كُنْتُ شَاهِدَ ابْنِ أَبِي لَيْلَى فَقَضَى فِي رَجُلٍ جَعَلَ لِبَعْضِ قَرَابَتِهِ غَلَّةَ دَارِهِ وَ لَمْ يُوَقِّتْ وَقْتاً فَمَاتَ الرَّجُلُ فَحَضَرَ وَرَثَتُهُ ابْنَ أَبِي لَيْلَى وَ حَضَرَ قَرَابَتُهُ الَّذِي جُعِلَ لَهُ الدَّارُ فَقَالَ ابْنُ أَبِي لَيْلَى أَرَى أَنْ أَدَعَهَا عَلَى مَا تَرَكَهَا صَاحِبُهَا فَقَالَ لَهُ مُحَمَّدُ بْنُ مُسْلِمٍ الثَّقَفِيُّ أَمَا إِنَّ عَلِيَّ بْنَ أَبِي طَالِبٍ ع- قَدْ قَضَى فِي

“I was witness that ibn abu Layla’ judged in the case of a man who had designated the income of a house for his relative without the mention of time limit. كَتَبْتُ إِلَى أَبِي جَعْفَرٍ ع أَنَّ فُلَاناً ابْتَاعَ ضَيْعَةً فَوَقَفَهَا وَ جَعَلَ لَكَ فِي الْوَقْفِ الْخُمُسَ وَ يَسْأَلُ عَنْ رَأْيِكَ فِي بَيْعِ حِصَّتِكَ مِنَ الْأَرْضِ أَوْ يُقَوِّمُهَا عَلَى نَفْسِهِ بِمَا اشْتَرَاهَا بِهِ أَوْ يَدَعُهَا مَوْقُوفَةً فَكَتَبَ ع إِلَيَّ أَعْلِمْ فُلَاناً أَنِّي آمُرُهُ بِبَيْعِ حَقِّي مِنَ الضَّيْعَةِ وَ إِيصَالِ ثَمَنِ ذَلِكَ إِلَيَّ وَ إِنَّ ذَلِكَ رَأْيِي إِنْ شَاءَ اللَّ

“I once wrote to abu Ja‘far ‘Alayhi al-Salam, that so and so has bought a certain asset. He has made it an endowment of which one-fifth is designated for you. He seeks your opinion about selling your share of the land, or appraising and counting its price on himself for which he has bought or keep it as an endowment. H

قُلْتُ رَوَى بَعْضُ مَوَالِيكَ عَنْ آبَائِكَ ع أَنَّ كُلَّ وَقْفٍ إِلَى وَقْتٍ مَعْلُومٍ فَهُوَ وَاجِبٌ عَلَى الْوَرَثَةِ وَ كُلَّ وَقْفٍ إِلَى غَيْرِ وَقْتٍ مَعْلُومٍ جَهْلٌ مَجْهُولٌ بَاطِلٌ مَرْدُودٌ عَلَى الْوَرَثَةِ وَ أَنْتَ أَعْلَمُ بِقَوْلِ آبَائِكَ فَكَتَبَ ع هُوَ عِنْدِي كَذَا[2].

Ali ibn Mahziyar has said: “I asked him (the Imam) (a.s.), that certain ones of your Mawali (friends or slaves) have narrated from your ancestors the following. ‘All endowments for a known period of time are binding upon the heirs, and all endowments for an unknown period of time are unknown, confusing and invalid

مَيِّتٌ أَوْصَى بِأَنْ يُجْرَى عَلَى رَجُلٍ مَا بَقِيَ مِنْ ثُلُثِهِ وَ لَمْ يَأْمُرْ بِإِنْفَاذِ ثُلُثِهِ هَلْ لِلْوَصِيِّ أَنْ يُوقِفَ ثُلُثَ الْمَيِّتِ بِسَبَبِ الْإِجْرَاءِ فَكَتَبَ ع يُنْفِذُ ثُلُثَهُ وَ لَا يُوقِفُ‌[3].

كَتَبْتُ إِلَى أَبِي جَعْفَرٍ الثَّانِي ع أَسْأَلُ عَنْ أَرْضٍ أَوْقَفَهَا جَدِّي عَلَى الْمُحْتَاجِينَ مِنْ وُلْدِ فُلَانِ بْنِ فُلَانٍ وَ هُمْ كَثِيرٌ مُتَفَرِّقُونَ فِي الْبِلَادِ فَأَجَابَ ع ذَكَرْتَ الْأَرْضَ الَّتِي أَوْقَفَهَا جَدُّكَ عَلَى فُقَرَاءِ وُلْدِ فُلَانِ بْنِ فُلَانٍ وَ هِيَ لِمَنْ حَضَرَ الْبَلَدَ الَّذِي فِيهِ الْوَقْفُ وَ لَيْسَ لَكَ أَنْ تُتْبِعَ مَنْ كَانَ غَائِباً.

سَأَلْتُهُ عَنْ رَجُلٍ جَعَلَ دَاراً سُكْنَى لِرَجُلٍ إِبَّانَ حَيَاتِهِ أَوْ جَعَلَهَا لَهُ وَ لِعَقِبِهِ مِنْ بَعْدِهِ قَالَ هِيَ لَهُ وَ لِعَقِبِهِ مِنْ بَعْدِهِ كَمَا شَرَطَ قُلْتُ فَإِنِ احْتَاجَ يَبِيعُهَا قَالَ نَعَمْ قُلْتُ فَيَنْقُضُ بَيْعُهُ الدَّارَ السُّكْنَى قَالَ لَا يَنْقُضُ الْبَيْعُ السُّكْنَى كَذَلِكَ سَمِعْتُ أَبِي ع يَقُولُ قَالَ أَبُو جَعْفَرٍ ع لَا يَنْقُضُ الْبَيْعُ الْإِجَارَةَ وَ لَا السُّكْن

أَمْلَأُ عَلَيَّ أَبُو عَبْدِ اللَّهِ ع‌ بِسْمِ اللَّهِ الرَّحْمنِ الرَّحِيمِ* هَذَا مَا تَصَدَّقَ اللَّهَ بِهِ فُلَانُ بْنُ فُلَانٍ وَ هُوَ حَيٌّ سَوِيٌّ بِدَارِهِ الَّتِي فِي بَنِي فُلَانٍ بِحُدُودِهَا صَدَقَةً لَا تُبَاعُ وَ لَا تُوهَبُ وَ لَا تُورَثُ حَتَّى يَرِثَهَا وَارِثُ السَّمَاوَاتِ وَ الْأَرْضِ وَ إِنَّهُ قَدْ أَسْكَنَ صَدَقَتَهُ هَذِهِ فُلَاناً وَ عَقِبَهُ فَإِذَا انْقَرَضُوا فَهِيَ عَلَى ذِي الْحَاجَةِ م

“Abu ‘Abd Allah (a.s.), dictated to me the following:

قَالَ أَبُو جَعْفَرٍ ع‌ لَا يَشْتَرِي الرَّجُلُ مَا تَصَدَّقَ بِهِ وَ إِنْ تَصَدَّقَ بِمَسْكَنٍ عَلَى ذِي قَرَابَتِهِ فَإِنْ شَاءَ سَكَنَ مَعَهُمْ وَ إِنْ تَصَدَّقَ بِخَادِمٍ عَلَى ذِي قَرَابَتِهِ خَدَمَتْهُ إِنْ شَاءَ اللَّهُ‌[2].

41. Aban has narrated from abu al-Jarud who has narrated the following: “Abu Ja‘far (a.s.), has said, ‘A man cannot buy what he has given as charity. If he gives as charity a house to a relative then if he likes he can live with them. If he gives in charity a servant to a relative he can serve him by the will of Allah.

“A woman made a will to me that said, ‘With one-third of my legacy my debts must be paid and part of it will be for so and so female.’ I then asked ibn abu Layla’ about it and he said, ‘There is nothing for her because I do not know how much is al-Juz’ (a part).’ I then asked abu ‘Abd Allah (a.s.), about it afterwards

السَّهْمُ وَاحِدٌ مِنْ ثَمَانِيَةٍ لِقَوْلِ اللَّهِ تَبَارَكَ وَ تَعَالَى- إِنَّمَا الصَّدَقاتُ لِلْفُقَراءِ وَ الْمَساكِينِ وَ الْعامِلِينَ عَلَيْها وَ الْمُؤَلَّفَةِ قُلُوبُهُمْ وَ فِي الرِّقابِ وَ الْغارِمِينَ وَ فِي سَبِيلِ اللَّهِ وَ ابْنِ السَّبِيلِ‌[1].

سَأَلْتُ الرِّضَا ع وَ مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ صَفْوَانَ وَ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ قَالا سَأَلْنَا أَبَا الْحَسَنِ الرِّضَا ع عَنْ رَجُلٍ أَوْصَى بِسَهْمٍ مِنْ مَالِهِ وَ لَا يُدْرَى السَّهْمُ أَيُّ شَيْ‌ءٍ هُوَ فَقَالَ لَيْسَ عِنْدَكُمْ فِيمَا بَلَغَكُمْ عَنْ جَعْفَرٍ وَ لَا عَنْ أَبِي جَعْفَرٍ ع فِيهَا شَيْ‌ءٌ قُلْنَا لَهُ جُعِلْنَا فِدَاكَ مَا سَمِعْنَا أَصْحَابَ

“We once asked abu al-Hassan, al-Rida’ (a.s.), about the case of a man who has made a will about a share of his legacy and it is not known how much a share is. He (the Imam) asked, ‘Have you not received anything about it from Ja‘far, or abu Ja‘far, ‘Alayhim al-Salam?’ We replied, ‘We pray to Allah to keep our souls in

يَجُوزُ عَلَيْهِ شَهَادَتُهُ وَ لَا يُغْرَمُ وَ يُسْتَسْعَى الْغُلَامُ فِيمَا كَانَ لِغَيْرِهِ مِنَ الْوَرَثَةِ[3].

“About the case of a man who dies and leaves behind a slave and certain ones of his children testify that their father had freed the slave. He (the Imam) said, ‘His testimony is permissible, he is not required to compensate and the slave is not required to work to pay for his freedom from the other heirs.’”

قُلْتُ لَهُ إِنَّ رَجُلًا مِنْ مَوَالِيكَ مَاتَ وَ تَرَكَ وُلْداً صِغَاراً وَ تَرَكَ شَيْئاً وَ عَلَيْهِ دَيْنٌ وَ لَيْسَ يَعْلَمُ بِهِ الْغُرَمَاءُ فَإِنْ قَضَاهُ لِغُرَمَائِهِ بَقِيَ وُلْدُهُ وَ لَيْسَ لَهُمْ شَيْ‌ءٌ فَقَالَ أَنْفَقَهُ عَلَى وُلْدِهِ‌[3].

“I once asked abu al-Hassan (a.s.), about the case of a man who has died and left behind small children and something but owes debts. The creditors do not know it (his leaving something). If debts are paid, nothing is left for his children who do not have anything. He (the Imam) said, ‘Spend it for his children.’”

كَتَبْتُ إِلَى أَبِي مُحَمَّدٍ ع رَجُلٌ كَانَ لَهُ ابْنَانِ فَمَاتَ أَحَدُهُمَا وَ لَهُ وُلْدٌ ذُكُورٌ وَ إِنَاثٌ فَأَوْصَى لَهُمْ جَدُّهُمْ بِسَهْمِ أَبِيهِمْ فَهَذَا السَّهْمُ الذَّكَرُ وَ الْأُنْثَى فِيهِ سَوَاءٌ أَمْ‌ لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ‌ فَوَقَّعَ ع يُنْفِذُونَ وَصِيَّةَ جَدِّهِمْ كَمَا أَمَرَ إِنْ شَاءَ اللَّهُ قَالَ وَ كَتَبْتُ إِلَيْهِ رَجُلٌ لَهُ وُلْدٌ ذُكُورٌ وَ إِنَاثٌ فَأَقَرَّ لَهُمْ

“I once wrote to abu Muhammad (a.s.), and asked about the case of a man who has two sons. One of them dies, leaving behind male and female children, and the grandfather bequests for them the share of their father, if male and female in this share are equal or if the male has twice the share of the female. He (the Imam)

سَأَلْتُ أَبَا الْحَسَنِ ع عَنْ رَجُلٍ أَوْصَى إِلَى امْرَأَةٍ فَأَشْرَكَ فِي الْوَصِيَّةِ مَعَهَا صَبِيّاً فَقَالَ يَجُوزُ ذَلِكَ وَ تُمْضِي الْمَرْأَةُ الْوَصِيَّةَ وَ لَا يُنْتَظَرُ بُلُوغُ الصَّبِيِّ فَإِذَا بَلَغَ الصَّبِيُّ فَلَيْسَ لَهُ أَنْ لَا يَرْضَى إِلَّا مَا كَانَ مِنْ تَبْدِيلٍ أَوْ تَغْيِيرٍ فَإِنَّ لَهُ أَنْ يَرُدَّهُ إِلَى مَا أَوْصَى بِهِ الْمَيِّتُ.

“I once asked abu al-Hassan (a.s.), about the case of a man who makes a bequest for a woman to share it with a child. He (the Imam) said, ‘It is permissible. The woman can execute the will and she does not have to wait until the child becomes mature. The child upon maturity cannot disagree unless the will is changed or

رَجُلٌ أَوْصَى إِلَى وُلْدِهِ وَ فِيهِمْ كِبَارٌ قَدْ أَدْرَكُوا وَ فِيهِمْ صِغَارٌ أَ يَجُوزُ لِلْكِبَارِ أَنْ يُنْفِذُوا وَصِيَّتَهُ وَ يَقْضُوا دَيْنَهُ لِمَنْ صَحَّ عَلَى الْمَيِّتِ بِشُهُودٍ عُدُولٍ قَبْلَ أَنْ يُدْرِكَ الْأَوْصِيَاءُ الصِّغَارُ فَوَقَّعَ ع نَعَمْ عَلَى الْأَكَابِرِ مِنَ الْوِلْدَانِ أَنْ يَقْضُوا دَيْنَ أَبِيهِمْ وَ لَا يَحْبِسُوهُ بِذَلِكَ‌[1].

سَأَلْتُ أَبَا الْحَسَنِ ع عَنْ رَجُلٍ مُسَافِرٍ حَضَرَهُ الْمَوْتُ فَدَفَعَ مَالَهُ إِلَى رَجُلٍ مِنَ التُّجَّارِ فَقَالَ إِنَّ هَذَا الْمَالَ لِفُلَانِ بْنِ فُلَانٍ لَيْسَ لِي فِيهِ قَلِيلٌ وَ لَا كَثِيرٌ فَادْفَعْهُ إِلَيْهِ‌ يَضَعُهُ حَيْثُ يَشَاءُ فَمَاتَ وَ لَمْ يَأْمُرْ صَاحِبَهُ الَّذِي جَعَلَ لَهُ بِأَمْرٍ وَ لَا يَدْرِي صَاحِبُهُ مَا الَّذِي حَمَلَهُ عَلَى ذَلِكَ كَيْفَ يَصْنَعُ بِهِ قَالَ يَضَعُهُ حَيْثُ ي

“I once asked abu al-Hassan (a.s.), about the case of a man whose death approaches him on a journey. He gives his assets to a man of the merchants saying, ‘This asset belongs to so and so son of so and so. Nothing of it, little or more, belongs to me. You must give it to him, he will place it as he wants’; and he dies,

سَأَلْتُهُ يَعْنِي أَبَا الْحَسَنِ الرِّضَا ع- عَنْ رَجُلٍ‌[3] كَانَ لَهُ ابْنٌ يَدَّعِيهِ فَنَفَاهُ وَ أَخْرَجَهُ مِنَ الْمِيرَاثِ وَ أَنَا وَصِيُّهُ فَكَيْفَ أَصْنَعُ فَقَالَ يَعْنِي الرِّضَا ع لَزِمَهُ الْوَلَدُ بِإِقْرَارِهِ بِالْمَشْهَدِ لَا يَدْفَعُهُ الْوَصِيُّ عَنْ شَيْ‌ءٍ قَدْ عَلِمَهُ.

“I once asked him [abu al-Hassan, al-Rida’ (a.s.) ] about the case of a man who has a son, whom he called his son then denied and removed him from the list of his heirs, and I am the executor of the will. What must I do? He, al-Rida’ ‘Alayhi al-Salam, said, ‘He is considered his son because of his confession in public.
