سَأَلْتُهُ عَنِ الرَّجُلِ يَحْفِرَ الْبِئْرَ فِي دَارِهِ أَوْ فِي أَرْضِهِ فَقَالَ أَمَّا مَا حَفَرَ فِي مِلْكِهِ فَلَيْسَ عَلَيْهِ ضَمَانٌ وَ أَمَّا مَا حَفَرَ فِي الطَّرِيقِ أَوْ فِي غَيْرِ مِلْكِهِ فَهُوَ ضَامِنٌ لِمَا يَسْقُطُ فِيهَا.

Hadith.5341 - Zurah and Uthman ibn Isa narrated from Samaah, who said: I asked Imam (as) about a man who digs a well in his house or on his land. Imam (as) said: "If he digs it within his own property, there is no liability upon him. But if he digs it in a public road or in a place that does not belong to him, then he is liable for anything that falls into it."
