[١]يعني أبا عبد اللّه عليه السلام كما هو مذكور في الكافي.
[٢]العقدة: الضيعة جمعها عقد، و في بعض النسخ« عقر» و هو من العقار.
[٣]يدل على جواز تصرف الثقة في مال اليتيم.( م ت).
[٤]يدل على جواز تصرف الولى و القيم في مال الطفل و سند الخبر صحيح، و لكن في الكافي ضعيف على المشهور.
إِنْ قَامَ رَجُلٌ ثِقَةٌ قَاسَمَهُمْ ذَلِكَ كُلَّهُ فَلَا بَأْسَ.
Hadith.5511 - Zur'ah narrated from Sama'ah, who said: I asked Imam (as) about a man who died and left behind sons and daughters, both young and old, without leaving a will. He also had servants, slaves, and jewelry. How should the heirs divide that inheritance? Imam (as) said: "If a trustworthy man undertakes the division of all that among them, then there is no harm in it."

أَبَا الْحَسَنِ مُوسَى ع عَنْ رَجُلٍ بَيْنِي وَ بَيْنَهُ قَرَابَةٌ مَاتَ وَ تَرَكَ أَوْلَاداً صِغَاراً وَ تَرَكَ مَمَالِيكَ لَهُ غِلْمَاناً وَ جَوَارِيَ وَ لَمْ يُوصِ فَمَا تَرَى فِيمَنْ يَشْتَرِي مِنْهُمُ الْجَارِيَةَ فَيَتَّخِذُهَا أُمَّ وَلَدٍ وَ مَا تَرَى فِي بَيْعِهِمْ فَقَالَ إِنْ كَانَ لَهُمْ وَلِيٌّ يَقُومُ بِأَمْرِهِمْ بَاعَ عَلَيْهِمْ وَ نَظَرَ لَهُمْ كَانَ مَأْجُوراً فِيهِمْ قُلْتُ فَمَا تَرَى فِيمَنْ يَشْتَرِي مِنْهُمُ الْجَارِيَةَ فَيَتَّخِذُهَا أُمَّ وَلَدٍ قَالَ لَا بَأْسَ بِذَلِكَ إِذَا بَاعَ عَلَيْهِمُ الْقَيِّمُ لَهُمْ النَّاظِرُ فِيمَا يُصْلِحُهُمْ وَ لَيْسَ لَهُمْ أَنْ يَرْجِعُوا عَمَّا صَنَعَ الْقَيِّمُ لَهُمُ النَّاظِرُ فِيمَا يُصْلِحُهُمْ.
Hadith.5512 - Al-Hasan ibn Mahbub narrated from Ali ibn Ri'ab, who said: I asked Abu Al-Hasan Imam Musa ibn Jafar Al-Kadhim (as), about a man related to me who died and left behind young children and male and female slaves. He did not leave a will. What is your opinion regarding someone who buys a female slave from them and takes her as an umm walad (a concubine who bears a child)? And what is your opinion on selling them? Imam (as) said: "If they have a guardian who manages their affairs, sells on their behalf, and looks after their interests, then he will be rewarded for it." I said: "What do you say about someone who buys a female slave from them and takes her as an umm walad?" Imam (as) said: "There is no harm in that if the guardian responsible for their welfare sells to him, considering what is in their best interest. They have no right to revoke what the guardian, acting in their best interest, has done."

إِلَيْهِ يَعْنِي عَلِيَّ بْنَ مُحَمَّدٍ ع أَسْأَلُهُ عَنْ إِنْسَانٍ أَوْصَى بِوَصِيَّةٍ فَلَمْ يَحْفَظِ الْوَصِيُّ إِلَّا بَاباً وَاحِداً مِنْهَا كَيْفَ يَصْنَعُ فِي الْبَاقِي فَوَقَّعَ ع الْأَبْوَابَ الْبَاقِيَةَ اجْعَلْهَا فِي الْبِرِّ.
Hadith.5513 - Muhammad ibn Al-Hasan Al-Saffar, may Allah (swt) be pleased with him, narrated from Sahl ibn Ziyad from Muhammad ibn Rayyan, who said: I wrote to Imam (as) - meaning Imam Ali ibn Muhammad Al-Hadi (as) - asking about a person who had made a will, but the executor only remembered one part of it. What should be done with the remaining parts? Imam (as) replied: "Allocate the remaining parts to charitable acts."
