سَأَلَهُ بَعْضُ آلِ زُرَارَةَ عَنْ رَجُلٍ قَطَعَ لِسَانَ رَجُلٍ أَخْرَسَ فَقَالَ إِنْ كَانَ وَلَدَتْهُ أُمُّهُ وَ هُوَ أَخْرَسُ فَعَلَيْهِ الدِّيَةُ[4] وَ إِنْ كَانَ لِسَانُهُ ذَهَبَ بِوَجَعٍ أَوْ آفَةٍ بَعْدَ مَا كَانَ يَتَكَلَّمُ فَإِنَّ عَلَى الَّذِي قَطَعَ ثُلُثَ دِيَةِ لِسَانِهِ.
