Chapter on the Legal Punishment for Drinking Alcohol and Reports Regarding Singing and Amusements

لَوْ أَنَّ رَجُلًا دَخَلَ فِي الْإِسْلَامِ فَأَقَرَّ بِهِ ثُمَّ شَرِبَ الْخَمْرَ وَ زَنَى وَ أَكَلَ الرِّبَا وَ لَمْ يَتَبَيَّنْ لَهُ شَيْ‌ءٌ مِنَ الْحَلَالِ وَ الْحَرَامِ لَمْ أُقِمْ عَلَيْهِ الْحَدَّ إِذَا كَانَ جَاهِلًا إِلَّا أَنْ تَقُومَ عَلَيْهِ الْبَيِّنَةُ أَنَّهُ قَرَأَ السُّورَةَ الَّتِي فِيهَا الزِّنَا وَ الْخَمْرُ وَ أَكْلُ الرِّبَا وَ إِذَا جَهِلَ ذَلِكَ أَعْلَمْتُهُ وَ أَخْبَرْتُهُ فَإِنْ رَكِبَهُ بَعْد

"If a man entered Islam, acknowledged it, and then drank alcohol, committed adultery, and consumed usury, without having any knowledge of what is lawful and unlawful, I would not administer the legal punishment upon him if he was ignorant - unless there was evidence that he had recited the Surah in which adultery, alco

يَا أَمِيرَ اَلْمُؤْمِنِينَ ضَرَبْتَنِي ثَمَانِينَ سَوْطاً فِي شُرْبِ اَلْخَمْرِ فَهَذِهِ اَلْعِشْرُونَ مَا هِيَ فَقَالَ "هَذَا لِجُرْأَتِكَ عَلَى شُرْبِ اَلْخَمْرِ فِي شَهْرِ رَمَضَانَ ".

Hadith.5089 - In the narration of Amr ibn Shimr from Jabir, who attributed it to the Prophet: Commander of the Faithful (as) was presented with Al-Najashi Al-Harithiyy, the poet, who had consumed alcohol during the month of Ramadan. لَا تُجَالِسُوا شُرَّابَ الْخَمْرِ فَإِنَّ اللَّعْنَةَ إِذَا نَزَلَتْ عَمَّتْ مَنْ فِي الْمَجْلِسِ. وَ لَا تَجُوزُ الصَّلَاةُ فِي بَيْتٍ فِيهِ خَمْرٌ مَحْصُورٌ فِي آنِيَةٍ وَ لَا بَأْسَ بِالصَّلَاةِ فِي ثَوْبٍ أَصَابَتْهُ خَمْرٌ لِأَنَّ اللَّهَ عَزَّ وَ جَلَّ حَرَّمَ شُرْبَهَا وَ لَمْ يُحَرِّمِ الصَّلَاةَ فِي ثَوْبٍ أَصَابَتْهُ[6]

Hadith.5090 - Imam Jafar ibn Muhammad Al-Sadiq (as) said: "Do not sit with those who drink wine, for when the curse descends, it encompasses everyone present in the gathering."

وَ قَالَ الصَّادِقُ ع‌[1] شَارِبُ الْخَمْرِ إِنْ مَرِضَ فَلَا تَعُودُوهُ وَ إِنْ مَاتَ فَلَا تَشْهَدُوهُ وَ إِنْ شَهِدَ فَلَا تُزَكُّوهُ‌[2] وَ إِنْ خَطَبَ إِلَيْكُمْ فَلَا تُزَوِّجُوهُ فَإِنَّ مَنْ زَوَّجَ ابْنَتَهُ شَارِبَ الْخَمْرِ فَكَأَنَّمَا قَادَهَا إِلَى الزِّنَا وَ مَنْ زَوَّجَ ابْنَتَهُ مُخَالِفاً لَهُ عَلَى دِينِهِ فَقَدْ قَطَعَ رَحِمَهَا[3] وَ مَنِ ائْتَمَنَ شَارِبَ الْخَمْرِ لَمْ يَكُنْ لَهُ عَلَى اللَّه

Hadith.5091 - Imam Jafar ibn Muhammad Al-Sadiq (as) said: "If a wine drinker falls ill, do not visit him; if he dies, do not attend his funeral; if he testifies, do not accept his testimony; and if he seeks marriage from you, do not marry him off. خَمْسَةٌ مِنْ خَمْسَةٍ مُحَالٌ الْحُرْمَةُ مِنَ الْفَاسِقِ مُحَالٌ وَ الشَّفَقَةُ مِنَ الْعَدُوِّ مُحَالٌ وَ النَّصِيحَةُ مِنَ الْحَاسِدِ مُحَالٌ وَ الْوَفَاءُ مِنَ الْمَرْأَةِ مُحَالٌ وَ الْهَيْبَةُ مِنَ الْفَقِيرِ مُحَالٌ[4]. وَ الْغِنَاءُ مِمَّا أَوْعَدَ اللَّهُ عَزَّ وَ جَلَّ عَلَيْهِ النَّارَ وَ هُوَ قَوْلُهُ عَزَّ وَ جَلَ وَ مِنَ النَّاسِ مَنْ يَشْتَرِي لَهْوَ الْحَدِيثِ لِيُضِلَّ عَنْ سَبِيلِ اللَّهِ بِغَيْرِ

Hadith.5092 - Imam Jafar ibn Muhammad Al-Sadiq (as) said: "Five things from five are impossible: Honor from a transgressor is impossible, compassion from an enemy is impossible, sincere advice from a jealous person is impossible, loyalty from a woman is impossible, and awe from a poor person is impossible."

الرِّجْسُ مِنَ الْأَوْثَانِ الشِّطْرَنْجُ وَ قَوْلُ الزُّورِ الْغِنَاءُ[6] وَ النَّرْدُ أَشَدُّ مِنَ الشِّطْرَنْجِ فَأَمَّا الشِّطْرَنْجُ فَإِنَّ اتِّخَاذَهَا كُفْرٌ وَ اللَّعِبَ بِهَا شِرْكٌ‌[1] وَ تَعْلِيمَهَا كَبِيرَةٌ مُوبِقَةٌ[2] وَ السَّلَامَ عَلَى اللَّاهِي بِهَا مَعْصِيَةٌ وَ مُقَلِّبَهَا كَمُقَلِّبِ لَحْمِ الْخِنْزِيرِ[3] وَ النَّاظِرَ إِلَيْهَا كَالنَّاظِرِ إِلَى فَرْجِ أُمِّهِ‌[4] وَ اللَّاعِبَ بِالنَّرْدِ

Hadith.5093 - Imam Jafar ibn Muhammad Al-Sadiq (as) was asked about the saying of Allah (swt), the Mighty and Majestic: "So avoid the filth of idols and avoid false speech." (Surah Al-Hajj 22:30) Imam (as) said: "The filth of idols refers to chess, and false speech refers to singing. And backgammon (nard) is worse than

إِنَّ الْمَلَائِكَةَ لَتَنْفِرُ عِنْدَ الرِّهَانِ وَ تَلْعَنُ صَاحِبَهُ مَا خَلَا الْحَافِرَ وَ الْخُفَّ وَ الرِّيشَ وَ النَّصْلَ وَ قَدْ سَابَقَ رَسُولُ اللَّهِ ص أُسَامَةَ بْنَ زَيْدٍ وَ أَجْرَى الْخَيْلَ[10]

Hadith.5094 - Imam Jafar ibn Muhammad Al-Sadiq (as) said: "Indeed, the angels withdraw from gatherings where gambling occurs and curse the one involved in it, except in the case of betting on hoofed animals, animals with padded feet, feathered birds, and arrows. فَرُوِيَ‌ أَنَّ نَاقَةَ النَّبِيِّ ص سُبِقَتْ فَقَالَ ع إِنَّهَا بَغَتْ وَ قَالَتْ فَوْقِي رَسُولُ اللَّهِ ص وَ حَقٌّ عَلَى اللَّهِ عَزَّ وَ جَلَّ أَنْ لَا يَبْغِيَ شَيْ‌ءٌ عَلَى شَيْ‌ءٍ إِلَّا أَذَلَّهُ اللَّهُ- وَ لَوْ أَنَّ جَبَلًا بَغَى عَلَى جَبَلٍ لَهَدَّ اللَّهُ الْبَاغِيَ مِنْهُمَا.

Hadith.5095 - It has been narrated that the she-camel of the Prophet (peace be upon him and his family), was outrun in a race. So Prophet (sw), peace be upon him and his family, said: "It (camel) transgressed and said to itself, 'Upon me is the Messenger of Allah (swt), peace and blessings be upon him and his family.'

وَ نَهَى رَسُولُ اللَّهِ ص عَنْ تَحْرِيشِ الْبَهَائِمِ مَا خَلَا الْكِلَابَ‌[1].

Hadith.5096 - The Messenger of Allah (swt) (peace be upon him and his family) forbade inciting animals against one another, except in the case of dogs.

"مَا عَلَيْكَ لَوِ اِشْتَرَيْتَهَا فَذَكَّرَتْكَ اَلْجَنَّةَ ".

Hadith.5097 - A man asked Imam Ali ibn Al-Hussain (as) about purchasing a bondwoman with a beautiful voice. Imam (as) said: "There is no harm upon you if you buy her and she reminds you of Paradise."
