Chapter on the Legal Punishment for Slanderous Accusation

يُجْلَدُ قُلْتُ أَ رَأَيْتَ إِنْ عَفَتْ عَنْهُ قَالَ لَا وَ لَا كَرَامَةَ[3].

Hadith.5063 - Al-Alaa narrated from Muhammad ibn Muslim from Abu Jafar Imam Muhammad ibn Ali Al-Baqir (as) regarding a man who accuses his wife (of adultery). Imam (as) said: "He is to be flogged." I asked: "What if she pardons him?" Imam (as) said: "No, and no honor (for him)."

سُئِلَ أَبُو عَبْدِ اللَّهِ ع عَنْ نَصْرَانِيٍّ قَذَفَ مُسْلِماً فَقَالَ لَهُ يَا زَانِ قَالَ يُجْلَدُ ثَمَانِينَ جَلْدَةً لِحَقِّ الْمُسْلِمِ وَ ثَمَانِينَ جَلْدَةً إِلَّا سَوْطاً لِحُرْمَةِ الْإِسْلَامِ وَ يُحْلَقُ رَأْسُهُ وَ يُطَافُ بِهِ فِي أَهْلِ دِينِهِ لِكَيْ يُنَكَّلَ غَيْرُهُ‌[3].

سَأَلْتُهُ عَنْ رَجُلٍ يَفْتَرِي عَلَى رَجُلٍ مِنْ جَاهِلِيَّةِ الْعَرَبِ قَالَ يُضْرَبُ حَدّاً قُلْتُ يُضْرَبُ حَدّاً قَالَ نَعَمْ إِنَّ ذَلِكَ يَدْخُلُ عَلَى رَسُولِ اللَّهِ ص‌[4].

I asked Imam (as) about a man who slanders a man from the pre-Islamic Arabs. Imam (as) said: "He is to be given the legal punishment." I asked: "Is he to be given the legal punishment?" He said: "Yes, because that offense reaches the Messenger of Allah (swt) (peace be upon him and his family)."

سَأَلْتُهُ عَنْ رَجُلٍ قَالَ لِامْرَأَتِهِ يَا زَانِيَةُ قَالَ يُجْلَدُ حَدّاً وَ يُفَرَّقُ بَيْنَهُمَا بَعْدَ مَا جُلِدَ وَ لَا تَكُونُ امْرَأَتَهُ قَالَ وَ إِنْ كَانَ قَالَ كَلَاماً أَفْلَتَ مِنْهُ فِي غَيْرِ أَنْ يَعْلَمَ شَيْئاً أَرَادَ أَنْ يَغِيظَهَا بِهِ فَلَا يُفَرَّقُ بَيْنَهُمَا.

سُئِلَ أَبُو عَبْدِ اللَّهِ ع عَنْ رَجُلٍ قَذَفَ امْرَأَتَهُ بِالزِّنَا وَ هِيَ خَرْسَاءُ صَمَّاءُ لَا تَسْمَعُ مَا قَالَ فَقَالَ إِنْ كَانَ لَهَا بَيِّنَةٌ يَشْهَدُونَ لَهَا عِنْدَ الْإِمَامِ جَلَدَهُ الْحَدَّ وَ فَرَّقَ بَيْنَهُمَا ثُمَّ لَا تَحِلُّ لَهُ‌ أَبَداً وَ إِنْ لَمْ يَكُنْ لَهَا بَيِّنَةٌ فَهِيَ حَرَامٌ عَلَيْهِ مَا أَقَامَ مَعَهَا وَ لَا إِثْمَ عَلَيْهَا مِنْهُ‌[1].

Hadith.5074 - In the narration of Al-Sakuni, Imam Ali ibn Abi Talib (as) said: "Whoever acknowledges a child and then denies him is to be given the legal punishment and held responsible for the child."

سَمِعْتُ أَبَا عَبْدِ اللَّهِ ع يَقُولُ‌ لَوْ أُتِيتُ بِرَجُلٍ قَدْ قَذَفَ عَبْداً مُسْلِماً بِالزِّنَا لَا نَعْلَمُ مِنْهُ إِلَّا خَيْراً لَضَرَبْتُهُ الْحَدَّ حَدَّ الْحُرِّ إِلَّا سَوْطاً.

سُئِلَ عَلِيٌّ ع‌[7] عَنْ مُكَاتَبٍ افْتَرَى عَلَى رَجُلٍ مُسْلِمٍ- فَقَالَ يُضْرَبُ حَدَّ الْحُرِّ ثَمَانِينَ جَلْدَةً أَدَّى مِنْ مُكَاتَبَتِهِ شَيْئاً أَوْ لَمْ يُؤَدِّ قِيلَ لَهُ فَإِنْ زَنَى وَ هُوَ مُكَاتَبٌ وَ لَمْ يُؤَدِّ مِنْ مُكَاتَبَتِهِ شَيْئاً قَالَ هَذَا حَقُّ اللَّهِ عَزَّ وَ جَلَّ يُطْرَحُ عَنْهُ خَمْسُونَ جَلْدَةً وَ يُضْرَبُ خَمْسِينَ.
