بَابُ مَا يَجِبُ بِهِ التَّعْزِيرُ وَ الْحَدُّ وَ الرَّجْمُ وَ الْقَتْلُ وَ النَّفْيُ فِي الزِّنَا

وَ فِي رِوَايَةِ السَّكُونِيِّ أَنَّهُ رُفِعَ إِلَى عَلِيٍّ ع‌ رَجُلٌ وَقَعَ عَلَى امْرَأَةِ أَبِيهِ فَرَجَمَهُ وَ كَانَ غَيْرَ مُحْصَنٍ‌.

Hadith.5045 - In the narration of Al-Sakuni, it was reported to Imam Ali ibn Abi Talib (as) that a man had committed fornication with his father's wife, so Imam (as) ordered him to be stoned, even though he was not married (non-muhṣan).

Hadith.5046 - In the narration reported by Al-Hasan ibn Mahbub from Ali ibn Riʾab from Abu Ubaydah from Abu Jafar (as), regarding a man upon whom a legal punishment (hadd) was due but he was not punished until he became mentally disturbed. Imam (as) said: "If he had confessed to the hadd upon himself while he was sound in mind and free from any mental illness, then the hadd must be carried out on him regardless of his current state."

قُلْتُ لَهُ رَجُلٌ أَتَى رَجُلًا قَالَ إِنْ كَانَ مُحْصَناً فَعَلَيْهِ الْقَتْلُ وَ إِنْ لَمْ يَكُنْ مُحْصَناً فَعَلَيْهِ الْحَدُّ قُلْتُ فَمَا عَلَى الْمُؤْتَى بِهِ قَالَ عَلَيْهِ الْقَتْلُ عَلَى كُلِّ حَالٍ مُحْصَناً كَانَ أَوْ غَيْرَ مُحْصَنٍ‌.

Hadith.5047 - In the narration reported by Hammad ibn Uthman from Abu Abdullah (as), he said: I asked Imam (as) about a man who approached another man (committing sodomy). Imam (as) replied: "If the perpetrator was married (muhṣan), then his punishment is execution, and if he was not married, then the legal punishment (hadd) applies to him." I then asked: "What about the one who was approached?" Imam (as) replied: "He must be executed in all cases, whether he was married or unmarried."

Hadith.5048 - In the narration of Hisham and Hafṣ ibn Al-Bukhturi, it is reported that a group of women entered upon Abu Abdullah (as), and one of the women asked him about lesbianism (Al-sahaq). Imam (as) replied: "Its punishment is the same as that of the adulterer (Al-zani)." A woman then said: "But Allah (swt) has not mentioned that in the Qur'an." Imam (as) replied: "Indeed, He (swt) has." She asked: "Where is it mentioned?" Imam (as) said: "They are the people of Al-Rass (Ashab Al-Rass)."
