Chapter on Mutual Cursing (li'an)

سَأَلَ الْبَزَنْطِيُّ أَبَا الْحَسَنِ الرِّضَا ع‌ فَقَالَ لَهُ أَصْلَحَكَ اللَّهُ كَيْفَ الْمُلَاعَنَةُ قَالَ يَقْعُدُ الْإِمَامُ وَ يَجْعَلُ ظَهْرَهُ إِلَى الْقِبْلَةِ وَ يَجْعَلُ الرَّجُلَ عَنْ يَمِينِهِ وَ الْمَرْأَةَ وَ الصَّبِيَّ عَنْ يَسَارِهِ‌[2].

سَأَلْتُ أَبَا جَعْفَرٍ عَلَيْهِ اَلسَّلاَمُ عَنِ اَلْحُرِّ يُلاَعِنُ اَلْمَمْلُوكَةَ قَالَ "نَعَمْ إِذَا كَانَ مَوْلاَهَا اَلَّذِي زَوَّجَهَا إِيَّاهُ".

I asked Abu Ja'far Imam Muhammad ibn Ali Al-Baqir (as) about a free man performing liʿan (mutual cursing) against a female slave. Imam (as) replied: "Yes, if it was her master who married her to him."

قُلْتُ لَهُ جُعِلْتُ فِدَاكَ كَيْفَ صَارَ الرَّجُلُ إِذَا قَذَفَ امْرَأَتَهُ كَانَتْ شَهَادَتُهُ أَرْبَعَ‌ شَهاداتٍ بِاللَّهِ‌ فَإِذَا قَذَفَهَا غَيْرُهُ أَبٌ أَوْ أَخٌ أَوْ وَلَدٌ أَوْ غَرِيبٌ جُلِدَ الْحَدَّ أَوْ يُقِيمَ الْبَيِّنَةَ عَلَى مَا قَالَ فَقَالَ قَدْ سُئِلَ جَعْفَرُ بْنُ مُحَمَّدٍ ع عَنْ ذَلِكَ فَقَالَ إِنَّ الزَّوْجَ إِذَا قَذَفَ امْرَأَتَهُ فَقَالَ رَأَيْتُ ذَلِكَ بِعَيْنِي كَانَتْ شَهَادَتُهُ أَرْبَع
