سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنْ رَجُلٍ نَسِيَ أَنْ يُحْرِمَ حَتَّى دَخَلَ الْحَرَمَ قَالَ قَالَ أَبِي يَخْرُجُ إِلَى مِيقَاتِ أَهْلِ أَرْضِهِ فَإِنْ خَشِيَ أَنْ يَفُوتَهُ الْحَجُّ أَحْرَمَ مِنْ مَكَانِهِ فَإِنِ اسْتَطَاعَ أَنْ يَخْرُجَ مِنْ الْحَرَمِ فَلْيَخْرُجْ ثُمَّ لْيُحْرِمْ.

1. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “I once asked abu ‘ Abd Allah (a.s.), about a man who forgets to assume the state of Ihram until he enters al-Haram (the sacred area). He (the Imam) said, ‘My father has said that he must go out to Miqat (place for assuming the state of Ihram) of the people of his land. If he is afraid of missing the season of al-Hajj, he then must assume the state of Ihram from where he is. If he can go out of al- Haram (the sacred area), he must do so to assume the state of Ihram.”’

2. Ali ibn Ibrahim has narrated from his father from Ahmad ibn Muhammad ibn abu Nasr from Jamil ibn Darraj from Muhammad ibn Muslim who has said the following: “Abu Ja‘far (a.s.), has said, ‘If one is killed and only flesh without bones are found, Salah (prayer) is not obligatory for it. If bones without flesh are found, there is Salah (prayer) for it.’” He (the narrator) has said, ‘It is narrated that Salah (prayer) is not obligatory for a head found without the body.’”

2. A number of our people have narrated from Ahmad ibn Muhammad from al-Husayn ibn Sa‘id from Safwan ibn Yahya who has said the following: “I once wrote to abu al-Hassan al-Rida’ ‘Alayhi al-Salam, saying, ‘Certain people of your followers from Basrah assume the state of Ihram at Batn al-‘Aqiq. There is no water at that place or station. It makes things very difficult for them, their companions rush them as well as camel men. Fifteen miles after that place is a station, which has water where they disembark. If you consider it proper, instruct them to assume the state of Ihram at this place, which makes things easier for them. He (the Imam) wrote, ‘The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, designated Mawaqit (places for assuming the state of Ihram) for their people as well as those who pass through them. However, there is permission for people who have difficulty and illness. It is not permissible to pass Miqat (place for assuming the state of Ihram) without acceptable reason (excuse).”’

2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ‘Isma’il who has said the following: “I once asked al-Rida’ (a.s.), about the case of a man who had a slave-girl and he kissed her; if she was lawful for his sons. He (the Imam) asked, ‘Was it with lust?’ I replied, ‘Yes, it was with lust.’ He (the Imam) said, ‘He then has left nothing if he has kissed with lust.’ He (the Imam) then initiating said, ‘If he makes her bare and looks at her with lust she becomes unlawful to marry for his father and his son.’ I then asked, ‘What happens if he looks at her body?’ He (the Imam) said, ‘If he looks at her vagina and body with lust she becomes unlawful for him.’”

A number of our people have narrated from Ahmad ibn Muhammad ibn Khalid from his father from certain persons of his people who has said the following: “Abu ’Abd Allah (a.s.), has said, ‘A man who is found being killed, if there is a complete part of the body, it is buried after Salah (prayer) for it. If a complete part is not found it is buried without Salah (prayer).’”

A number of our people have narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Sayf ibn ‘Amirah from abu Bakr al- Hadramiy who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘I once went out (for al-Hajj) with my family walking and did not assume the state of Ihram until al-Juhfah. I had complaints (due to difficulties). People of al-Madinah kept questioning me saying, ‘We met him with his (regular) clothes on him.’ They know that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has given permission to those who suffer from an illness or are weak to assume the state of Ihram at al-Juhfah.’”

4. A number of our people have narrated from Sahl ibn Ziyad from Ayyub ibn Nuh in a marfu‘ manner who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘If a piece is cut from a man, it is dead. In case of one’s touching, whatever piece has bone in it Ghusl (bath) becomes obligatory, if bone is not found in it, Ghusl (bath) is not obligatory.’”

سُئِلَ أَبُو عَبْدِ اللَّهِ ع وَ أَنَا عِنْدَهُ عَنْ رَجُلٍ اشْتَرَى جَارِيَةً وَ لَمْ يَمَسَّهَا فَأَمَرَتِ امْرَأَتُهُ ابْنَهُ وَ هُوَ ابْنُ عَشْرِ سِنِينَ أَنْ يَقَعَ عَلَيْهَا فَوَقَعَ عَلَيْهَا فَمَا تَرَى فِيهِ فَقَالَ أَثِمَ الْغُلَامُ وَ أَثِمَتْ أُمُّهُ وَ لَا أَرَى لِلْأَبِ إِذَا قَرِبَهَا الِابْنُ أَنْ يَقَعَ عَلَيْهَا قَالَ وَ سَأَلْتُهُ عَنْ رَجُلٍ يَكُونُ لَهُ جَارِيَةٌ فَيَضَعُ أَبُوهُ يَدَهُ عَلَيْهَا مِنْ شَهْوَةٍ أَوْ يَنْظُرُ مِنْهَا إِلَى مُحَرَّمٍ مِنْ شَهْوَةٍ فَكَرِهَ أَنْ يَمَسَّهَا ابْنُهُ‌.

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from ‘Abd Allah ibn Yahya al-Kahiliy who has said the following: “Once abu ‘Abd Allah (a.s.), was asked, when I was with him (the Imam), about the case of a man who bought a slave-girl but did not touch her. His wife commanded his son, who was ten years old, to fall on her (for sexual intercourse) and he did it, now what do you say about it. He (the Imam) said, ‘The boy has sinned as well as his mother and it is not permissible for the father, after his son’s going near her, to fall on her.’ I then asked him (the Imam) about the case of a man who has a slave-girl and his father places his hand on her with lust or looks where it is not permissible to look with lust. He (the Imam) disliked his son’s touching her.’”

[1]يدل على أن زنا الابن بالجارية قبل دخول الأب يوجب التحريم على الأب و إن كان الابن صغيرا بل لا يبعد القول بأن هذا أظهر في التحريم لان فعله لا يوصف بالحرمة و لا يمكن مقايسة الكبير عليه و ربما يستدل على ما هو المشهور من عدم تحريم الملموسة و المنظورة لظاهر لفظ الكراهة و فيه نظر اذ الكراهة في الاخبار غير ظاهرة في المعنى المشهور.( آت)ص 419

5. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad, from ibn Faddal from ibn Bukayr from Zurarah from certain persons of our people who performed al-Hajj with a woman with them. They arrived at Miqat (place for assuming the state of Ihram) and she did not perform Salat (prayer). They did not know that one like her must assume the state of Ihram; so they continued on their journey with her in the same condition, until they arrived in Makkah and she experienced Hayd (menses) and without Ihram. They asked people about it and they said that she must go to any one of Miqat to assume the state of Ihram; but in so doing she could not be in time for al-Hajj. They asked abu Ja‘far (a.s.), and he (the Imam) said, ‘She must assume the state of Ihram from where she is, Allah had full knowledge of her intention.’”

Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan from ‘Abd Allah ibn Sinan who has said the following: “I once asked abu ‘Abd Allah (a.s.), about a man who passed through Miqat (place for assuming the state of Ihram). He forgot or was ignorant; so he did not assume the state of Ihram until he entered Makkah, then he was afraid of not being able to come back in time for al-Hajj . He (the Imam) said, ‘He must go outside al-Haram (the sacred area) to assume the state of Ihram and it is sufficient.’”

If he goes to bed with a slave-girl who is lawful thereafter she becomes unlawful forever to his son and father. If a man marries a woman in a lawful way, that woman is not lawful for his father and son for marriage.

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Jamil ibn Darraj from certain persons of our people who has said the following: “If one forgets to assume the state of Ihram or is ignorant, attends all places for performing the acts of al-Hajj such as Tawaf, Sa‘y between al-Safa’ and al-Marwah and so on, one of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhim al-Salam, has said, ‘His intention is sufficient. If he had such intention, his Hajj is complete even though he did not say Talbiyah.’ About the case of a man who fainted due to illness until Miqat (place for assuming the state of Ihram), he (the Imam) said, ‘He must assume the state of Ihram.’”

A number of our people have narrated from Sahl ibn Ziyad from Musa ibn Ja’far from “Amr ibn Sa‘id from Musaddiq ibn Sadaqah from ‘Ammar who has said the following: “About the case of a man who has a slave-girl and his grandson falls on her (does sexual intercourse) before his grandfather or that a man commits fornication with a woman; if she is lawful for his father to marry, abu ‘Abd Allah (a.s.), said, ‘No, it is not permissible. Only if the man marries her and goes to bed with her then his son commits fornication with her it does not harm him because unlawful does not make lawful ones unlawful and so also is the case of the slave-girl.’”

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ امْرَأَةٍ كَانَتْ مَعَ قَوْمٍ فَطَمِثَتْ فَأَرْسَلَتْ إِلَيْهِمْ فَسَأَلَتْهُمْ فَقَالُوا مَا نَدْرِي أَ عَلَيْكِ إِحْرَامٌ أَمْ لَا وَ أَنْتِ حَائِضٌ فَتَرَكُوهَا حَتَّى دَخَلَتِ الْحَرَمَ قَالَ إِنْ كَانَ عَلَيْهَا مُهْلَةٌ فَلْتَرْجِعْ إِلَى الْوَقْتِ فَلْتُحْرِمْ مِنْهُ وَ إِنْ لَمْ يَكُنْ عَلَيْهَا وَقْتٌ فَلْتَرْجِعْ إِلَى مَا قَدَرَتْ عَلَيْهِ بَعْدَ مَا تَخْرُجُ مِنَ الْحَرَمِ بِقَدْرِ مَا لَا يَفُوتُهَا.

10. Safwan has narrated from Mu‘awiyah who has said the following: “I once asked abu ‘Abd Allah (a.s.), about the case of a woman who, with a people, experienced Hayd (menses), and asked them about it; but they did not know if she was required to assume the state of Ihram or not, so they left her in her condition until she entered al-Haram (the sacred area). He (the Imam) said, ‘If she has enough time, she must go to Miqat (place for assuming the state of Ihram) to assume the state of Ihram. If she does not have enough time, she must return back as much as she can after leaving al-Haram (the sacred area) so that she does not miss the rest of the acts of her al-Hajj.’”

11. Ali ibn Ibrahim has narrated from his father from ‘Abd Allah ibn al-Mughirah from Ahmad ibn ‘Amr ibn Sa‘id from Wardan from Abu al-Hassan al-Awwal (a.s.) who said, “Whoever lives at a distance of ten miles from Makkah must not enter it except in a state of Ihram.”

12. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Jamil ibn Darraj from Sawrah ibn Kulayb who has said the following: “I once asked abu ‘ Abd Allah (a.s.), about the case of a woman of our family who was with us and was ignorant of Ihram, so she did not assume the state of Ihram until we entered Makkah and we forgot to tell her about it. He (the Imam) said, ‘You can instruct her to assume the state of Ihram from wherever she is in Makkah or the Masjid.”’
