What kind of help do you need?’”

Ali ibn Ibrahim has narrated from his father and Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan from all Ibn Abi ‘Umayr from Hafs ibn al-Bakhtariy who has said the following: “This is in regards to my question before abu ‘ Abd Allah (a.s.), about a man who dies when he owes Qada’ (compensatory) Salat (prayer) or fast. He (the Imam) said, The person who has the greatest degree of priority for his legacy carries out its Qada’ (compensatory fast or Salat) on his behalf.’ I then asked, ‘Can such person be a woman?’ He (the Imam) said, ‘No, such person can only be from men.’”

1. A number of our people have narrated from Ahmad ibn Muhammad from ‘Uthman ibn ‘Isa from Sama‘ah who has said the following: “About the words of Allah, most Majestic, most Glorious, ‘One who is poor can eat to the proper limit’, (4:6) abu ‘Abd Allah (a.s.), has said, ‘It is one who manages the properties of orphans but is needy and does not have anything to support himself. He collects debts that people owe to them (orphans) and looks after them, he can eat from their assets only what he needs without excess, but if their assets do not take his time to work for his own-self, then he must not use anything of the properties of the orphans.’”

1. Ali ibn Ibrahim has narrated from his father from al-Husayn ibn Sayf from Muhammad ibn Sulayman who has said the following: “I once asked abu Ja‘far, al-Thaniy (a.s.), saying, ‘I pray to Allah to keep my soul in service for your cause, why is it that waiting period for a woman divorced three times, is three cycles of Hayd (menses) or three months, and the waiting period of a widow is four months and ten days? He (the Imam) said, ‘Waiting period for a woman divorced three times is passing of three Hayd (menses)- free periods. It is to ascertain a womb is free of child and pregnancy. About the waiting period of a widow Allah, most Majestic, most Glorious, has set a condition for and a condition against women. In the condition for them He does not hold them accountable and in the condition against them He has not done injustice to them. In the case of ’Ila’ (swearing not to go to bed with one’s wife) it is four months as Allah, most Majestic, most Glorious, says, ‘. . . for those who swear there is a four month waiting period.’ (2:226) He has not made it permissible for anyone in the case of ‘Ila’ to wait more than four months because He, most Blessed, most High, knows how long women can wait without going to bed and without men. The condition against women is in the case of the death of their husband in which case they must wait for four months and ten days. Thus He has taken from her when he dies as much as He has takes for her from him during his life time in the case of ‘Ila’ as Allah, most Blessed, most High, says, ‘. . . they must wait for four months and ten days.’ He has not mentioned the ten days in waiting period except with four months. He knows that women can wait without men only for four months and without going to bed. For this reason He has set conditions for and against them.’”

A number of our people have narrated from Sahl ibn Ziyad from ibn Mahbub and Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa and Ali ibn Ibrahim has narrated from his father from all ibn Mahbub from al-‘ Ala’ ibn Razin from Muhammad ibn Muslim Muhammad who has narrated the following: “I once asked abu Ja‘far (a.s.), about the case of a man who had a mother who was owned by someone. When it was the time of his death a certain person of our people went and bought his mother. He set the condition that he buys her and sets her free; if after the death of her son so and so, son of so and so, when she will inherit his legacy, she must pay him one-half of what she will inherit. She must promise before Allah and the Messenger of Allah to fulfil this agreement. She agreed and promised before Allah and the Messenger of Allah to act according to the agreement. The man bought and freed her according to the condition and her son died thereafter. She inherited him because there was no other heir except her. Abu Ja‘far (a.s.), has said, ‘He has done a favor to her and has his rewards for it. He is a scholar of fiqh (Islamic laws) and Muslims stand by their conditions. She must complete the agreement about which she has promised before Allah and His messenger.”’

He (the Imam) said, ‘He is not obligated for anything; however, Qada’ (compensatory matters) must be completed on behalf of one who gets well, then dies before completing Qada’ (compensatory matters) of what is missed.’”

2. ‘Uthman has narrated from Sama‘ah who has said the following: “About the words of Allah, most Majestic, most Glorious, ‘If you mix with them then they are your brothers in religion’, abu ‘Abd Allah (a.s.), has said, ‘It is a reference to orphans. If one becomes the person-in-charge of the affairs of orphans, one must take from one’s own assets a certain amount, and equal to this amount from every one of the orphan assets take the same amount; then mix them for the use of all of them together. One must not use anything from their property; it is the fire.’”

Al-Husayn ibn Muhammad has narrated from Mu‘alla’ ibn Muhammad from al-Hassan ibn Ali al-Washsha’ from Aban ibn ‘Uthman from abu Maryam al-Ansariy who has said the following: “Abu ‘Abd Allah (a.s.), has stated this Hadith: ‘If a man fasts certain days of the month of Ramadan during his illness then dies, he is not obligated for anything. However, if he becomes well, then becomes ill then dies and leaves behind a certain amount of asset, for every day, one mud of food must be given on his behalf, and if he has not left behind any assets, his guardian must fast on his behalf.’”

He (the Imam) said, ‘The one who has the greatest degree of priority in the matter about him completes Qada’ (compensatory fast) on his behalf.’ I then asked, ‘Can such person be a woman?’ He (the Imam) said, ‘No, such person can only be from men.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ‘Isma’il from Hanan ibn Sadir who has said the following: “Abu ‘Abd Allah (a.s.), has said that ‘Isa ibn Musa asked about guardians of orphans, camels and what is lawful in matters of camels. I said, ‘If he repairs their water tank, finds the lost ones, scratches their itch, he then is entitled to use their milk without excessive use of their udder or harming their young.’”

Muhammad ibn Yahya has narrated from Muhammad (ibn al-Hassan al-Saffar) who has said the following: “I once wrote to the last (abu Muhammad al-‘Askariy) (a.s.), and asked, ‘A man has died, and owes Qada’ (compensatory fast) of the month of Ramadan which are ten days and has left behind two guardians. Is it permissible that the two together complete Qada’ (compensatory fast) of such fast five days each guardian?’ He (the Imam) signed the answer that said, ‘The eldest of his guardians completes ten days of Qada’ (compensatory fast) as a guardian by the will of Allah.’”

Ahmad ibn Muhammad has narrated from Muhammad ibn al-Fudayl from abu al-Sabbah al-Kinaniy who has said the following: “About the words of Allah, most Majestic, most Glorious, ‘One who is poor can eat within the proper limits’, abu ‘Abd Allah (a.s.), has said, ‘He is a man who holds himself back from making his living (to help the orphans). It is not harmful if he eats within the proper limits when he looks after their properties. If the properties are of a small amount he must not eat thereof.’ I (the narrator) then asked, ‘What is the meaning of the words of Allah, most Majestic, most Glorious, “If you mix then they are your brothers in religion”?’ He (the Imam) said, ‘You must take out from their property an amount that is sufficient for them for a certain time and from your own property a similar amount which is sufficient for you; then you can spend it.’ I then asked about the case where certain ones are smaller and others are bigger and of different amount of expenses for food and clothing. He (the Imam) said, ‘In matters of clothes each individual pays what is spent for that individual, but in matters of food they all share; a small person perhaps uses as much food as a larger one.’”

Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from certain persons of our people from Us ibn al-Qasim who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about an orphan whose income every month is twenty dirham; how I must spend it. He (the Imam) said, ‘Spend what the orphan needs of food and dates.’ I asked if spending one-third is sufficient. He (the Imam) said, ‘Yes, you must spend half of the income.’”
