لَمَّا قُتِلَ جَعْفَرُ بْنُ أَبِي طَالِبٍ ع أَمَرَ رَسُولُ اللَّهِ ص فَاطِمَةَ ع أَنْ تَتَّخِذَ طَعَاماً- لِأَسْمَاءَ بِنْتِ عُمَيْسٍ ثَلَاثَةَ أَيَّامٍ وَ تَأْتِيَهَا وَ نِسَاءَهَا فَتُقِيمَ عِنْدَهَا ثَلَاثَةَ أَيَّامٍ فَجَرَتْ بِذَلِكَ السُّنَّةُ أَنْ يُصْنَعَ لِأَهْلِ الْمُصِيبَةِ طَعَامٌ ثَلَاثاً.

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hafs ibn al-Bakhtariy (and from) Hisham ibn Salim who has said the following: “Abu ’Abd Allah (a.s.), has said that when Ja‘far ibn abu Talib was martyred, the Messenger of Allah instructed Fatimah, ‘Alayha al-Salam, to prepare food for Asma’ bint ‘Umays for three days and visit her with a group of her women everyday for three days. This formed the tradition to prepare food for the people of the deceased for three days.”

سَأَلْتُهُ‌ عَنِ الرَّجُلِ يَدَّهِنُ بِدُهْنٍ فِيهِ طِيبٌ وَ هُوَ يُرِيدُ أَنْ يُحْرِمَ قَالَ لَا تَدَّهِنْ حِينَ تُرِيدُ أَنْ تُحْرِمَ بِدُهْنٍ فِيهِ مِسْكٌ وَ لَا عَنْبَرٌ تَبْقَى رَائِحَتُهُ فِي رَأْسِكَ بَعْدَ مَا تُحْرِمُ وَ ادَّهِنْ بِمَا شِئْتَ مِنَ الدُّهْنِ حِينَ تُرِيدُ أَنْ تُحْرِمَ قَبْلَ الْغُسْلِ وَ بَعْدَهُ فَإِذَا أَحْرَمْتَ فَقَدْ حَرُمَ عَلَيْكَ الدُّهْنُ حَتَّى تُحِلَّ.

1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Husayn ibn Sa‘id from al-Qasim ibn Muhammad from Ali ibn abu Hamzah who has said the following: “I once asked him (the Imam) (a.s.), about a man who uses an oil which is sweet smelling and he wants to assume the state of Ihram. He (the Imam) said, ‘You must not use sweet smelling oil with musk or ‘amber and its smell may remain on your head after you assume the state of Ihram. You can use oil of whatever kind you like before Ghusl (bath) or thereafter, but when you assume the state of Ihram, it then becomes unlawful for you to use oil until you come out of the state of Ihram.”’

إِيَّاكُمْ وَ ذَوَاتِ الْأَزْوَاجِ الْمُطَلَّقَاتِ عَلَى غَيْرِ السُّنَّةِ قَالَ قُلْتُ لَهُ فَرَجُلٌ طَلَّقَ امْرَأَتَهُ مِنْ هَؤُلَاءِ وَ لِي بِهَا حَاجَةٌ قَالَ فَتَلْقَاهُ بَعْدَ مَا طَلَّقَهَا وَ انْقَضَتْ عِدَّتُهَا عِنْدَ صَاحِبِهَا فَتَقُولُ لَهُ طَلَّقْتَ فُلَانَةَ فَإِذَا قَالَ نَعَمْ فَقَدْ صَارَ تَطْلِيقَةً عَلَى طُهْرٍ فَدَعْهَا مِنْ حِينَ طَلَّقَهَا تِلْكَ التَّطْلِيقَةَ حَتَّى تَنْقَضِيَ عِدَّتُهَا ثُمَّ تَزَوَّجْهَا فَقَدْ صَارَتْ تَطْلِيقَةً بَائِنَةً.

Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from ‘Uthman ibn ‘Isa from certain persons of our people who have said the following: “Abu ‘ Abd Allah (a.s.), has said, ‘You must remain on your guard in the case of married women who are divorced against the Sunnah.’ I asked him (the Imam) that a man has divorced his wife and I am interested. He (the Imam) said, ‘Meet him after he divorces her and waiting period is complete with him then ask him, ‘Have you divorced so and so?’ If he said, ‘Yes, I have divorced her’, this is one divorce during a menses free period. From the time he has divorced her until waiting period is complete then you can marry and divorce has made them complete strangers to each other.’”

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘You must not apply any oil which has musk or ambergris; for its perfume remains in your head after Ihram. You can apply oil when you want to assume the state of Ihram, once you are in the state of Ihram; applying becomes unlawful until you come out of the state of Ihram.’”

2. A number of our people have narrated from Ahmad ibn Muhammad ibn ‘Isa from al-Husayn ibn Sa‘id from al-Nadr ibn Suwayd from Muhammad ibn abu Hamzah from Shu’ayb al-Hadad who has said the following: “I once said to abu ‘Abd Allah (a.s.), ‘One of your followers offers greetings of peace to you and he wants to marry a woman who has agreed and he likes her due to certain matters about her and she has a husband who has divorced her three times on non-Sunnah basis. He dislikes marrying her without your instruction so you command him to do so. Abu ‘Abd Allah (a.s.), said, ‘It is an issue of marriage and the matter of marriage is severe because from marriage are children and we maintain precaution, so he must not marry her.’”

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hafs ibn al-Bakhtariy from Ishaq ibn ‘Ammar who has said the following: “About the case of a man who divorces his wife three times and then another man wants to marry her and about what he must do, abu ‘Abd Allah (a.s.), has said, ‘He must wait until she experiences one cycle of menses; then he must go to the man who has divorced her and ask him in the presence of two people, ‘Have you divorced so and so?’ If he said, ‘Yes, I have divorced her, then he must leave her alone for three months, then propose to her for marriage.’”

He considered it as part of the tradition; the Messenger of Allah had said, ‘Prepare food for the family of Ja‘far; they are preoccupied (with the death of Ja‘far).’”

A number of our people have narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Dawud ibn al-Nu’man from abu Ayyub from Muhammad ibn Muslim who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘It is not harmful if a man applies oil before or after taking Ghusl (bath) for Ihram.’ He (the Imam) disliked only thick oil that stays.”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from ‘Abd Allah al-Kahiliy who has said the following: “Once I said to abu al-Hassan (a.s.), ‘My wife and the wife of ibn Marid went to join a memorial service, and I tried to stop them but my wife said, “If it is unlawful then stop us so we desist, but if it is not unlawful then why should you stop us? If one of us will die no one will come to us.”’ Abu al-Hassan (a.s.), then said, ‘You are asking about rights. My father would send my mother and mother of Farwah to meet the terms of the rights of the people of al-Madinah.’”

Ahmad has narrated from Ali ibn al-Hakam from al-Husayn abu al-‘Ala’ who has said the following: “I once asked abu ‘Abd Allah (a.s.), about a man who is in the state of Ihram and applies oil after Ghusl (bath). He (the Imam) said, ‘Yes, it is permissible.’ We applied cassia-bark in his presence and he (the Imam) mentioned that his father would apply oil after Ghusl (bath) for Ihram and he would apply oil as long as it was not costly or mixed with musk or ambergris.’”

Ahmad ibn Muhammad al-Kufiy has narrated from ibn Jumhur from his father from Muhammad ibn Sinan from al-Mufaddal ibn ‘Umar who has said the following: “He has also said that al-Asamm has narrated to us from Hariz from Muhammad ibn Muslim from abu ‘Abd Allah (a.s.), who has said the following: ‘’Amir al-Mu’minin (a.s.), has said, “Instruct your families to speak good words when someone among you dies. When father of Fatimah, ‘Alayha al-Salam, died, daughters of children of Hashim supported her and she said to them, ‘Ignore eulogies but you must pray (to Allah).”””

Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan from ‘Abd Allah ibn Muskan from Ali ibn ‘Abd al-‘Aziz who has said the following: “Abu ‘Abd Allah (a.s.), once took Ghusl (bath) for Ihram, then entered Masjid al-Shajarah and performed Salat (prayer), then came out to the servants and said, ‘Bring us of the meat from hunting so we can eat.’”

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Ibn Abi ‘Umayr from Jamil ibn Darraj from certain persons of our people who have said the following: “I once asked one of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhim al-Salam, about a man who performs al-Zuhr in Masjid al-Shajarah, assumes the state of Ihram, then touches perfumes, or a prey or involves in sexual relation. He (the Imam) said, ‘There is nothing on him because of such things before his saying Talbiyah.’”

[5]يدل على ما هو المقطوع به في كلام الاصحاب من أنّه إذا عقد نية الاحرام و لبس ثوبيه ثمّ لم يلب و فعل ما لا يحل للمحرم فعله لم يلزمه بذلك كفّارة إذا كان متمتعا أو مفردا و كذا لو كان قارنا لم يشعر و لم يقلد و نقل السيّد المرتضى- رحمه اللّه- في الانتصار اجماع الفرق فيه و ربما ظهر من الروايات انه لا يجب استيناف نية الاحرام بعد ذلك بل يكفى الإتيان بالتلبية و على هذا فيكون المنوى عند عقد الاحرام اجتناب ما يجب على المحرم اجتنابه من حين التلبية و صرّح المرتضى في الانتصار بوجوب استيناف النية قبل التلبية و الحال هذه و هو الأحوط.( آت)ص 330

He (the Imam) (a.s.), wrote the answer, ‘Yes,’ or that he (the Imam) said, ‘It is not harmful.’”
