قَالَ: لَا تُصَلِّ الْمَغْرِبَ حَتَّى تَأْتِيَ جَمْعاً فَتُصَلِّيَ بِهَا الْمَغْرِبَ وَ الْعِشَاءَ الْآخِرَةَ بِأَذَانٍ وَاحِدٍ وَ إِقَامَتَيْنِ وَ انْزِلْ بِبَطْنِ الْوَادِي عَنْ يَمِينِ الطَّرِيقِ قَرِيباً مِنَ الْمَشْعَرِ وَ يُسْتَحَبُّ لِلصَّرُورَةِ أَنْ يَقِفَ عَلَى الْمَشْعَرِ الْحَرَامِ‌ وَ يَطَأَهُ بِرِجْلِهِ وَ لَا يُجَاوِزِ الْحِيَاضَ لَيْلَةَ الْمُزْدَلِفَةِ وَ يَقُولُ اللَّهُمَّ هَذِهِ جَمْعٌ اللَّهُمَّ إِنِّي أَسْأَلُكَ أَنْ تَجْمَعَ لِي فِيهَا جَوَامِعَ الْخَيْرِ اللَّهُمَّ لَا تُؤْيِسْنِي مِنَ الْخَيْرِ الَّذِي سَأَلْتُكَ أَنْ تَجْمَعَهُ لِي فِي قَلْبِي- وَ أَطْلُبُ إِلَيْكَ أَنْ تُعَرِّفَنِي مَا عَرَّفْتَ أَوْلِيَاءَكَ فِي مَنْزِلِي هَذَا وَ أَنْ تَقِيَنِي جَوَامِعَ الشَّرِّ وَ إِنِ اسْتَطَعْتَ أَنْ تُحْيِيَ تِلْكَ اللَّيْلَةَ فَافْعَلْ فَإِنَّهُ بَلَغَنَا أَنَّ أَبْوَابَ السَّمَاءِ لَا تُغْلَقُ تِلْكَ اللَّيْلَةَ لِأَصْوَاتِ الْمُؤْمِنِينَ لَهُمْ دَوِيٌّ كَدَوِيِّ النَّحْلِ يَقُولُ اللَّهُ جَلَّ ثَنَاؤُهُ أَنَا رَبُّكُمْ وَ أَنْتُمْ عِبَادِي أَدَّيْتُمْ حَقِّي وَ حَقٌّ عَلَيَّ أَنْ أَسْتَجِيبَ لَكُمْ فَيَحُطُّ اللَّهُ تِلْكَ اللَّيْلَةَ عَمَّنْ أَرَادَ أَنْ يَحُطَّ عَنْهُ ذُنُوبَهُ وَ يَغْفِرُ لِمَنْ أَرَادَ أَنْ يَغْفِرَ لَهُ.

1. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Mu‘awiyah and Hammad from al-Halabiy who has said the following: (NOTE: Fatwa best explains the beginning of this Hadith.)“Abu ‘ Abd Allah (a.s.), has said that you must not perform al-Maghrib Salat (prayer) until you arrive at al-Jam‘ so that you can perform both al-Maghrib and al-‘Isha’ al-’Akhirah with one Adhan and two ’Iqamah. You must disembark in valley on the right side of the road near al-Mash‘ar. One who performs al-Hajj for the first time should stay in al-Mash‘ar al-Haram, walk on foot but must not pass Hiyaz in the night of al-Muzdalifah, and should say, ‘O Allah, this is an assembly. O Allah, I appeal before You to accumulate for me all goodness. O Allah, do not deprive me of the goodness for which I have appealed before You, and accumulate all of it in my heart. I appeal before You to make me learn what You have made Your friends to learn at this place, and keep me safe from all wickedness and evil.’ You should remain, if you can, that night awake. It has come to us that the doors of the heaven remain open that night for the voices of the believing people, who express a humming voice like honey bees. Allah, the Most Majestic, the Most Glorious, says, ‘I am Your Lord and you are My servants. You have yielded to My rights and it is necessary for Me to answer your prayers.’ During that night Allah deletes the sins of whomever He wants and forgives whomever He decides to forgive.’”

[3]اعلم انه قد يطلق الشعر- بفتح الميم و قد يكسر- على جميع المزدلفة و قد يطلق على الجبل المسمى بقزح و هو المراد هاهنا في الموضعين كما ذكره الشيخ و فسرها ابن الجنيد بما قرب من المنارة و قال في الدروس: الظاهر أنّه المسجد الموجود الآن و ما ذكره بعض المتأخرين أن المراد المزدلفة فلا يخفى بعده.( آت)ص 468

[1]قوله:« و لا يجاوز الحياض» أي حياض وادى محسر فانها حدّ عرفة من جهة منى و ظاهره وجوب الوقوف بالليل كما اختاره بعض الاصحاب و المشهور استحبابه و أن الوقوف الواجب الذي هو ركن هو بعد طلوع الفجر.( آت)ص 469

1. A number of our people have narrated from Ahmad ibn Muhammad from Khalid from Muhammad ibn Ali from Muhammad ibn Aslam al-Jabaliy from ‘Abd al-Rahman ibn Salim al-Ashal from al-Mufaddal ibn ‘Umar who has said the following: “I once asked abu ‘Abd Allah (a.s.), ‘How did the Messenger of Allah touch the hands of women for their pledge of allegiance? He (the Imam) said, ‘He (the Messenger of Allah) asked for a bucket in which he would make wudu. He (the Messenger of Allah) poured water in it, then immersed his right hand in water and as soon as one of them pledged allegiance he (the Messenger of Allah) asked her to immerse her hand in the water and she did so whenever he (the Messenger of Allah), O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, did and this is how he touched their hands.’” Ali ibn Ibrahim has narrated from his father from certain persons of his people from abu ‘Abd Allah (a.s.), a similar Hadith.

Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Muskan from ‘Anbasah ibn Mus’ab who has said the following: “I once asked abu ‘Abd Allah (a.s.), about the Rak‘ats of Salat (prayer) after al-Maghrib during the night of al-Muzdalifah. He (the Imam) said, ‘Perform them after al-‘Isha’ as four Rak‘at.’”

2. Abu Ali al-Ash’ariy has narrated from Ahmad ibn Ishaq from Sa‘dan ibn Muslim who has said the following: “Abu ‘Abd Allah (a.s.), once asked me, ‘Do you know how the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, pledged allegiance with women?’ I replied, ‘Allah knows best and the child of His Messenger knows best.’ He (the Imam) said, ‘He (the Messenger of Allah) called them to come together around him (the Messenger of Allah) and asked for a bowl. The place was Baram (near al-Baqi‘). He (the Messenger of Allah) poured water in the bowl just to moisten it and immersed his hand in it, then said, ‘Listen all of you. I pledge allegiance with you with the condition that you will not call anything as partners of Allah, you must not steal, you must not fornicate, you must not kill your children, you must not accuse falsely fabricating all by yourselves and you must not disobey your husbands in lawful matters. Do you confirm and acknowledge?’ They replied, ‘Yes, we confirm.’ He (the Messenger of Allah) then moved his hand from the bowl then said to them, ‘Immerse your hands in the bowl and they also did so. The purified and holy hand of the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, must not have touched female hands who were not of his relatives.’”

3. Al-Husayn ibn Muhammad has narrated from Mu‘alla’ ibn Muhammad from al-Hassan ibn Ali from Aban ibn ‘Uthman from a man who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘It is preferable for al-Sarura (one who performs al-Hajj for the first time) to walk on al-Mash‘ar al-Haram (name of a place) and enter the House. ’’’(Fatwa best explains Hadith 2-3 of this Chapter.)

A number of our people have narrated from Ahmad ibn Muhammad from ‘Uthman ibn ‘Isa from abu Ayyub al-Khazzaz from a man who has said the following: “About the words of Allah, most Majestic, most Glorious, ‘. . . that they must not disobey you in lawful matters’ (60:13) Abu ‘Abd Allah (a.s.), has said, ‘lawful matters means not to tear one’s shirt, slap one’s face, crying, ‘woe is me’, must not remain behind near the grave, must not blacken clothes and must not spread hairs.’”

4. Muhammad ibn Yahya has narrated from Salmah ibn al-Khattab from Sulayman ibn Sama‘ah al-Khuza‘iy from Ali ibn ‘Isma’il from ‘Amr ibn abu al-Miqdam who said: “I once heard Abu Ja‘far (a.s.) say, ‘Do you know what is the meaning of the words of Allah, ‘. . . that they must not disobey you in lawful matters?’ (60:13) I replied, ‘No, I do not know.’ He (the Imam) said, ‘The Messenger of Allah (sw) once said to Fatimah (sa), ‘When I die, you must not cause abrasion to any face, do not spread for me any hairs, do not cry ‘woe is me’ and do not call any gathering to mourn for me.’ He (the Imam) then said, ‘This is the lawful matter about which Allah, most Majestic, most Glorious, has spoken.’”

5. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Yahya from Ishaq ibn ‘Ammar who has said the following: “I once asked abu Ibrahim (a.s.), about the time in which he likes to leave al-Jam' (Mash’ar). He (the Imam) said, ‘It is a little before sunrise. That is the best hour to me.’ I asked, ‘Can we wait until sunrise?’ He (the Imam) said, ‘It is not harmful.’”

لَمَّا فَتَحَ رَسُولُ اللَّهِ ص مَكَّةَ بَايَعَ الرِّجَالَ ثُمَّ جَاءَ النِّسَاءُ يُبَايِعْنَهُ فَأَنْزَلَ اللَّهُ عَزَّ وَ جَلَّ- يا أَيُّهَا النَّبِيُّ إِذا جاءَكَ الْمُؤْمِناتُ يُبايِعْنَكَ عَلى‌ أَنْ لا يُشْرِكْنَ بِاللَّهِ شَيْئاً وَ لا يَسْرِقْنَ وَ لا يَزْنِينَ وَ لا يَقْتُلْنَ أَوْلادَهُنَ‌ وَ لا يَأْتِينَ بِبُهْتانٍ يَفْتَرِينَهُ‌ بَيْنَ أَيْدِيهِنَّ وَ أَرْجُلِهِنَ‌ وَ لا يَعْصِينَكَ فِي مَعْرُوفٍ‌ فَبايِعْهُنَّ وَ اسْتَغْفِرْ لَهُنَّ اللَّهَ إِنَّ اللَّهَ غَفُورٌ رَحِيمٌ‌ فَقَالَتْ هِنْدٌ أَمَّا الْوَلَدُ فَقَدْ رَبَّيْنَا صِغَاراً وَ قَتَلْتَهُمْ كِبَاراً وَ قَالَتْ أُمُّ حَكِيمٍ بِنْتُ الْحَارِثِ بْنِ هِشَامٍ وَ كَانَتْ عِنْدَ عِكْرِمَةَ بْنِ أَبِي جَهْلٍ يَا رَسُولَ اللَّهِ مَا ذَلِكَ الْمَعْرُوفُ الَّذِي أَمَرَنَا اللَّهُ أَنْ لَا نَعْصِيَنَّكَ فِيهِ قَالَ لَا تَلْطِمْنَ خَدّاً وَ لَا تَخْمِشْنَ وَجْهاً وَ لَا تَنْتِفْنَ شَعْراً وَ لَا تَشْقُقْنَ جَيْباً وَ لَا تُسَوِّدْنَ ثَوْباً وَ لَا تَدْعِينَ بِوَيْلٍ فَبَايَعَهُنَّ رَسُولُ اللَّهِ ص عَلَى هَذَا فَقَالَتْ يَا رَسُولَ اللَّهِ كَيْفَ نُبَايِعُكَ قَالَ إِنَّنِي لَا أُصَافِحُ النِّسَاءَ فَدَعَا بِقَدَحٍ مِنْ مَاءٍ فَأَدْخَلَ يَدَهُ ثُمَّ أَخْرَجَهَا فَقَالَ أَدْخِلْنَ أَيْدِيَكُنَّ فِي هَذَا الْمَاءِ فَهِيَ الْبَيْعَةُ.

Ali ibn Ibrahim has narrated from his father from Ahmad ibn Muhammad from ibn abu Nasr from Aban from Abu ‘Abdillah (a.s.) who said: “When the Messenger of Allah (sw) liberated Makkah, men pledged allegiance; then women came to pledge allegiance; and Allah, most Majestic and most Glorious, said, ‘O Prophet, when believing women come to pledge allegiance with you not to call anything as partner of Allah, not to steal, not to commit fornication, not to kill their children, not to accuse falsely of their own making, must not disobey you in lawful matters, then pledge allegiance with them and ask forgiveness from Allah for them, Allah is forgiving and merciful.’ (60:13) Hind then said, ‘We brought up children from the time they were infants but you killed them when they grew up.’ Umm Hakim daughter of al-Harith ibn Hisham, wife of ‘Ikramah ibn Abu Jahl asked, ‘O Messenger of Allah, what is that ‘lawful matters’ that Allah has commanded us not to disobey you? He replied, ‘Do not slap any face, abrade it, pull out any hair, tear apart front part of a shirt, blacken clothes and do not cry ‘woe is me’.’ The Messenger of Allah (sw) pledged allegiance with them on this and then she said, ‘O Messenger of Allah, how can we pledge allegiance to you?’ He (the Messenger of Allah) said, ‘I do not place my hand in the hands of women.’ He (the Messenger of Allah) then asked for a bowl of water and immersed his hand in it and then moved it and told them to immerse their hands in the bowl and that was pledging allegiance.’”

Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr and Muhammad ibn Isma‘il from al-Fadl ibn Shadhan from Safwan ibn Yahya and ibn abu ‘Umayr from Mu‘awiyah ibn ‘Ammar who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said that you must remain with a valid Wudu’ in the morning. After performing the morning salat (prayer), stay if you like, near the hill, or wherever you like. Praise Allah and thank Him, speak of His bounties and of His trials as much as you can and say, ‘O Allah, grant salawat (favors and compensation to Muhammad and his family worthy of their services to Your cause). This should be of what you may say, ‘O Allah, Lord of al-Mash‘ar al-Haram, set my neck free from hellfire, increase my sustenance of the lawful kind, keep away from me wickedness of sinful Jinn and man. O Allah, You are the best of those who are sought, the best of those before whom appeals are made and the best of those who are asked for help. Every delegate receives a gift. As gifts for me, ignore my mistakes, accept my excuses and forgive my transgressions; thereafter make piety my supplies of this world.’ Then leave as soon as it becomes bright enough to see the footprints of camels.’”
