بَابُ الرَّجُلِ يُرِيدُ أَنْ يَذْبَحَ فَيَسْبِقُهُ السِّكِّينُ فَيَقْطَعُ الرَّأْسَ‌

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ عُمَرَ بْنِ أُذَيْنَةَ عَنِ الْفُضَيْلِ بْنِ يَسَارٍ قَالَ:

سَأَلْتُ أَبَا جَعْفَرٍ ع عَنْ رَجُلٍ ذَبَحَ فَسَبَقَهُ السِّكِّينُ فَقَطَعَ رَأْسَهُ فَقَالَ هُوَ ذَكَاةٌ وَحِيَّةٌ لَا بَأْسَ بِهِ وَ بِأَكْلِهِ.

1. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from ‘Umar ibn ‘Udhaynah from al-Fudayl ibn Yasar who has said the following: “I once asked abu Ja‘far (a.s.), about the case of a man who slaughters an animal but by mistake the knife cuts off its head before it dies. He (the Imam) said, ‘It is a fast slaughtering and it is not unlawful to use it for food.’”

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادِ بْنِ عِيسَى عَنْ حَرِيزٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ:

سَأَلْتُ أَبَا جَعْفَرٍ ع عَنْ مُسْلِمٍ ذَبَحَ شَاةً وَ سَمَّى فَسَبَقَهُ السِّكِّينُ بِحِدَّتِهَا فَأَبَانَ الرَّأْسَ فَقَالَ إِنْ خَرَجَ الدَّمُ فَكُلْ.

2. Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Hariz from Muhammad ibn Muslim who has said the following: “I once asked abu Ja‘far (a.s.), about the case of a Muslim man who slaughters a sheep and mentions the name of Allah but because of sharpness of the knife he cuts off the head. He (the Imam) said, ‘If blood has come out you can use it for food.’”

سَمِعْتُ أَبَا عَبْدِ اللَّهِ ع‌ وَ قَدْ سُئِلَ عَنِ الرَّجُلِ يَذْبَحُ فَتُسْرِعُ السِّكِّينُ فَتُبِينُ الرَّأْسَ فَقَالَ الذَّكَاةُ الْوَحِيَّةُ لَا بَأْسَ بِأَكْلِهِ إِذَا لَمْ يَتَعَمَّدْ بِذَلِكَ.

Ali Bin Ibrahim, from his father, from Hroun Bin Muslim, from Mas’ada Bin sadaqa who said, ‘I heard Abu Abdullah asws , and he asws had been asked about the man who slaughtered, so the knife hastened and the head was cut off. So he asws said: ‘The vivid slaughter. There is no problem with eating it when it was not deliberate with that’.
