Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar and Muhammad ibn ’Isma‘il from al-Fadl ibn Shadhan all from Safwan ibn Yahya from ibn Muskan from Ayyub al-Hurr who has said the following: “Abu ‘Abd Allah (a.s.), was asked about one who dies in a ship in the ocean. He (the Imam) said, ‘The deceased is placed in a vat and with its opening sealed is thrown into the water.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has said the following: “One of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhim al-Salam, has said, ’If the wives of the Holy Prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, were not made unlawful for people to marry because of the words of Allah, most Majestic, most Glorious, “You must not cause pain to the Messenger of Allah and never marry his wives after him” (33:53) they were unlawful for al-Hassan and al-Husayn (a.s.), because of the words of Allah, most Majestic, most Glorious, “You must not marry whoever your fathers have married.” (4:22)’”

Al-Husayn from Muhammad has narrated from Mu’alla’ ibn Muhammad from al-Hassan ibn Ali from Aban ibn ‘Uthman from abu al-Jarud who has said the following: “I once heard abu ‘ Abd Allah (a.s.), saying, when this verse was mentioned, ‘We advised the man about his (two fathers) parents’, (29:7) ‘The Messenger of Allah is one of the (two fathers) parents.’ ‘Who is the other (father) parent?’ ‘Abd Allah ibn ‘Ajalan then asked. He (the Imam) replied ‘Ali (a.s.), is the other (father) parent. His women are unlawful to us and this (verse) is especially for us.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Ali ibn abu Hamzah who has said the following: “Abu Basir once asked abu ‘Abd Allah (a.s.), when I was present, ‘How much time is required between two applications (of hair removers)?’ He (the Imam) said, ‘Two Fridays, after fifteen days you can apply again.’”

لَوْ كَانَ نَبِيّاً مَا مَاتَ ابْنُهُ فَأَلْحَقَهَا رَسُولُ اللَّهِ ص بِأَهْلِهَا قَبْلَ أَنْ يَدْخُلَ بِهَا فَلَمَّا قُبِضَ رَسُولُ اللَّهِ ص وَ وُلِّيَ النَّاسَ أَبُو بَكْرٍ أَتَتْهُ الْعَامِرِيَّةُ وَ الْكِنْدِيَّةُ وَ قَدْ خُطِبَتَا فَاجْتَمَعَ أَبُو بَكْرٍ وَ عُمَرُ فَقَالا لَهُمَا اخْتَارَا إِنْ شِئْتُمَا الْحِجَابَ وَ إِنْ شِئْتُمَا الْبَاهَ فَاخْتَارَتَا الْبَاهَ فَتَزَوَّجَتَا فَجُذِمَ أَحَدُ الرَّجُلَيْنِ وَ جُنَّ الْآخَرُ. - قَالَ عُمَرُ بْنُ أُذَيْنَةَ فَحَدَّثْتُ بِهَذَا الْحَدِيثِ زُرَارَةَ وَ الْفُضَيْلَ فَرَوَيَا عَنْ أَبِي جَعْفَرٍ ع‌ أَنَّهُ قَالَ مَا نَهَى اللَّهُ عَزَّ وَ جَلَّ عَنْ شَيْ‌ءٍ إِلَّا وَ قَدْ عُصِيَ فِيهِ حَتَّى لَقَدْ نَكَحُوا أَزْوَاجَ النَّبِيِّ ص مِنْ بَعْدِهِ وَ ذَكَرَ هَاتَيْنِ الْعَامِرِيَّةَ وَ الْكِنْدِيَّةَ ثُمَّ قَالَ أَبُو جَعْفَرٍ ع لَوْ سَأَلْتَهُمْ عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً فَطَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا أَ تَحِلُّ لِابْنِهِ لَقَالُوا لَا فَرَسُولُ اللَّهِ ص أَعْظَمُ حُرْمَةً مِنْ آبَائِهِمْ.

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from ‘Umar ibn ‘Udhaina who has said the following: “Sa‘ad ibn Abu ‘Urwah narrated to me from al-Hassan al-Basri that the Messenger of Allah (saww) married a woman from the tribe of Banu ’Amir ibn Sa‘sa‘ah called Sana’ and she was the most beautiful among women of her time. When ‘A’isha and Hafsa looked at her they said that she will dominate them before the Messenger of Allah because of her beauty. They said to her, ‘The Messenger of Allah does not show any interest in you.’ When she went to the Messenger of Allah (saww) he (the Messenger of Allah) took her in his hand and she said, ‘I seek refuge with Allah.’ The hand of the Messenger of Allah moved away from her and he divorced her and sent her to her family. The Messenger of Allah (saww) married a woman from Kindah who was a daughter of Abu al-Jawn. When Ibrahim, son of the Messenger of Allah from Maria the Coptic died, she said, ‘Had he been a prophet, his son would not die.’ The Messenger of Allah (saww) sent her to her family before going to bed with her. When the Messenger of Allah passed away and Abu Bakr took charge of the affairs of the people; al-‘Amiriya and al-Kindah women who had proposed for marriage came to him. Abu Bakr and ‘Umar had a meeting and they said to the women, ‘You can choose the veil or sexual satisfaction.’ They chose sexual satisfaction and married but one of the men contracted leprosy and the other man became insane. ‘Umar ibn ‘Udhaina has said, ‘I narrated this Hadith to Zurarah and al-Fudayl and they narrated it from Abu Ja‘far (a.s.), who has said, ‘Whatever Allah, most Majestic, most Glorious, prohibited He is disobeyed in it so much so that they even married the wives of the Holy Prophet (saww) after him and he (the Imam) mentioned the two women, al-‘Amiriya and al-Kindiyah. Abu Ja‘far (a.s.), then said, ‘If you ask them about the case of a man who marries a woman then divorces her before going to bed with her if she is lawful for his son, they will say, ’No. It is not lawful.’ The Messenger of Allah (saww) is greater than their fathers in matters of unlawfulness in such case.'"

قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع مَا تَقُولُ فِي قَوْمٍ كَانُوا فِي سَفَرٍ فَهُمْ يَمْشُونَ عَلَى سَاحِلِ الْبَحْرِ فَإِذَا هُمْ بِرَجُلٍ مَيِّتٍ عُرْيَانٍ قَدْ لَفَظَهُ الْبَحْرُ وَ هُمْ عُرَاةٌ لَيْسَ عَلَيْهِمْ إِلَّا إِزَارٌ كَيْفَ يُصَلُّونَ عَلَيْهِ وَ هُوَ عُرْيَانٌ وَ لَيْسَ مَعَهُمْ فَضْلُ ثَوْبٍ يُكَفِّنُونَهُ فِيهِ قَالَ يُحْفَرُ لَهُ وَ يُوضَعُ فِي لَحْدِهِ وَ يُوضَعُ اللَّبِنُ عَلَى عَوْرَتِهِ لِتَسْتُرَ عَوْرَتُهُ بِاللَّبِنِ ثُمَّ يُصَلَّى عَلَيْهِ ثُمَّ يُدْفَنُ قَالَ قُلْتُ فَلَا يُصَلَّى عَلَيْهِ إِذَا دُفِنَ قَالَ لَا يُصَلَّى عَلَى الْمَيِّتِ بَعْدَ مَا يُدْفَنُ وَ لَا يُصَلَّى عَلَيْهِ وَ هُوَ عُرْيَانٌ حَتَّى تُوَارَى عَوْرَتُهُ.

4. A number of our people have narrated from Ahmad ibn Muhammad ibn abu Nasr from Marwan ibn Muslim from ‘Ammar ibn Musa who has said the following: “I once asked abu ‘Abd Allah (a.s.), ‘What do you say about a people who walk during a journey on the sea shore; they find a dead man who is naked, thrown out by the ocean and they also are naked except for a loin cloth on them; how do they perform Salah (prayer) for him when he is naked? They do not have extra clothes with them to use as shroud for him. He (the Imam) said, ‘A grave is dug and he is placed in it and with a piece of brick placed on his private parts, Salah (prayer) is performed for him and then he is buried.’ I (the narrator) asked. ‘Can Salah (prayer) be made after he is buried? He (the Imam) said, ‘Once a deceased is buried Salah (prayer) is not performed, nor when he is naked and before his private parts are covered.’”

4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Musa ibn Bakr from Zurarah ibn ‘A‘yan who has said the following: “Zurarah has narrated a Hadith similar to the previous Hadith from Abu Ja’far (a.s.), and he (the Imam) has said, ’They do not consider it lawful to marry their mothers if they are believers. The wives of the Messenger of Allah (sw) in the matter of the above unlawfulness are like their mothers.’”

A number of our people have narrated from Sahl ibn Ziyad from Ali ibn Mahziyar who has said the following: “Once al-Hassan ibn Sa‘id wrote to abu al-Hassan (a.s.), about a man who assumes the state of Ihram without Ghusl (bath) or without Salat (prayer) knowingly, or is ignorant, and what he owes and what should he do? He (the Imam) wrote in answer, ‘He must assume the state of Ihram again.’”

كُنَّا بِالْمَدِينَةِ فَلَاحَانِي‌ زُرَارَةُ فِي نَتْفِ الْإِبْطِ وَ حَلْقِهِ فَقُلْتُ حَلْقُهُ أَفْضَلُ وَ قَالَ زُرَارَةُ نَتْفُهُ أَفْضَلُ فَاسْتَأْذَنَّا عَلَى أَبِي عَبْدِ اللَّهِ ع فَأَذِنَ لَنَا وَ هُوَ فِي الْحَمَّامِ يَطَّلِي وَ قَدِ اطَّلَى إِبْطَيْهِ فَقُلْتُ لِزُرَارَةَ يَكْفِيكَ قَالَ لَا لَعَلَّهُ فَعَلَ هَذَا لِمَا لَا يَجُوزُ لِي أَنْ أَفْعَلَهُ فَقَالَ فِيمَا أَنْتُمَا فَقُلْتُ إِنَّ زُرَارَةَ لَاحَانِي فِي نَتْفِ الْإِبْطِ وَ حَلْقِهِ قُلْتُ حَلْقُهُ أَفْضَلُ وَ قَالَ زُرَارَةُ نَتْفُهُ أَفْضَلُ فَقَالَ أَصَبْتَ السُّنَّةَ وَ أَخْطَأَهَا زُرَارَةُ حَلْقُهُ أَفْضَلُ مِنْ نَتْفِهِ وَ طَلْيُهُ أَفْضَلُ مِنْ حَلْقِهِ ثُمَّ قَالَ لَنَا اطَّلِيَا فَقُلْنَا فَعَلْنَا مُنْذُ ثَلَاثٍ فَقَالَ أَعِيدَا فَإِنَّ الِاطِّلَاءَ طَهُورٌ.

6. Certain persons of our people have narrated from ibn Jumhur from Muhammad ibn al-Qasim ibn from ‘Abd Allah ibn abu Ya’fur who has said the following: “Once we were in al-Madinah. Zurarah insisted about plucking out or shaving the hairs of underarms. I said shaving is better and he said, plucking out is better. We asked permission to see abu ‘Abd Allah (a.s.). Permission was granted and he was in the shower applying the paste (to remove hairs). He (the Imam) had applied it to his underarms. I said to Zurarah that it is sufficient. He said, ‘Perhaps he (the Imam) did what was not permissible for me to do.’ He (the Imam) asked, ‘What is the issue between you two people?’ I replied, ‘Zurarah insists about plucking out or shaving.’ I said to him that shaving is better and Zurarah says that plucking out is better. He (the Imam) said, ‘You have found the Sunnah and Zurarah has missed it. Shaving is better than plucking it out, and using paste is better than shaving.’ He (the Imam) then said apply paste. We said, ‘It is three days that we have applied it. He (the Imam) said, ‘Apply again; applying paste is cleansing.’”

2. Humayd ibn Ziyad has narrated from al-Hassan ibn Muhammad from more than one person from Aban from a man who has said the following: “Abu ‘Abd Allah (a.s.), was asked about one who dies in the company of people in the ocean. He (the Imam) said, ‘Ghusl (bath), shroud and Salah (prayer) are done for him and with some weight tied to him is thrown in the ocean.’”

A number of our people have narrated from Sahl ibn Ziyad in a marfu‘ manner has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘If one dies in a ship and it is not possible to bring him to the shore, shroud and hunut are done for him, after wrapping in a piece of cloth, is thrown into the water.’”
