بَابُ مَا يُزَكَّى مِنَ الْحُبُوبِ‌

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادِ بْنِ عِيسَى عَنْ حَرِيزٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ:

سَأَلْتُهُ ع عَنِ الْحُبُوبِ مَا يُزَكَّى مِنْهَا قَالَ الْبُرُّ وَ الشَّعِيرُ وَ الذُّرَةُ وَ الدُّخْنُ وَ الْأَرُزُّ وَ السُّلْتُ وَ الْعَدَسُ وَ السِّمْسِمُ‌ كُلُّ هَذَا يُزَكَّى وَ أَشْبَاهُهُ.

1. Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Hariz from Muhammad ibn Muslim who has said the following: “I once asked him (the Imam), ‘Alayhi al-Salam, about grains which are subject to Zakat. He (the Imam) said, ‘Zakat is due on wheat, barley, corn, millet, rice, suit (something similar to wheat and barley), lentil and sesame all are subject to Zakat as well as the like.’”

[2]الدخن: الجاورس. و السلت- بالضم-: نوع من الشعير و العدس حبّ معروف و في المرآة العلس و قال المجلسيّ- رحمه اللّه-: ذهب الشيخ و جماعة إلى ان السلت نوع من الشعير و العلس نوع من الحنطة مستدلين بكلام بعض أهل اللغة. و السمسم- في اللغة بكسر المهملتين بينهما ميم-: نبات يستخرج من حبّه السيرج، الواحدة سمسمة. انتهى. و لعله ما يقال له بالفارسية كنجد.ص 510

حَرِيزٌ عَنْ زُرَارَةَ عَنْ أَبِي عَبْدِ اللَّهِ ع‌ مِثْلَهُ وَ قَالَ

كُلُّ مَا كِيلَ بِالصَّاعِ فَبَلَغَ الْأَوْسَاقَ فَعَلَيْهِ الزَّكَاةُ وَ قَالَ جَعَلَ رَسُولُ اللَّهِ ص الصَّدَقَةَ فِي كُلِّ شَيْ‌ءٍ أَنْبَتَتِ الْأَرْضُ إِلَّا مَا كَانَ فِي الْخُضَرِ وَ الْبُقُولِ وَ كُلَّ شَيْ‌ءٍ يَفْسُدُ مِنْ يَوْمِهِ.

2. Hariz has narrated from Zurarah who has narrated a similar Hadith from abu ‘Abd Allah (a.s.) who has said that whatever is measured with al-Sa‘ and it amounts to al-Awsaq (a certain unit of measurement) then it becomes subject to Zakat.’ He (the Imam) said, ‘The Messenger of Allah made charity (Zakat) obligatory on everything that earth grows except vegetable, legumes and things that perish on the same day.’” H 5738, Ch. 5, h 3

قَرَأْتُ فِي كِتَابِ عَبْدِ اللَّهِ بْنِ مُحَمَّدٍ إِلَى أَبِي الْحَسَنِ ع جُعِلْتُ فِدَاكَ رُوِيَ عَنْ أَبِي عَبْدِ اللَّهِ ع أَنَّهُ قَالَ وَضَعَ رَسُولُ اللَّهِ ص الزَّكَاةَ عَلَى تِسْعَةِ أَشْيَاءَ الْحِنْطَةِ وَ الشَّعِيرِ وَ التَّمْرِ وَ الزَّبِيبِ وَ الذَّهَبِ وَ الْفِضَّةِ وَ الْغَنَمِ وَ الْبَقَرِ وَ الْإِبِلِ وَ عَفَا رَسُولُ اللَّهِ ص عَمَّا سِوَى ذَلِكَ فَقَالَ لَهُ الْقَائِلُ عِنْدَنَا شَيْ‌ءٌ كَثِيرٌ يَكُونُ أَضْعَافَ ذَلِكَ فَقَالَ وَ مَا هُوَ فَقَالَ لَهُ الْأَرُزُّ فَقَالَ أَبُو عَبْدِ اللَّهِ ع أَقُولُ لَكَ إِنَّ رَسُولَ اللَّهِ ص وَضَعَ الزَّكَاةَ عَلَى تِسْعَةِ أَشْيَاءَ وَ عَفَا عَمَّا سِوَى ذَلِكَ وَ تَقُولُ عِنْدَنَا أَرُزٌّ وَ عِنْدَنَا ذُرَةٌ وَ قَدْ كَانَتِ الذُّرَةُ عَلَى عَهْدِ رَسُولِ اللَّهِ ص فَوَقَّعَ ع كَذَلِكَ هُوَ وَ الزَّكَاةُ عَلَى كُلِّ مَا كِيلَ بِالصَّاعِ وَ كَتَبَ عَبْدُ اللَّهِ وَ رَوَى غَيْرُ هَذَا الرَّجُلِ عَنْ أَبِي عَبْدِ اللَّهِ ع أَنَّهُ سَأَلَهُ عَنِ‌ الْحُبُوبِ فَقَالَ وَ مَا هِيَ فَقَالَ السِّمْسِمُ وَ الْأَرُزُّ وَ الدُّخْنُ‌ وَ كُلُّ هَذَا غَلَّةٌ كَالْحِنْطَةِ وَ الشَّعِيرِ فَقَالَ أَبُو عَبْدِ اللَّهِ ع فِي الْحُبُوبِ كُلِّهَا زَكَاةٌ.

3. It is also narrated that abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Everything that is measured by al- Qafiz are dealt with like wheat, barley, dates and raisins. He then asked saying, ‘I pray to Allah to keep my soul in service for your cause, is there Zakat on rice and similar things like beans and lintel?’ He (the Imam) ‘Alayhi al-Salam, signed, ‘Pay charity from everything that is measured.’”

وَ رَوَى أَيْضاً عَنْ أَبِي عَبْدِ اللَّهِ ع أَنَّهُ قَالَ:

كُلُّ مَا دَخَلَ الْقَفِيزَ فَهُوَ يَجْرِي مَجْرَى الْحِنْطَةِ وَ الشَّعِيرِ وَ التَّمْرِ وَ الزَّبِيبِ قَالَ فَأَخْبِرْنِي جُعِلْتُ فِدَاكَ هَلْ عَلَى هَذَا الْأَرُزِّ وَ مَا أَشْبَهَهُ مِنَ الْحُبُوبِ الْحِمَّصِ وَ الْعَدَسِ‌ زَكَاةٌ فَوَقَّعَ ع صَدَقُوا الزَّكَاةُ فِي كُلِّ شَيْ‌ءٍ كِيلَ.

4. It is narrated from him (narrator of previous Hadith) Ahmad ibn Muhammad from Muhammad ibn ’Isma‘il who has said the following: “I once asked abu al-Hassan, ‘Alayhi al-Salam, ‘We have fresh dates and rice. So what we owe for it?’ He (the Imam) said, ‘You do not owe anything because of fresh dates. If rice is watered by rains from the sky one out of ten is Zakat but if it is watered with buckets then one out of twenty is Zakat on whatever you measure by al-Sa‘ or that he (the Imam) said, ‘Whatever is measured by measuring devices.’”

قُلْتُ لِأَبِي الْحَسَنِ ع إِنَّ لَنَا رَطْبَةً وَ أَرُزّاً فَمَا الَّذِي عَلَيْنَا فِيهَا فَقَالَ ع أَمَّا الرَّطْبَةُ فَلَيْسَ عَلَيْكَ فِيهَا شَيْ‌ءٌ وَ أَمَّا الْأَرُزُّ فَمَا سَقَتِ السَّمَاءُ بِالْعُشْرِ وَ مَا سُقِيَ بِالدَّلْوِ فَنِصْفُ الْعُشْرِ مِنْ كُلِّ مَا كِلْتَ بِالصَّاعِ أَوْ قَالَ وَ كِيلَ بِالْمِكْيَالِ.

5. Humayd ibn Ziyad has narrated from Ahmad ibn Sama‘ah from those whom he has mentioned from Aban from abu Maryam who has said the foilowing: “I once asked abu ’Abd Allah (a.s.), about plantation and what is subject to Zakat from it. He (the Imam) said, ‘There is Zakat on wheat, barley, corn, rice, al-sult, and lintels and all of these are subject to Zakat.’ He (the Imam) said, ‘Everything that is measured by al-Sa‘ and amounts to al- Awsaq are subject to Zakat.’”

حُمَيْدُ بْنُ زِيَادٍ عَنْ أَحْمَدَ بْنِ سَمَاعَةَ عَمَّنْ ذَكَرَهُ عَنْ أَبَانٍ عَنْ أَبِي مَرْيَمَ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ:

سَأَلْتُهُ عَنِ الْحَرْثِ مَا يُزَكَّى مِنْهُ فَقَالَ الْبُرُّ وَ الشَّعِيرُ وَ الذُّرَةُ وَ الْأَرُزُّ وَ السُّلْتُ وَ الْعَدَسُ كُلُّ هَذَا مِمَّا يُزَكَّى وَ قَالَ كُلُّ مَا كِيلَ بِالصَّاعِ فَبَلَغَ الْأَوْسَاقَ فَعَلَيْهِ الزَّكَاةُ.

Humeyd Bin Ziyad, from ahmad Bin Sama’at, from the one who mentioned it, from Aban, from Abu Maryam, (It has been narrated) from Abu Abdullah asws , said, ‘I asked him asws about the farm, what would be purified ( Zakāt paid) from it?’ So he asws said: ‘The wheat, and the barley, and the corn, and the rice, and the rye, and the lentils – all of these are from what would be purified ( Zakāt paid)’. And he asws said: ‘Everything which is weighed by the Sa’a, so it reaches the Awsaaq, so upon it is the Zakāt ’.
