سَمِعْتُ أَبَا عَبْدِ اللَّهِ ع يَقُولُ‌ إِنَّ مِمَّا أَوْحَى اللَّهُ إِلَى مُوسَى ع وَ أَنْزَلَ عَلَيْهِ فِي التَّوْرَاةِ أَنِّي‌ أَنَا اللَّهُ لا إِلهَ إِلَّا أَنَا خَلَقْتُ الْخَلْقَ وَ خَلَقْتُ الْخَيْرَ وَ أَجْرَيْتُهُ عَلَى يَدَيْ مَنْ أُحِبُّ فَطُوبَى لِمَنْ أَجْرَيْتُهُ عَلَى يَدَيْهِ وَ أَنَا اللَّهُ لا إِلهَ إِلَّا أَنَا خَلَقْتُ الْخَلْقَ وَ خَلَقْتُ الشَّرَّ وَ أَجْرَيْتُهُ عَلَى يَدَيْ مَنْ أُرِيدُهُ فَوَيْلٌ لِمَنْ أَجْرَيْتُهُ عَلَى يَدَيْهِ‌.

A number of our people have narrated from Ahmad ibn Muhammad ibn Khalid from ibn Mahbub and Ali ibn al-Hakam from Mu’awiya ibn Wahab from (Imam) abu ‘Abd Allah (a.s.), who said the following: “I heard (Imam) abu ‘Abd Allah (a.s.), saying, ‘It was of the facts that Allah revealed to Moses and sent down in the Torah, ‘I am Allah, no one deserves to be obeyed and worshipped besides Me. I have created the creatures and created the Good and made it to run through the hands of those whom I love. Fortunate are those through whose hands I have made the Good to continue. I am Allah, no one deserves to be obeyed and worshipped besides Me. I created the creatures and created Evil and made it to run through the hands of whomever I wanted. Unfortunate, therefore, are those through whose hands I have made evil to run.’”

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad ibn ‘Isa from af-Halabiy who has said the following: “Abu ’Abd Allah (a.s.), was asked about a man who dies and there is no one to give him Ghusl (bath) except women. He (the Imam) said that his wife or a relative woman could give him Ghusl (bath). Women just pour water on him. In the case of a woman, her husband gives her Ghusl (bath) by reaching with his hand under her shirt.”’

كَتَبْتُ إِلَى أَبِي عَبْدِ اللَّهِ ع بِمَسَائِلَ بَعْضُهَا مَعَ ابْنِ بُكَيْرٍ وَ بَعْضُهَا مَعَ أَبِي الْعَبَّاسِ فَجَاءَ الْجَوَابُ‌ بِإِمْلَائِهِ سَأَلْتَ عَنْ قَوْلِ اللَّهِ عَزَّ وَ جَلَّ- وَ لِلَّهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنِ اسْتَطاعَ إِلَيْهِ سَبِيلًا يَعْنِي بِهِ الْحَجَّ وَ الْعُمْرَةَ جَمِيعاً لِأَنَّهُمَا مَفْرُوضَانِ وَ سَأَلْتُهُ عَنْ قَوْلِ اللَّهِ عَزَّ وَ جَلَّ- وَ أَتِمُّوا الْحَجَّ وَ الْعُمْرَةَ لِلَّهِ‌ قَالَ يَعْنِي بِتَمَامِهِمَا أَدَاءَهُمَا وَ اتِّقَاءَ مَا يَتَّقِي الْمُحْرِمُ فِيهِمَا وَ سَأَلْتُهُ عَنْ قَوْلِهِ تَعَالَى- الْحَجِّ الْأَكْبَرِ مَا يَعْنِي بِالْحَجِّ الْأَكْبَرِ فَقَالَ الْحَجُّ الْأَكْبَرُ الْوُقُوفُ بِعَرَفَةَ وَ رَمْيُ الْجِمَارِ وَ الْحَجُّ الْأَصْغَرُ الْعُمْرَةُ.

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from ‘Umar ibn ‘Udhaynah who has said the following: “I once wrote to abu ‘ Abd Allah (a.s.), about certain issues (of Fiqh) of which a few were with ibn Bukayr, a few with abu al- ‘Abbas. The answers came with his (the Imam’s) dictation, ‘You have asked about the words of Allah, the Most Majestic, the Most Glorious, “People owe to Allah to perform al-Hajj of the House, whoever is capable to do so,” (3:97) is a reference to al-Hajj and al-‘Umrah. It refers to both of them performed together because they are obligatory.’ You have asked about the words of Allah, the Most Majestic, the Most Glorious, ‘Complete al-Hajj and al-‘Umrah for the sake of Allah. . .’ (2:196) ‘Completing’ means fulfilling this duty during which one must abstain from whatever a person in the state of Ihram abstains.’ I also asked him (the Imam) about the meaning of the words of Allah, the most High, ‘Al-Hajj al-Akbar’. (9:3) He (the Imam) replied it is staying in ‘Arafat, throwing pebbles on al-Jamar and al-Hajj al-Asghar stands for al-‘Umrah.’”

[1]يعني من التمكن فيه و الاستقرار في ظله لئلا يصيبك تعب الركوب و حر الشمس، فأجابه عليه السلام بأن في شهود تلك المواضع التي هي منافع بالحضور بها و المشاهدة لها و النظر إليها فضلا لا يحصل بالتمكن في المحمل و الاستراحة تحت الظل و الغيبة عن البصر و الاختفاء عن النظر.( فى) و قال المجلسيّ- رحمه اللّه-:« أرحت بدنك» أي بترك الحجّ فان ركوب المحمل يشق عليك. و يحتمل أن يكون إشارة إلى ما سيأتي في اول باب طواف المريض أن أبا عبد اللّه عليه السلام كان يطاف به حول الكعبة في محمل و هو شديد المرض و هو مع ذلك يستلم الاركان فقال له الربيع ابن خيثم: جعلت فداك يا ابن رسول اللّه ان هذا يشق عليك فقال: انى سمعت اللّه عزّ و جلّ يقول:« لِيَشْهَدُوا مَنافِعَ لَهُمْ» فقال: منافع الدنيا أو منافع الآخرة؟ فقال: الكلص 264

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Husayn ibn Sa‘id from Fadalah ibn Ayyub from ‘Abd Allah ibn Sinan who has said the following: “I once asked abu ‘Abd Allah (a.s.), about a man if he can look at his wife when she is dying or give her Ghusl (bath) if there is no one for her Ghusl (bath) and if a woman can look at her husband in such a condition. He (the Imam) said, ‘It is not harmful. Only relatives of the woman may not like her husband to look as such that they dislike.’”

Ali ibn Ibrahim has narrated from Muhammad ibn ‘Isa from Yunus from Bakkar from Kardam, from Mufaddal ibn ‘Umar and ‘Abd al-Mu’min al-Ansari from (Imam) abu ‘Abd Allah (a.s.), who has said the following: “Allah, the Most Holy, the Most High, has said, ‘I am Allah. No one deserves to be obeyed and worshipped besides I the Creator of good and evil. Fortunate are those through whose hands I have made good to run and unfortunate are those through whose hands I have made evil to run and unfortunate are those who say, “How is this and how is that?”’ “Yunus has said, ‘It means they are those who deny this fact instead of having proper understanding of it.’”

Ibn abu ‘Umayr has narrated from Mu‘awiyah ibn ‘Ammar who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘Al-’Umrah is obligatory on the creatures as al-Hajj is if they are able to perform; Allah, most High, has said, ‘Complete al-Hajj and al-‘Umrah for the sake of Allah.’ (2:196) Al-’Umrah came in al-Madinah.’ I then asked, ‘Those who benefit (al-Tamattu‘) in al-‘Umrah and al-Hajj’, is that kind sufficient?’ He (the Imam) said, ‘Yes, it is sufficient.’”

A number of our people have narrated from Sahl ibn Ziyad from Musa ibn al-Qasim al-Bajaliy and Muhammad ibn Yahya has narrated from al-‘Amrakiy ibn Ali all from Ali ibn Ja’far from his brother, , who has said the following: “Abu al-Hassan, Musa (a.s.) has said that Allah, most Majestic, most Glorious, made al- Hajj obligatory for people of Jaddah every year because of His words, ‘It is obligatory upon people from Allah to perform al-Hajj who are able to do so. Those who refuse must take notice that Allah is independent of all people.’ (3:96) I then asked him (the Imam); ‘Does one of us for not performing al- Hajj become an unbeliever?’ He (the Imam) said, ‘However, if he says, ‘This is not as such then he becomes one who hides the truth (an unbeliever).”’

A number of our people have narrated from Sahl ibn Ziyad from Ahmad ibn Muhammad from ibn abu Nasr from Dawud ibn Sarhan who has said the following: “About a man who dies on a journey or a strage land and there is no one other than women with him, abu ‘Abd Allah (a.s.), has said, ‘He is buried without Ghusl (bath).’ He (the Imam) said that the same rule applies to woman in such condition unless her husband is among them, in which case he gives her Ghusl (bath) from behind the shield and pours water in a large amount on her body. A wife can give him Ghusl (bath) if he (her husband) dies. Women are different from men. Women are in a worse condition when they die.’”

A number of our people have narrated from Sahl ibn Ziyad from Ali ibn al-Hakam from Sayf ibn ‘ Amirah from Dawud ibn Farqad who has said the following: “I once heard a friend of us ask abu ‘Abd Allah (a.s.), about a woman who dies among men and none of them is of her relatives if they can give her Ghusl (bath) with her clothes on her. He (the Imam) said, ‘Thereby that feeling is apt to get in them, instead they must only wash her both palms (hands).”’

Sahl ibn Ziyad has narrated from ibn Mahbub from ibn Ri’ab from al-Halabiy who has said the following: “About the case of a woman who dies and there is no other woman to give her Ghusl (bath), abu ‘Abd Allah (a.s.), has said, ‘Her husband can reach out with his hand up to his elbow under her shirt to give her Ghusl (bath).”’

He (the Imam) said, ‘Yes, but her relatives may hinder due to intolerance.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ahmad ibn al-Hassan from ‘Amr ibn Sa‘id from Musaddiq ibn Sadaqah from ‘Ammar ibn Musa who has said the following: “Abu ‘Abd Allah (a.s.), was asked about a Muslim man who dies on a journey and there is no other Muslim man with him but there are Christian men with him and his paternal and maternal aunts who are Muslimah how to be given Ghusl (bath) is give to him. He (the Imam) said, ‘His aunts must give him Ghusl (bath) from behind his shirt and Christians must not come close to him.’ It then was asked about a woman who dies on a journey and there are no other Muslim women except Christian women and her paternal and maternal uncles. He (the Imam) said, ‘The uncles may give her Ghusl (bath). Christian women must not come close to her. Only the uncles give her Ghusl (bath) from behind a shield and water is poured from above the shield.’ I then asked about a Muslim man who dies on a journey and there is no other Muslim man or women from his relatives but there are Christian men and none relative Muslim women. He (the Imam) said, ‘Christian men themselves first take Ghusl (bath) to give him (the deceased) Ghusl (bath) because of the need.’ He (the Imam) was asked about the case of a Muslim woman who dies and there are no other Muslim women with her or men of her relatives; but there is a Christian woman and non-relative Muslim men. He (the Imam) said, ‘The Christian woman first herself must take Ghusl (bath) then she gives her (the deceased) Ghusl (bath).’ He (the Imam) was asked about a case where on a journey a Christian man dies among the Muslims. He (the Imam) said, ‘A Muslim cannot give him Ghusl (bath): it is not an honor (befitting) he cannot bury him and cannot stand on his grave.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from ‘Abd al-Rahman ibn Salim from Mufaddal ibn ‘Umar who has said the following: “I once asked abu ‘Abd Allah (a.s.), ‘Who gave Ghusl (bath) to Fatimah, ‘Alayha al- Salam ? He (the Imam) said, ‘That was ’Amir al-Mu’minin (a.s.). It seems as if you find it astonishing to hear such words.’ He (the Imam) said to me, ‘It seems you are strained because of what I told you.’ I said, ‘I pray to Allah to keep my soul in service for your cause, that is true.’ He (the Imam) said to me, ‘You must not be stressed out; she was a truthful one and no one other than a truthful one could give her Ghusl (bath). Consider the case of Maryam (Mary) who was given Ghusl (bath) by no one other than Jesus (a.s.) .’ I then said, ‘I pray to Allah to keep my soul in service for your cause, what do you say about the case of a woman who dies during a journey in the company of men among whom there is no one of her relatives or other woman. What they must do?’ He (the Imam) said, ‘Only those parts of her body are washed which Allah has made obligatory to be used for Tayammum. She is not touched and neither anything of her beauty which Allah, most Majestic, most Glorious, has covered must be exposed.’ I then asked, ‘What they must do?’ He (the Imam) said, ‘Only her palms, face and the backs of her hands are washed.’”
