قَضَى أَمِيرُ الْمُؤْمِنِينَ ع فِي رَجُلٍ قُتِلَ وَ لَهُ وَلِيَّانِ فَعَفَا أَحَدُهُمَا وَ أَرَادَ الْآخَرُ أَنْ يَقْتُلَ قَالَ يَقْتُلُ وَ يَرُدُّ عَلَى أَوْلِيَاءِ الْمَقْتُولِ الْمُقَادِ نِصْفَ الدِّيَةِ[2].

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع- عَنْ رَجُلٍ قُتِلَ وَ لَهُ أَبٌ وَ أُمٌّ وَ ابْنٌ فَقَالَ الِابْنُ أَنَا أُرِيدُ أَنْ أَقْتُلَ قَاتِلَ أَبِي وَ قَالَ الْآخَرُ[3] أَنَا أَعْفُو وَ قَالَ الْآخَرُ[4] أَنَا أُرِيدُ أَنْ آخُذَ الدِّيَةَ قَالَ‌ فَلْيُعْطِ الِابْنُ أُمَّ الْمَقْتُولِ السُّدُسَ مِنَ الدِّيَةِ وَ يُعْطِي وَرَثَةَ الْقَاتِلِ السُّدُسَ مِنَ الدِّيَةِ حَقَّ الْأَبِ الَّذِي عَفَا وَ يَقْتُلُهُ.

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع- عَنْ رَجُلٍ قُتِلَ وَ لَهُ أَوْلَادٌ صِغَارٌ وَ كِبَارٌ أَ رَأَيْتَ إِنْ عَفَا أَوْلَادُهُ الْكِبَارُ فَقَالَ لَا يُقْتَلُ وَ يَجُوزُ عَفْوُ الْكِبَارِ فِي حِصَصِهِمْ فَإِذَا كَبِرَ الصِّغَارُ كَانَ لَهُمْ أَنْ يَطْلُبُوا حَقَّهُمْ مِنَ الدِّيَةِ[1]. وَ قَدْ رُوِيَ‌ أَنَّهُ إِذَا عَفَا وَاحِدٌ مِنَ الْأَوْلِيَاءِ عَنِ الدَّمِ ارْتَفَعَ الْقَوَدُ[2].
