بَابُ حَدِّ الْمَرْأَةِ الَّتِي لَهَا زَوْجٌ فَتَزَوَّجُ أَوْ تَتَزَوَّجُ وَ هِيَ فِي عِدَّتِهَا وَ الرَّجُلِ الَّذِي يَتَزَوَّجُ ذَاتَ زَوْجٍ‌

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ عَنْ‌ أَبِي عَبْدِ اللَّهِ ع

‌ أَنَّ عَلِيّاً ع ضَرَبَ رَجُلًا تَزَوَّجَ امْرَأَةً فِي نِفَاسِهَا قَبْلَ أَنْ تَطْهُرَ الْحَدَّ^[1]

English translationHubeAli

Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad, from Al Halby, (It has been narrated) from Abu Abdullah asws that Ali asws struck a man with the Penalty ( Hadd ), who married a woman during her menses, before she had purified’.

^[١]قال الشيخ في التهذيب: كان أبو جعفر محمّد بن بابويه- رحمه اللّه- يقول في هذا الحديث انه انما ضربه الحدّ لانه كان وطئها لانه لو لم يكن وطئها لما وجب عليها الحدّ لأنّها خرجت من العدة بوضعها ما في بطنها و هذا الذي ذكره- رحمه اللّه- يحتمل إذا كانت المرأة مطلقة فاما إذا قدرنا انها كانت متوفى عنها زوجها فوضعها الحمل لا يخرجها عن العدة بل تحتاج أن تستوفى العدة أربعة أشهر و عشرة أيّام فأمير المؤمنين عليه السلام انما ضربه لأنّها لم يخرج بعد من العدة التي هى عدة المتوفى عنها زوجها و الوجهان جميعا محتملان.( آت)

^[٢]يمكن حمله على أن ذكر الربع على سبيل التمثيل بقرينة مقابلته بعدم أداء شي‌ء.( آت)

قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع قَوْمٌ اشْتَرَكُوا فِي شِرَاءِ جَارِيَةٍ فَائْتَمَنُوا بَعْضَهُمْ وَ جَعَلُوا الْجَارِيَةَ عِنْدَهُ فَوَطِئَهَا قَالَ يُجْلَدُ الْحَدَّ وَ يُدْرَأُ عَنْهُ مِنَ الْحَدِّ بِقَدْرِ مَا لَهُ فِيهَا وَ تُقَوَّمُ الْجَارِيَةُ وَ يُغَرَّمُ ثَمَنَهَا لِلشُّرَكَاءِ فَإِنْ كَانَتِ الْقِيمَةُ فِي الْيَوْمِ الَّذِي وَطِئَهَا أَقَلَّ مِمَّا اشْتُرِيَتْ بِهِ فَإِنَّهُ يُلْزَمُ أَكْثَرَ الثَّمَنِ لِأَنَّهُ قَدْ أَفْسَدَ عَلَى شُرَكَائِهِ وَ إِنْ كَانَتِ الْقِيمَةُ فِي الْيَوْمِ الَّذِي وَطِئَ أَكْثَرَ مِمَّا اشْتُرِيَتْ بِهِ يُلْزَمُ الْأَكْثَرَ لِاسْتِفْسَادِهَا.

English translationHubeAli

Ali Bin Ibrahim, from Salih Bin Saeed, from Yunus, from Abdullah Bin Sinan who said, ‘I said to Abu Abdullah asws , ‘A group participated in buying a slave girl, so they relied upon one of them, and made the slave girl to be with him, so he went to her’. He asws said: ‘He would be whipped the Penalty ( Hadd ) and it would be staved off by the measurement of whatever (share) was for him in her, and the slave girl would be evaluated, and her price would be for the associates. So if her price during the day she had been copulated with is less than what she was bought for, so the excess of the price would be necessitated upon him, because he had spoilt upon his associates; and if it was that the price during the day which she had been copulated with is more than what she had been bought for, the excess would be necessitated for having spoilt her’.

سُئِلَ عَنْ رَجُلٍ أَصَابَ جَارِيَةً مِنَ الْفَيْ‌ءِ فَوَطِئَهَا قَبْلَ أَنْ تُقْسَمَ قَالَ تُقَوَّمُ الْجَارِيَةُ وَ تُدْفَعُ إِلَيْهِ بِالْقِيمَةِ وَ يُحَطُّ لَهُ مِنْهَا مَا يُصِيبُهُ مِنْهَا مِنَ الْفَيْ‌ءِ وَ يُجْلَدُ الْحَدَّ وَ يُدْرَأُ عَنْهُ مِنَ الْحَدِّ بِقَدْرِ مَا كَانَ لَهُ فِيهَا فَقُلْتُ وَ كَيْفَ صَارَتِ الْجَارِيَةُ تُدْفَعُ إِلَيْهِ هُوَ بِالْقِيمَةِ دُونَ غَيْرِهِ قَالَ لِأَنَّهُ وَطِئَهَا وَ لَا يُؤْمَنُ أَنْ يَكُونَ ثَمَّ حَبَلٌ.

English translationHubeAli

Ali Bin Ibrahim, from his father, from Amro Bin Usman, from a number of our companions, Abu Abdullah asws , said when He asws was asked about a man who got a slave girl from Al-Fey (war booty). So he copulated with her before the distribution’. He asws said: ‘The slave girl would be evaluated and she would be handed over to him by the price, and reduced for him from her what his share was from the war booty, and he would be whipped the Penalty ( Hadd ), and it would be staved off from him from the Penalty ( Hadd ), by the measurement of what (share) was for him with regards to her’. So I said, ‘And how come the slave girl would be handed over to him, and he is with the price, besides the others?’ He asws said: ‘Because he has copulated with her, and there is no safety that she might happen to be pregnant’.
