الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ مُعَلَّى بْنِ مُحَمَّدٍ وَ عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ جَمِيعاً عَنِ الْوَشَّاءِ عَنْ أَحْمَدَ بْنِ عَائِذٍ عَنْ أَبِي الْحَسَنِ السَّوَّاقِ عَنْ أَبَانِ بْنِ تَغْلِبَ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ:

يَا أَبَانُ إِذَا قَدِمْتَ الْكُوفَةَ فَارْوِ هَذَا الْحَدِيثَ مَنْ شَهِدَ أَنْ لَا إِلَهَ إِلَّا اللَّهُ مُخْلِصاً وَجَبَتْ لَهُ الْجَنَّةُ قَالَ قُلْتُ لَهُ إِنَّهُ يَأْتِينِي مِنْ كُلِّ صِنْفٍ مِنَ الْأَصْنَافِ أَ فَأَرْوِي لَهُمْ هَذَا الْحَدِيثَ قَالَ نَعَمْ يَا أَبَانُ إِنَّهُ إِذَا كَانَ‌ يَوْمُ الْقِيَامَةِ وَ جَمَعَ اللَّهُ الْأَوَّلِينَ وَ الْآخِرِينَ فَتُسْلَبُ لَا إِلَهَ إِلَّا اللَّهُ مِنْهُمْ إِلَّا مَنْ كَانَ عَلَى هَذَا الْأَمْرِ.

Al-Husayn ibn Muhammad has narrated from Mu’alla ibn Muhammad and A number of our people have narrated from Ahmad ibn Muhammad all from al- Washsha’ from Ahmad ibn ‘Ai’z from abu al-Hassan al-Sawwaq from Aban ibn Taghlib from Abu ‘Abdillah (a.s.) who has said the following: “O Aban, when you will arrive in al-Kufah, narrate this Hadith : ‘Whoever testifies sincerely saying, “No one deserves to be worshipped except Allah,” paradise becomes necessary for him. I (the narrator) then said, ‘All kinds of people will come to me, shall I narrate it to them?’ The Imam said, ‘Yes, O Aban, when it will be the Day of Judgment and Allah will gather all the people of the past and last together, the testimony: ‘No one deserves to be worshipped except Allah,’ will be taken away from them except those who believe in this cause (belief of the followers of Ahl al-Baay (a.s.)).”’

إِنَّا نَأْمُرُ صِبْيَانَنَا بِالصِّيَامِ إِذَا كَانُوا بَنِي سَبْعِ سِنِينَ بِمَا أَطَاقُوا مِنْ صِيَامِ الْيَوْمِ فَإِنْ كَانَ إِلَى نِصْفِ النَّهَارِ وَ أَكْثَرَ مِنْ ذَلِكَ‌ أَوْ أَقَلَّ فَإِذَا غَلَبَهُمُ‌ الْعَطَشُ وَ الْغَرَثُ أَفْطَرُوا حَتَّى يَتَعَوَّدُوا الصَّوْمَ وَ يُطِيقُوهُ فَمُرُوا صِبْيَانَكُمْ إِذَا كَانُوا أَبْنَاءَ تِسْعِ سِنِينَ بِمَا أَطَاقُوا مِنْ صِيَامٍ فَإِذَا غَلَبَهُمُ الْعَطَشُ أَفْطَرُوا.

Ali ibn Ibrahim has narrated from his father [from ibn abu ‘ Umayr] from Hammad from al-Halabiy who has said the following: “Abu ‘ Abd Allah (a.s.), has said, ‘We command our children, when they are seven years old, to fast as long as they can. In midday or more if thirst increases, they stop fasting so they develop endurance. You should command your children to fast, when they are nine years old, for as long as they can fast. When thirst increases they can stop fasting.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Asbat ibn Salim who has said the following: “I once said to abu ‘ Abd Allah (a.s.), ‘I had a brother who has died and made a will in which he appointed my brother who is elder to me and myself as executors. He has left behind a small son and has left behind a certain amount of assets. My brother uses that asset in business and gives the extra to the orphan and has taken the responsibility for the assets of the orphan. He (the Imam) said, ‘If your brother’s own asset is sufficient to cover the assets of the orphan, then it is not harmful; but if he does not have that much asset he must not bother with the assets of the orphan.’”

A number of our people have narrated from Ahmad ibn Muhammad from ibn Khalid and Ali ibn Ibrahim has narrated from his father from ‘Uthman ibn ‘Isa from Sama‘ah who has said the following: “He (the Imam) (a.s.), has said, ‘The waiting period for a pregnant widow is the one which ends last. If she is pregnant when four months end but her child is not yet born, then her waiting period ends when the child is born. If she gives birth before the end of four months and ten days, she must wait until the four months and ten days are complete and this is the longer of the two time periods.’”

Abu Ali al-Ash‘ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Yahya from Mansur ibn Hazim who has narrated the following: “Abu ‘Abd Allah (a.s.), has said, ‘A contracting slave inherits proportionate to the amount he has paid.’” (The above form of contracting is a contract between a slave and his master, which is an agreement that requires the slave to pay a certain amount to become free. Such contract can entail conditions and restrictions or is without restrictions). [Note: Other Ahadith of this chapter are not translated because of not being applicable in our time.]

He (the Imam) said, ‘They must fast when they are fifteen and fourteen years old. If they fast before this then allow them to do so. My son, so and so fasted before such time and I allowed him to do so.’”

A number of our people have narrated from Sahl ibn Ziyad from Ali ibn Asbat from Asbat ibn Salim who has said the following: “I once said to abu ‘Abd Allah (a.s.), that my brother has told me to ask you about the assets of an orphan who is under his (my brother’s) guardianship and he uses the assets of the orphan in business. He (the Imam) said, ‘If your brother’s assets are sufficient to cover the assets of the orphan in case it is destroyed, it is permissible; otherwise, it is not permissible and he must not hassle with the assets of the orphan.’”

Ali ibn Ibrahim has narrated from his father and a number of our people have narrated from Sahl ibn Ziyad from ibn abu Najran from ‘Asem ibn Hamid from Muhammad ibn Qays who has said the following: “Abu Ja‘far (a.s.), has said that ’Amir al-Mu’minin issued a judgment in the case of a pregnant widow who gave birth before the end of four months and ten days and married. The judgment said that she must be left alone and no one must propose to her for marriage until the longer of the two periods of time ends; and thereafter if her family wants they can give her in marriage or keep her, but if they choose to keep her they must return his (one who had married her) assets.’”

Ali ibn Ibrahim has narrated from his father and Muhammad ibn ‘Isma’il has narrated from af-Fadf ibn Shadhan from Ibn Abi ‘Umayr and Safwan from ‘Abd al- Rahman ibn al-Hajjaj who has said the following: “I once asked abu al-Hassan (a.s.), about the case of a man in whose family someone has the assets of orphans and he gives a certain amount of dirham to him that he needs; and the person with whom there are the assets of orphans does not know if he has taken anything from their assets. He thereafter becomes affluent. Is it better for him to give it back to the one who had given him such assets or to the orphan who has reached maturity? Is it sufficient if he gives it to the one from whom he had received the amount in the form of gifts without informing him about his borrowing anything from him? He (the Imam) said, ’Either way is sufficient. To give it as gift to his friend is sufficient because it is of the secret matters, if he had the intention to return to the orphan who has become mature, and in whatever manners he returns even if he does not inform him about his borrowing or if he wants he can return to the one from whom he had received the amount.’ He (the Imam) said, ‘If his friend is absent, he then must return it to the one from whom he had received the amount.’”

A number of our people have narrated from Sahl ibn Ziyad from ibn abu Nasr from Muthanna’ al-Hannat from Zurarah who has said the following: “About the case of a pregnant widow abu ‘Abd Allah (a.s.), has said that she does not have the right to receive maintenance.’” It is also narrated that her maintenance is from the assets of the child in her womb. It is narrated from the narrator of the previous Hadith from Safwan ibn Yahya from ibn Muskan from Muhammad ibn Muslim who has said the following: “I once asked abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a pregnant widow who after childbirth marries before the end of four months and ten days. He (the Imam) said, ‘If the new husband has gone to bed with her he must stay away from her and she must complete the remaining time of the first waiting period and another waiting period for the later (separation). If he has not gone to bed with her they must separate from each other and she must complete the remaining of the first waiting period and he is then one of those who may propose for marriage.’ ” It is narrated from the narrator of the previous Hadith from Ja’far ibn Sama’ah and Ali ibn Khalid al-‘Aquliy from Karram from Muhammad ibn Muslim from abu Ja‘far, ‘Alayhi al-Salam, a similar Hadith.
