عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادٍ عَنْ حَرِيزٍ عَنْ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ ع قَالَ:

سَأَلْتُهُ هَلْ سُئِلَ رَسُولُ اللَّهِ ص عَنِ الْأَطْفَالِ فَقَالَ قَدْ سُئِلَ فَقَالَ اللَّهُ أَعْلَمُ بِمَا كَانُوا عَامِلِينَ ثُمَّ قَالَ يَا زُرَارَةُ هَلْ تَدْرِي قَوْلَهُ اللَّهُ أَعْلَمُ بِمَا كَانُوا عَامِلِينَ قُلْتُ لَا قَالَ لِلَّهِ فِيهِمُ الْمَشِيئَةُ إِنَّهُ إِذَا كَانَ يَوْمُ الْقِيَامَةِ جَمَعَ اللَّهُ عَزَّ وَ جَلَّ الْأَطْفَالَ وَ الَّذِي مَاتَ مِنَ النَّاسِ فِي الْفَتْرَةِ وَ الشَّيْخَ الْكَبِيرَ الَّذِي أَدْرَكَ النَّبِيَّ ص وَ هُوَ لَا يَعْقِلُ وَ الْأَصَمَّ وَ الْأَبْكَمَ الَّذِي لَا يَعْقِلُ وَ الْمَجْنُونَ وَ الْأَبْلَهَ الَّذِي لَا يَعْقِلُ وَ كُلُّ وَاحِدٍ مِنْهُمْ يَحْتَجُّ عَلَى اللَّهِ عَزَّ وَ جَلَّ فَيَبْعَثُ اللَّهُ إِلَيْهِمْ مَلَكاً مِنَ الْمَلَائِكَةِ فَيُؤَجِّجُ لَهُمْ نَاراً ثُمَّ يَبْعَثُ اللَّهُ إِلَيْهِمْ مَلَكاً فَيَقُولُ لَهُمْ إِنَّ رَبَّكُمْ يَأْمُرُكُمْ أَنْ تَثِبُوا فِيهَا فَمَنْ دَخَلَهَا كَانَتْ عَلَيْهِ بَرْداً وَ سَلَاماً وَ أُدْخِلَ الْجَنَّةَ وَ مَنْ تَخَلَّفَ عَنْهَا دَخَلَ النَّارَ.

1. Ali ibn Ibrahim has narrated from his father from Hammad, from Hariz from Zurarah who has narrated the following: “I asked abu Ja’far (a.s.), ’Had the Messenger of Allah been asked about children?’ He said, ‘Indeed he was asked and he said, “Allah knows better about their deeds.’” The Imam then said, ‘O Zurarah, do you know His words, “Allah knows better of what they had been doing?”’ I replied, ‘I do not know.’ The Imam said, ‘Allah has a wish in the matter. On the Day of Judgment Allah, the Most Majestic, the Most Glorious, will bring the children together as well as the people who have died between the intervals (the time between the passing away of one prophet and the coming of the other). He will bring the elderly who lived in the time of the Holy Prophet but had lost understanding, were the deaf, and the dumb who do not understand, the insane ones and the dimwitted who do not understand. Every one of such people will argue before Allah, the Most Majestic, the Most Glorious. Allah sends an angel from among His angels who lights up a fire and then Allah sends another angel who says to them, ‘Your Lord commands you to jump in it (fire). Whoever of them jumps, for him it will turn cool and peaceful and he is admitted to paradise and those who disobey go to the fire.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ‘Isma‘il ibn Muhammad ibn al-Fadl from abu al-Sabbah who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘If one in the state of Ihram becomes ill one must treat the illness with edible items while he is in the state of Ihram.”’

A number of our people have narrated from Sahl ibn Ziyad and Ali ibn Ibrahim has narrated from his father from all from ibn abu Najran from ‘Asem ibn Hamid from abu Basir who has said the following: “In response to my question before abu Ja’far (a.s.), about al-Mut‘ah (advantageous marriage), he (the Imam) said, ‘It is mentioned in al-Quran, “If you marry them for al-Mut‘ah (advantageous marriage) you must pay their dowries. There is no harm if you reach an understanding among yourselves about mahr (the dowry). Allah is All-knowing and All-wise.’”” (4:24)

إِذَا كَانَ يَوْمُ الْقِيَامَةِ جَمَعَهُمُ اللَّهُ وَ أَجَّجَ لَهُمْ نَاراً وَ أَمَرَهُمْ أَنْ يَطْرَحُوا أَنْفُسَهُمْ فِيهَا فَمَنْ كَانَ فِي عِلْمِ اللَّهِ عَزَّ وَ جَلَّ أَنَّهُ سَعِيدٌ رَمَى بِنَفْسِهِ فِيهَا وَ كَانَتْ عَلَيْهِ بَرْداً وَ سَلَاماً وَ مَنْ كَانَ فِي عِلْمِهِ أَنَّهُ شَقِيٌّ امْتَنَعَ فَيَأْمُرُ اللَّهُ بِهِمْ إِلَى النَّارِ فَيَقُولُونَ يَا رَبَّنَا تَأْمُرُ بِنَا إِلَى النَّارِ وَ لَمْ تُجْرِ عَلَيْنَا الْقَلَمَ فَيَقُولُ الْجَبَّارُ قَدْ أَمَرْتُكُمْ مُشَافَهَةً فَلَمْ تُطِيعُونِي فَكَيْفَ وَ لَوْ أَرْسَلْتُ رُسُلِي بِالْغَيْبِ إِلَيْكُمْ. - وَ فِي حَدِيثٍ آخَرَ أَمَّا أَطْفَالُ الْمُؤْمِنِينَ فَيَلْحَقُونَ بِآبَائِهِمْ وَ أَوْلَادُ الْمُشْرِكِينَ يَلْحَقُونَ بِآبَائِهِمْ وَ هُوَ قَوْلُ اللَّهِ عَزَّ وَ جَلَ‌ بِإِيمانٍ أَلْحَقْنا بِهِمْ ذُرِّيَّتَهُمْ‌.

2. A number of our people have narrated from Sahl ibn Ziyad for more than one person who, in a marfu’ manner, have said the following: “He (the Holy Prophet) was asked about the children and he replied, ‘On the Day of Judgment Allah will bring all of them together, light up for them a fire and command them to throw themselves in it. Those of them who are fortunate in the knowledge of Allah, the Most Majestic, the Most Glorious, throw themselves in the fire and it turns cool and peaceful to them. Those of them who are not fortunate in the knowledge of Allah, they refuse to throw themselves in the fire and Allah then orders them to the fire and they will say, “O Lord, You commanded us to the fire and the pen has not moved against us.” The Almighty will say, “I just commanded you face to face but you did not obey Me: how would you obey Me through sending you my messengers in an unseen condition?”’ In another Hadith it is said that the children of the believing people are joined with their parents and the children of the pagans are joined with their parents as this is stated in the words of Allah, the Most Majestic, the Most Glorious, ‘The offspring of the believers will also follow them to paradise. Therefore, We shall join their offspring to them because of their faith. We shall not reduce anything from their deeds. Everyone will be responsible for his own actions.’” (52:21)

مَرَّ رَسُولُ اللَّهِ ص عَلَى كَعْبِ بْنِ عُجْرَةَ وَ الْقَمْلُ يَتَنَاثَرُ مِنْ رَأْسِهِ وَ هُوَ مُحْرِمٌ فَقَالَ لَهُ أَ تُؤْذِيكَ هَوَامُّكَ فَقَالَ نَعَمْ فَأُنْزِلَتْ هَذِهِ الْآيَةُ- فَمَنْ كانَ مِنْكُمْ مَرِيضاً أَوْ بِهِ أَذىً مِنْ رَأْسِهِ فَفِدْيَةٌ مِنْ صِيامٍ أَوْ صَدَقَةٍ أَوْ نُسُكٍ‌ فَأَمَرَهُ رَسُولُ اللَّهِ ص أَنْ يَحْلِقَ وَ جَعَلَ الصِّيَامَ ثَلَاثَةَ أَيَّامٍ وَ الصَّدَقَةَ عَلَى سِتَّةِ مَسَاكِينَ لِكُلِّ مِسْكِينٍ مُدَّيْنِ وَ النُّسُكَ شَاةً قَالَ أَبُو عَبْدِ اللَّهِ ع وَ كُلُّ شَيْ‌ءٍ مِنَ الْقُرْآنِ‌ أَوْ فَصَاحِبُهُ بِالْخِيَارِ يَخْتَارُ مَا شَاءَ وَ كُلُّ شَيْ‌ءٍ مِنَ الْقُرْآنِ فَمَنْ لَمْ يَجِدْ كَذَا فَعَلَيْهِ كَذَا فَالْأُولَى الْخِيَارُ.

2. Ali has narrated from his father from Hammad from Hariz from those who narrated to him who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, passed by Ka‘b ibn ‘Ujrah. Lice spread from his head and he was in the state of Ihram. He (the Messenger of Allah) asked, ‘Do your bugs annoy you?’ He replied, ‘Yes, they annoy me.’ This verse of al-Quran was then revealed. ‘Those of you who become ill or find annoyance in their head expiate it by fasting or charity or an act of worship.’ (2:195) The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, commanded him to shave his head and made the fasting to be three days, charity to six destitute people two mud (a certain measurement) for each one and one sheep as an act of worship.’ Abu ‘Abd Allah (a.s.), has said, ‘Wherever in al-Quran it is ‘or’ it is a reference to one’s having the choice to do what he likes, and wherever in al-Quran it says, ‘if one does not find then so and so’, then the first preference is one’s having the choice.’”

[4]يستفاد من الخبر احكام الأول: أنه إذا اضطر الى الحلق جاز له ذلك مع الكفّارة و أجمع العلماء كافة على وجوب الفدية على المحرم إذا حلق رأسه متعمدا سواء كان لاذى أو غيره حكاه في المنتهى و الحكم في الآية و الرواية وقع معلقا على الحلق للاذى الا أن ذلك تقتضى وجوب الكفّارة على غيره بطريق الأولى و يدلّ بعض الأخبار على الوجوب مطلقا. الثاني: أن النسك المذكور في الآية شاة و هو المقطوع به في كلام الاصحاب. الثالث: ان الصيام ثلاثة أيّام و لا خلاف فيه. الرابع: أن الصدقة إطعام ستة مساكين لكل مسكين مدان و هو المشهور بين الاصحاب و ذهب بعضهم الى وجوب إطعام عشرة لكل مسكين مد لرواية عمر بن يزيد و التخيير لا يخلو من قوة.ص 358

2. Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan from Safwan ibn Yahya from ibn Muskan from ‘Abd Allah ibn Sulayman who has said the following: “I once heard Abu Ja‘far (a.s.), saying that Ali (a.s.), would say, ‘Had Banu al-Khattab not prohibited al-Mut‘ah (advantageous marriage) before (the beginning of my administration) no one would commit fornication except the wicked ones.’”

3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Husayn ibn Sa‘id from al-Nadr ibn al-Suwayd from Yahya al-Halabiy from ibn Muskan from Zurarah who has said the following: “I asked abu Ja‘far (a.s.), about the children, and he said, ‘The Messenger of Allah was asked about the children and infants, and he replied, “Allah knows best about what they had been doing.’””

سَأَلَهُ رَجُلٌ ضَرِيرُ الْبَصَرِ وَ أَنَا حَاضِرٌ فَقَالَ‌ أَكْتَحِلُ إِذَا أَحْرَمْتُ قَالَ لَا وَ لِمَ تَكْتَحِلُ قَالَ إِنِّي ضَرِيرُ الْبَصَرِ فَإِذَا أَنَا اكْتَحَلْتُ نَفَعَنِي وَ إِذَا لَمْ أَكْتَحِلْ ضَرَّنِي قَالَ فَاكْتَحِلْ قَالَ فَإِنِّي أَجْعَلُ مَعَ الْكُحْلِ غَيْرَهُ قَالَ مَا هُوَ قَالَ آخُذُ خِرْقَتَيْنِ فَأُرَبِّعُهُمَا فَأَجْعَلُ عَلَى كُلِّ عَيْنٍ خِرْقَةً وَ أُعَصِّبُهُمَا بِعِصَابَةٍ إِلَى قَفَايَ فَإِذَا فَعَلْتُ ذَلِكَ نَفَعَنِي وَ إِذَا تَرَكْتُهُ ضَرَّنِي قَالَ فَاصْنَعْهُ.

3. A number of our people have narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from ‘Abd Allah ibn Yahya al-Kahiliy who has said the following: “Once, a blind man asked abu ‘Abd Allah (a.s.), when I was there, saying, ‘I use kohl when I assume the state of Ihram.’ He (the Imam) said, ‘No, do not use kohl.’ He said, ‘I am blind. If I use kohl it benefits me but if I do not use, it harms me.’ He (the Imam) said, ‘If that is the case then you can use kohl.’ He then said, ‘With kohl I use a certain other thing.’ He (the Imam) asked, ‘What is it?’ He said, ‘I take two pieces of cloth, fold them and place them on my eyes, then secure them in place by a strip behind my head. If I did this it benefits me; if I did not do, it harms me. He (the Imam) said, ‘If that is the case then you can do it.’”

3. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from those whom he has mentioned who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘It was revealed as “If you marry them [for an appointed time] for al-Mut‘ah (advantageous marriage) you must pay their dowries.” (4:24)’”

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from ‘Umar ibn ’Udhaynah from Zurarah who has said the following: “I asked abu ‘Abd Allah (a.s.), about children who die before maturity and he replied, ‘The Messenger of Allah was asked about them and he said, “Allah knows best about what they may do.’” Then he turned to me and said, ‘O Zurarah, do you know what the Messenger of Allah meant thereby?’ I said, ‘No, I do not know.’ He said, ‘He meant to say, “You must not say anything about them but leave their affairs to Allah (to deal with).’””

Al-Husayn ibn Muhammad has narrated from Mu‘alla’ ibn Muhammad from al-Hassan ibn Ali from Aban from those who narrated to him who has said the following: “A man once asked abu ‘Abd Allah (a.s.), about the case of a man in whose hands and feet cracks appear while he is in the state of Ihram; if he can use medicine. He (the Imam) said, ‘Yes, he can do so with oil and ghee.’ He (the Imam) said, ‘If one in the state of Ihram becomes ill, one must treat the illness with what is lawful for him to eat in the state of Ihram.’”

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from ‘Umar ibn ‘Udhaynah from Zurarah who has said the following: “Once ‘Abd Allah ibn ‘Umayr al-Laythiy came to abu Ja‘far (a.s.), and asked, ‘What do you say about al-Mut‘ah (advantageous marriage) of women?’ He (the Imam) said, ‘Allah has made it lawful in His book by the tongue of His Holy prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, thus it will remain lawful up to the Day of Judgment.’ He then said, ‘O abu Ja’far, how can someone like you say this, when ‘Umar made it unlawful and prohibited it?’ He (the Imam) said, ‘Even if he has done so.’ He said, ‘I ask Allah to protect you against a thing that ‘Umar has made unlawful.’ He (the narrator) has said that he (the Imam) then said, ‘So you can stand by the words of your friend but I stand by the words of the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, and I am prepared for al-Mula‘inah (ask Allah to condemn the party on the side of falsehood) that the word is what the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said; and that falsehood is what your friend has said.’ He (the narrator) has said that ‘Abd Allah ibn ‘Umayr then said, ‘Will it make you happy that your women, daughters, sisters, daughters of your aunts do?’ He (the narrator) has said that abu Ja‘far (a.s.), when he mentioned his women and daughters of his aunts turned away from him.’”

A number of our people have narrated from Sahl ibn Ziyad from Ali ibn al-Hakam from Sayf ibn ‘Amirah from ibn Bukayr who has said the following: “This is about the words of Allah, the Most Majestic, the Most Glorious, that read.. . . (The bountiful paradise is for the pious ones) and for the believers and their offspring who have followed them (parents) in belief, whom We shall join with their parents therein. . . . (52:21).’ Abu ‘Abd Allah (a.s.), has said, ‘The children even though may have had shortcomings in their deeds, they will be joined with their parents to grant delightfulness to the eyes of the parents.’”

Ali ibn Ibrahim has narrated from his father from ibn abu ‘ Umayr from Hisham who has said the following: “Abu ‘Abd Allah (a.s.), has said that the Messenger of Allah was asked about those who die in the interval (between the passing away of one prophet and coming of the other), those who have not committed sins, and people with severe mental conditions. He replied, ‘Allah argues against them by lighting up a fire and telling them to walk in it. Those who go in the fire it becomes cool and peaceful for them and to those who refuse Allah will say, “Consider, I just commanded you but you disobeyed Me.’””

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Afi ibn af-Hassan ibn Ribat from Hariz from ‘ Abd af-Rahman ibn abu ‘Abd Allah who has said the following: “I heard abu Hanifah ask abu ‘Abd Allah (a.s.), about al-Mut‘ah (advantageous matters). He (the Imam) asked, ‘Are you asking about the two al-Mut‘ah (advantageous matters)? 5 He said, ‘I asked you about al-Mut‘ah (advantageous matters of al-Hajj) and you inform me about al-Mut‘ah (advantageous marriage) is it true?’ He (the Imam) said, ‘Allah is free of all defects, have you not read the book of Allah, most Majestic, most Glorious, “If you marry them for al-Mut‘ah (advantageous marriage) you must pay their dowries. . . .”’ (4:24). قُلْتُ لِأَبِي الْحَسَنِ ع جُعِلْتُ فِدَاكَ إِنِّي كُنْتُ أَتَزَوَّجُ الْمُتْعَةَ فَكَرِهْتُهَا وَ تَشَأَّمْتُ بِهَا فَأَعْطَيْتُ اللَّهَ عَهْداً بَيْنَ الرُّكْنِ وَ الْمَقَامِ وَ جَعَلْتُ عَلَيَّ فِي ذَلِكَ نَذْراً وَ صِيَاماً أَلَّا أَتَزَوَّجَهَا ثُمَّ إِنَّ ذَلِكَ شَقَّ عَلَيَّ وَ نَدِمْتُ عَلَى يَمِينِي وَ لَمْ يَكُنْ بِيَدِي مِنَ الْقُوَّةِ مَا أَتَزَوَّجُ فِي الْعَلَانِيَةِ قَالَ فَقَالَ لِي عَاهَدْتَ اللَّهَ أَنْ لَا تُطِيعَهُ وَ اللَّهِ لَئِنْ لَمْ تُطِعْهُ لَتَعْصِيَنَّهُ‌.

7. Ali ibn Ibrahim has narrated from his father from ibn Mahbub from al-Sa’iy who has said the following: “I once said to abu al-Hassan (a.s.), ‘I pray to Allah to keep my soul in service for your cause, I would marry in the manner of al-Mut‘ah (advantageous marriage), I then disliked it and had bad omens about it; then I promised before Allah between the corner of al-Ka 5 bah and the Station of Ibrahim (a.s.), kept a vow upon myself and fasting not to do such marriage again. It became difficult for me, I regretted because of my swearing and I was not able to marry publicly. He (the Imam) said, ‘You promised Allah not to obey Him. By Allah, if you do not obey Him you sin against Him. 555

Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from ‘Imran al-Halabiy who has said the following: “I once asked abu ‘Abd Allah (a.s.), about a man who is in the state of Ihram with a wound and treats it with a medicine which has saffron. He (the Imam) said, ‘If saffron is overwhelming, it is not permissible; but if the medicine is overwhelming, it is not harmful.’”

Ali has narrated from in a marfu’ manner saying: “Abu Hanifah once asked abu Ja‘far, Muhammad ibn al-Nu 5 man Sahib al-Taq saying, ‘O abu Ja‘far, what do you say about al-Mut‘ah (advantageous marriage)? Do you think it is lawful? 5 He replied, ‘Yes, it is lawful. 5 He then said, ‘Why then do you not ask your women to go for al-Mut‘ah (advantageous marriage) and earn for you? 5 Abu Ja’far said, ‘All kinds of skills are not desirable even if they are lawful, because people have their values and positions which raise their values. However, what do you say O abu Hanifah, about al-Nabidh (wine from dates)? Do you think it is lawful? 5 He replied, ‘Yes, it is lawful. 5 He then said, ‘What prevents you from making your women sit in shops as al-Nabidh sellers to sell al-Nabidh to earn for you? 5 Abu Hanifah said, ‘This is one for one and your share is more effective. 5 He then said, ‘O abu Ja‘far, the verse in which there is “one asking a question asked” (Chapter 70) speaks of unlawfulness of al-Mut‘ah (advantageous marriage) and Hadith from the Holy Prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has come to cancel it. 5 Abu Ja’far said, ‘O abu Hanifah, the chapter “one asking a question asked” was revealed in Makkah and the verse that speaks of al-Mut‘ah (advantageous marriage) was revealed in al-Madinah and Hadith you spoke of is atypical and refuted. 5 Abu Hanifah then said, ‘The verse about inheritance also speaks of cancellation of al-Mut‘ah (advantageous marriage). 5 Abu Ja‘far, said, ‘Proof of lawfulness of marriage is without inheritance. 5 Abu Hanifah said, ‘On what basis you say so? 5 Abu Ja‘far, asked, ‘If a Muslim marries a woman from the people of the book then he dies what do you say about her? 5 He said, ‘She will not inherit him. 5 Abu Ja‘far, said, ‘So marriage is proved without inheritance. They then departed each other. 5 ” (Because of marriage spouses inherit each other. In Mut‘ah inheritance is not applicable thus Mut‘ah is not a marriage, according to the argument of abu Hanifah, if inheritance between the spouses is not applicable it is not a marriage. Abu Ja’far, proved one case where there is marriage but inheritance is not applicable).

Muhammad ibn Yahya Ahmad ibn Muhammad from Muhammad ibn Najiyah from Muhammad ibn Ali from Marwan ibn Muslim from who has said the following: “I once asked abu ‘Abd Allah (a.s.), about a man who is in the state of Ihram, his ears are affected by winds and is afraid of illness; if he can place cotton in his ears. He (the Imam) said, ‘It is not harmful if he is afraid of illness, otherwise, it is not permissible.’”
