ بِالْحَقِّ لَا تَزَوَّجْتُ زَوْجاً أَبَداً.

It is narrated from the narrator of the previous Hadith from al-Jamuraniy from ibn abu Hamzah from abu al-Mighra’ from abu Basir who has said the following: “Abu ‘Abd Allah (a.s.), has said that once a woman came to the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, and asked, ‘What is the right of husband on the wife?’ He (the Messenger of Allah) said, ‘Of his rights is to make herself available for him even when on the back of a camel and must not give anything without his permission. If she does it, she carries the sin and the reward is for him. She must not pass a night with him angry on her.’ She asked, ‘Even if he acts unjustly, O Messenger of Allah?’ He (the Messenger of Allah) replied, ‘Yes, even if he is as such.”
