[١]رواه الشيخ في التهذيب و يدلّ على القطع في الثمرة و يحمل على ما كان محرزا و على القطع في درهمين و الغالب كونهما خمس الدينار.( م ت).
[٢]روى الشيخ في التهذيب، في الصحيح عن الفضيل عن أبي عبد اللّه عليه السلام قال: « إذا أقرّ العبد على نفسه بالسّرقة لم يقطع و إذا شهد عليه شاهدان قطع» ثم روى هذا الخبر، و قال: الوجه فيه أن نحمله على أنّه إذا نضاف الى الإقرار البيّنة، فأما بمجرّد الإقرار فلا قطع عليه حسب ما تضمّنه الخبر الأوّل.
[٣]أي بعد العلم بالتحريم أو بعد ظهور التحريم على آكل الرّبا.

Hadith.5128 - Ishaq ibn Ammar narrated from Abu Abdullah (as) regarding a man who stole a cluster of dates from an orchard worth two dirhams. Imam (as) said: "His hand is to be cut off for that."

الْعَبْدُ إِذَا أَقَرَّ عَلَى نَفْسِهِ عِنْدَ الْإِمَامِ مَرَّةً أَنَّهُ سَرَقَ قَطَعَهُ وَ الْأَمَةُ إِذَا أَقَرَّتْ عَلَى نَفْسِهَا عِنْدَ الْإِمَامِ بِالسَّرِقَةِ قَطَعَهَا.
Hadith.5129 - Ali ibn Ri'ab narrated from Ḍurays Al-Kunasi from Abu Jafar Imam Muhammad ibn Ali Al-Baqir (as) who said: "If a male slave confesses to theft once before the Imam, his hand is to be cut off. Likewise, if a female slave confesses to theft before the Imam, her hand is to be cut off."

Hadith.5130 - Al-Hasan ibn Mahbub narrated from Abu Ayyub from Al-Fudayl ibn Yasar who said: I heard Abu Abdullah (as) say: "If a slave confesses to theft, his hand is not to be cut off. However, if two witnesses testify against him, his hand is to be cut off."

سُئِلَ أَحَدُهُمَا ع عَنْ حَدِّ الْأَخْرَسِ وَ الْأَصَمِّ وَ الْأَعْمَى قَالَ عَلَيْهِمُ الْحُدُودُ إِذَا كَانُوا يَعْقِلُونَ مَا يَأْتُونَ.
Hadith.5131 - Yunus narrated from Ishaq ibn Ammar who said that one of the two Imams (peace be upon them) was asked about the legal punishments (hudud) for a mute, a deaf person, and a blind person. Imam (as) said: "The legal punishments apply to them if they comprehend what they are doing."

رَوَى إِسْحَاقُ بْنُ عَمَّارٍ وَ سَمَاعَةُ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ:
Hadith.5132 - Ishaq ibn Ammar and Samaah narrated from Abu Basir from Abu Abdullah (as) who said: I asked Imam - "What is the punishment for one who consumes usury after clear evidence (has been established)?" Imam (as) replied: "He is to be disciplined. If he returns to it, he is disciplined again. If he repeats it a third time, he is to be killed."
