عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ مُحَمَّدِ بْنِ سِنَانٍ عَنْ مُحَمَّدِ بْنِ عَجْلَانَ قَالَ

قَالَ أَبُو عَبْدِ اللَّهِ ع‌ لَا تَفْدَحْ مَيِّتَكَ بِالْقَبْرِ وَ لَكِنْ ضَعْهُ أَسْفَلَ مِنْهُ بِذِرَاعَيْنِ أَوْ ثَلَاثَةٍ وَ دَعْهُ يَأْخُذُ أُهْبَتَهُ‌.

1. A number of our people have narrated from Sahl ibn Ziyad from Muhammad ibn Sinan from Muhammad ibn ‘Ajlan who has said the following: “Abu ’Abd Allah (a.s.), has said, ‘You must not make it heavy for your deceased by placing him in the grave. Place him two or three yards away from the grave on the ground so that he can get ready.”’

1. A number of our people have narrated from Sahl ibn Ziyad ibn Mahbub from ibn Ri’ab from Musadif who has said the following: “I once asked abu ‘ Abd Allah (a.s.), about the case of an al-Sarurah (one who performs al- Hajj for the first time) woman who performs al-Hajj on behalf of an al-Sarurah man. He (the Imam) said, ‘It is sufficient if she is a Muslimah and faqihah (knowledgeable in matters of Shari‘ah); many women are more faqihah (knowledgeable in matters of Shari ‘ah) than men.’”

زَوِّجْنِي فُلَاناً فَقَالَ إِنِّي لَا أُزَوِّجُكِ حَتَّى تُشْهِدِي لِي أَنَّ أَمْرَكِ بِيَدِي فَأَشْهَدَتْ لَهُ فَقَالَ عِنْدَ التَّزْوِيجِ لِلَّذِي يَخْطُبُهَا يَا فُلَانُ عَلَيْكَ كَذَا وَ كَذَا قَالَ نَعَمْ فَقَالَ هُوَ لِلْقَوْمِ اشْهَدُوا أَنَّ ذَلِكَ لَهَا عِنْدِي وَ قَدْ زَوَّجْتُهَا نَفْسِي فَقَالَتِ الْمَرْأَةُ لَا وَ لَا كَرَامَةَ وَ مَا أَمْرِي إِلَّا بِيَدِي وَ مَا وَلَّيْتُكَ أَمْرِي إِلَّا حَيَاءً مِنَ الْكَلَامِ قَالَ تُنْزَعُ مِنْهُ وَ تُوجَعُ رَأْسُهُ. - مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ النُّعْمَانِ عَنْ أَبِي الصَّبَّاحِ الْكِنَانِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ع‌ مِثْلَهُ.

1. Ali ibn Ibrahim has narrated from his father and Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad all from Ibn Abi ‘Umayr from Hammad ibn ‘Uthaman from al-Halabiy who has said the following: “About the case of a woman who appoints a man to form her marriage with so and so and he says, ‘I will do so only if you testify that I am your attorney;’ she testifies for him and at the time of ceremony he says to the man who has proposed marriage, ‘O so and so you owe such and such amount’ and he says, ‘Yes, I agree.’ He (her attorney) says to people, ‘Bear witness that this amount for her is on me and I give her in marriage to myself.’ She then says, ‘No, it is not an honor. The control of my affairs is in my own hand and I have not appointed you as the person in charge of my affairs. It was only because of not to verbally be embarrassed before people.’ He (the Imam) said, ‘He is removed from her. He deserves only a headache.’” Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Nu’man from abu al-Sabbah al-Kinaniy from abu ‘Abd Allah (a.s.), a similar Hadith.

2. Ali ibn Muhammad has narrated from Muhammad ibn Ahmad al-Khurasaniy from his father from Yunus who has said the following: “I heard a Hadith from abu al-Hassan, Musa (a.s.), that whenever I remember it in a house I feel as if it is tightening upon me. He (the Imam) said, ‘When a deceased is placed in front of his grave, give him a chance for a while; he readies himself for interrogation.’”

3. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from abu Ayyub who has said the following: “I once asked abu ‘Abd Allah (a.s.), about the case of a woman from our people whose brother has died and has said in his will to perform al-Hajj on his behalf. The woman who has performed al-Hajj said that if it is proper, she wants to perform al-Hajj on behalf of her brother, because she has a greater degree of priority to him than others do. He (the Imam) said, ‘It is not harmful if she performs al-Hajj on behalf of her brother. If she has any assets, she should perform from her own assets; it is of greater degree of reward for her.’”

A number of our people have narrated from Ahmad ibn Muhammad from al-Husayn ibn Sa‘id from Fadalah ibn Ayyub from Rifa’ah who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘It is permissible for a woman to perform al-Hajj for her brother, and sister.’ He (the Imam) said, ‘She can perform al-Hajj for her son also.’”
