Chapter on the Legal Punishment for Theft

لَا يَزَالُ الْعَبْدُ يَسْرِقُ حَتَّى إِذَا اسْتَوْفَى دِيَةَ يَدِهِ أَظْهَرَهُ اللَّهُ عَزَّ وَ جَلَّ عَلَيْهِ‌[3].

Hadith.5098 - It is narrated from Abu Al-Hasan Imam Ali ibn Musa Ar-Ridha (as) that he said: "A servant continues to steal until, when the value of what he has stolen equals the blood money for his hand, Allah (swt), the Mighty and Majestic, exposes him."

لَا يُقْطَعُ السَّارِقُ حَتَّى يُقِرَّ بِالسَّرِقَةِ مَرَّتَيْنِ فَإِنْ رَجَعَ‌[5] ضَمِنَ السَّرِقَةَ وَ لَمْ يُقْطَعْ إِذَا لَمْ يَكُنْ لَهُ شُهُودٌ[6].

Hadith.5103 - It is narrated from one of the two Imams (as) that Imam (as) said: "The hand of a thief is not to be cut off until he confesses to the theft twice. If he retracts his confession, he must compensate for what he stole, but his hand will not be cut off if there are no witnesses against him."

سَأَلْتُهُ عَنِ الصَّبِيِّ يَسْرِقُ قَالَ إِنْ كَانَ لَهُ سَبْعُ سِنِينَ أَوْ أَقَلُّ رُفِعَ عَنْهُ فَإِنْ عَادَ بَعْدَ السَّبْعِ قُطِعَتْ بَنَانُهُ أَوْ حُكَّتْ حَتَّى تَدْمَى فَإِنْ عَادَ قُطِعَ مِنْهُ أَسْفَلُ مِنْ بَنَانِهِ فَإِنْ عَادَ بَعْدَ ذَلِكَ وَ قَدْ بَلَغَ تِسْعَ سِنِينَ قُطِعَتْ يَدُهُ وَ لَا يُضَيَّعُ حَدٌّ مِنْ حُدُودِ اللَّهِ عَزَّ وَ جَلَ‌[2].

Hadith.5106 - A man came to Commander of the Faithful (as) and confessed to theft. Commander of the Faithful (as) asked him: "Do you recite anything from the Book of Allah (swt), the Mighty and Majestic?" The man replied: "Yes, Surah Al-Baqarah." Imam (as) said: "I have pardoned your hand for the sake of Surah Al-Baqar

وَ فِي رِوَايَةِ السَّكُونِيِّ قَالَ قَالَ رَسُولُ اللَّهِ ص‌ لَا قَطْعَ فِي ثَمَرٍ وَ لَا كَثَرٍ وَ الْكَثَرُ هُوَ الْجُمَّارُ[4].

Hadith.5107 - In the narration of Al-Sakuni, the Messenger of Allah (swt) (peace be upon him and his family) said: "There is no cutting (of the hand) for stealing fruit or kathar." And kathar refers to the inner core of palm trees (Al-jummar).

"Commander of the Faithful (as) ruled in the case of a group of people who slaughtered a camel and ate it. They were investigated to determine who among them had slaughtered it, and they all testified against themselves that they had collectively slaughtered it without specifying any individual over another. قُلْتُ لَهُ رَجُلٌ سَرَقَ مِنَ الْمَغْنَمِ الشَّيْ‌ءَ الَّذِي يَجِبُ عَلَيْهِ الْقَطْعُ قَالَ يُنْظَرُ كَمِ الَّذِي يُصِيبُهُ فَإِنْ كَانَ الَّذِي أَخَذَ أَقَلَّ مِنْ نَصِيبِهِ عُزِّرَ وَ دُفِعَ إِلَيْهِ تَمَامُ مَالِهِ وَ إِنْ كَانَ أَخَذَ مِثْلَ الَّذِي لَهُ فَلَا شَيْ‌ءَ عَلَيْهِ‌[2] وَ إِنْ كَانَ أَخَذَ فَضْلًا بِقَدْرِ ثَمَنِ مِجَنٍّ وَ هُوَ رُبُعُ دِينَارٍ قُطِعَ‌[3].

سَأَلْتُهُ عَنْ رَجُلٍ اكْتَرَى حِمَاراً وَ أَقْبَلَ إِلَى أَصْحَابِ الثِّيَابِ فَابْتَاعَ مِنْهُمْ ثَوْباً وَ تَرَكَ الْحِمَارَ عِنْدَهُمْ‌[4] قَالَ يُرَدُّ الْحِمَارُ عَلَى أَصْحَابِهِ وَ يُتْبَعُ الَّذِي ذَهَبَ بِالثَّوْبِ وَ لَيْسَ عَلَيْهِ قَطْعٌ إِنَّمَا هِيَ خِيَانَةٌ.

I asked Imam (as) about a man who rented a donkey and went to cloth merchants, bought a garment from them, and left the donkey with them. إِذَا أُقِيمَ عَلَى السَّارِقِ الْحَدُّ نُفِيَ إِلَى بَلْدَةٍ أُخْرَى‌[1] وَ إِنْ سَرَقَ رَجُلٌ فَلَمْ يُقْدَرْ عَلَيْهِ حَتَّى سَرَقَ مَرَّةً أُخْرَى فَأُخِذَ فَجَاءَتِ الْبَيِّنَةُ فَشَهِدُوا عَلَيْهِ بِالسَّرِقَةِ الْأُولَى وَ الْأَخِيرَةِ فَإِنَّهُ تُقْطَعُ يَدُهُ بِالسَّرِقَةِ الْأُولَى وَ لَا تُقْطَعُ رِجْلُهُ بِالسَّرِقَةِ الْأَخِيرَةِ لِأَنَّ الشُّهُودَ شَهِدُوا عَلَيْهِ جَمِيعاً فِي مَقَامٍ وَاحِدٍ بِالسَّرِ

Hadith.5117 - Imam Ali ibn Abi Talib (as) said: "There is no cutting (of the hand) for open and public theft, which is snatching (Al-khulsah), but I would discipline him (ta'zir). وَ رُوِيَ‌ أَنَّ عَلِيّاً ع قَطَعَ نَبَّاشَ الْقَبْرِ فَقِيلَ لَهُ أَ تَقْطَعُ فِي الْمَوْتَى فَقَالَ إِنَّا لَنَقْطَعُ لِأَمْوَاتِنَا كَمَا نَقْطَعُ لِأَحْيَائِنَا[3].

Hadith.5119 - It has been narrated that Imam Ali ibn Abi Talib (as) ordered the hand of a grave robber to be cut off. Imam (as) was asked: "Do you cut off (the hand) for stealing from the dead?" Imam (as) replied: "We cut for our dead just as we cut for our living."

وَ رُوِيَ: "أَنَّ أَمِيرَ اَلْمُؤْمِنِينَ عَلَيْهِ اَلسَّلاَمُ أُتِيَ بِنَبَّاشٍ فَأَخَذَ بِشَعْرِهِ وَ جَلَدَ بِهِ اَلْأَرْضَ ثُمَّ قَالَ "طَئُوا عَلَيْهِ عِبَادَ اَللَّهِ" فَوُطِئَ حَتَّى مَاتَ".

Hadith.5120 - It has been narrated that Commander of the Faithful (as) was presented with a grave robber. Imam (as) grabbed him by his hair, struck him against the ground, and then said: "Step on him, O' servants of Allah (swt)." So, the people trampled him until he died.

Then on the fourth day, Imam (as) took him down, prayed over him, and buried him."

سَمِعْتُ أَبَا عَبْدِ اللَّهِ ع يَقُولُ‌ إِذَا أَقَرَّ الْمَمْلُوكُ عَلَى نَفْسِهِ بِالسَّرِقَةِ لَمْ يُقْطَعْ وَ إِنْ شَهِدَ عَلَيْهِ شَاهِدَانِ قُطِعَ.
