عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادِ بْنِ عُثْمَانَ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ع‌ فِي قَوْلِ اللَّهِ عَزَّ وَ جَلَّ- الْحَجُّ أَشْهُرٌ مَعْلُوماتٌ فَمَنْ فَرَضَ فِيهِنَّ الْحَجَ‌ فَلا رَفَثَ‌ وَ لا فُسُوقَ‌ وَ لا جِدالَ‌ فِي الْحَجِ‌ فَقَالَ

إِنَّ اللَّهَ عَزَّ وَ جَلَّ اشْتَرَطَ عَلَى النَّاسِ شَرْطاً وَ شَرَطَ لَهُمْ شَرْطاً قُلْتُ فَمَا الَّذِي اشْتَرَطَ عَلَيْهِمْ وَ مَا الَّذِي اشْتَرَطَ لَهُمْ فَقَالَ أَمَّا الَّذِي اشْتَرَطَ عَلَيْهِمْ فَإِنَّهُ قَالَ‌ الْحَجُّ أَشْهُرٌ مَعْلُوماتٌ فَمَنْ فَرَضَ‌ فِيهِنَّ الْحَجَّ فَلا رَفَثَ وَ لا فُسُوقَ وَ لا جِدالَ فِي الْحَجِ‌ وَ أَمَّا مَا شَرَطَ لَهُمْ فَإِنَّهُ قَالَ- فَمَنْ تَعَجَّلَ فِي يَوْمَيْنِ فَلا إِثْمَ عَلَيْهِ وَ مَنْ تَأَخَّرَ فَلا إِثْمَ عَلَيْهِ لِمَنِ اتَّقى‌ قَالَ يَرْجِعُ لَا ذَنْبَ لَهُ قَالَ قُلْتُ أَ رَأَيْتَ مَنِ ابْتُلِيَ بِالْفُسُوقِ مَا عَلَيْهِ قَالَ لَمْ يَجْعَلِ اللَّهُ لَهُ حَدّاً يَسْتَغْفِرُ اللَّهَ وَ يُلَبِّي قُلْتُ فَمَنِ ابْتُلِيَ بِالْجِدَالِ مَا عَلَيْهِ قَالَ إِذَا جَادَلَ فَوْقَ مَرَّتَيْنِ فَعَلَى الْمُصِيبِ دَمٌ يُهَرِيقُهُ وَ عَلَى الْمُخْطِئِ بَقَرَةٌ.

1. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad ibn ‘Uthaman from al-Halabiy who has said the following: “This is about the words of Allah, most Majestic, most Glorious, ‘The months of al-Hajj are well known. Those who make al-Hajj obligatory upon themselves in these months, must take notice that there is no sexual relation, lying and swearing in al-Hajj.’ (2:196) Abu ‘Abd Allah (a.s.), has said, ‘Allah, most Majestic, most Glorious, has set one condition against people and one condition for them.’ I then asked, ‘What is the condition against them and what is for them?’ He (the Imam) said, ‘The one against them is, “The months of al-Hajj are well known. Those who make al-Hajj obligatory upon themselves in these months must take notice that there is no sexual relation, lying and swearing in al-Hajj” and the one for them is, “Those who are two days earlier, it is not a sin and those who are two days later, it is not a sin for those who observe piety.’” (2:202) He (the Imam) said, ‘He comes back with no sins on him.’ I then asked, ‘What is against one who sins?’ He (the Imam) said, ‘What is against him is not definite but he must plead for forgiveness and say Talbiyah.’ I then asked, ‘What is against one who quarrels?’ He (the Imam) said, ‘If one quarrels and argues more than twice because of it if true there is one animal to offer as expiation and if wrong, there is one cow to slaughter as expiation.’”

الْمُلَاعَنَةُ إِذَا لَاعَنَهَا زَوْجُهَا لَمْ تَحِلَّ لَهُ أَبَداً وَ الَّذِي يَتَزَوَّجُ الْمَرْأَةَ فِي عِدَّتِهَا وَ هُوَ يَعْلَمُ لَا تَحِلُّ لَهُ أَبَداً وَ الَّذِي يُطَلِّقُ الطَّلَاقَ الَّذِي لَا تَحِلُّ لَهُ‌ حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ‌ ثَلَاثَ مَرَّاتٍ وَ تَزَوَّجَ ثَلَاثَ مَرَّاتٍ لَا تَحِلُّ لَهُ أَبَداً وَ الْمُحْرِمُ إِذَا تَزَوَّجَ وَ هُوَ يَعْلَمُ أَنَّهُ حَرَامٌ عَلَيْهِ لَمْ تَحِلَّ لَهُ أَبَداً.

1. A number of our people have narrated from Sahl ibn Ziyad and Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad all from Ahmad ibn Muhammad from ibn abu Nasr from al-Muthanna’ from Zurarah ibn ‘A‘yan from Dawud ibn Sarhan from abu ‘Abd Allah (a.s.), and ‘Abd Allah ibn Bukayr from ‘Udaym Bayya’ al-Harawiy who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘A woman who because of al-Mula‘inah (condemnation) when it (condemnation) is from the husband becomes unlawful for marriage for him forever; a woman who is married during her waiting period knowing all about her condition becomes unlawful for him forever; a woman divorced three times in a way whereafter he can only marry her again after her marriage with another man, remarry her three times, each time after the above process, she then becomes unlawful for him forever and a woman whom one marries in the state of Ihram knowing that it is unlawful becomes unlawful for him forever.’”

A number of our people have narrated from Ahmad ibn Muhammad from al-Husayn ibn Sa‘id from al-Nadr ibn Suwayd from ‘Abd Allah ibn Sinan who has said the following: “About the words of Allah, most Majestic, most Glorious, ‘Complete al-Hajj and al-‘Umrah for the sake of Allah,’ (2:195) he (the Imam) (a.s.), has said, ‘The completion means, no sexual relation, lying and swearing in al-Hajj.’”

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘If one marries a woman during her waiting period and goes to bed with her, she becomes unlawful for him forever, regardless, he knows or not, but if he has not gone to bed with her, she is lawful for the one ignorant of her condition and is unlawful for the other (one who knows her condition).”’

Al-Husayn ibn Muhammad has narrated from ’Abd Allah ibn ‘Amir from Ali ibn Mahziyar from Ali ibn Isma’il al-Mithamiy from Rib‘i ibn ‘Abd Allah who has said the following: “Abu ‘Abd Allah (a.s.), has said that patience and misfortune race toward a believing person but misfortune finds him exercising patience. Outcry and impatience race toward an unbeliever person and misfortune finds him in outcry and impatience.”

3. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar and Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan all from Safwan from ‘Abd al-Rahman ibn al-Hajjaj who has said the following: “I once asked abu Ibrahim (a.s.), about the case of a man who married a woman during her waiting period because of ignorance; if she became unlawful for him forever. He (the Imam) said, ‘No, if marriage is because of ignorance he must marry her again after the waiting period is complete; people due to ignorance are sometimes forgiven even for an issue bigger than this.’ I then asked, ‘Of the two which ignorance is excused, ignorance of its unlawfulness or ignorance of her being in the waiting period?’ He (the Imam) said, ‘Of the two the ignorance which is easier is excused, and it is ignorance of the fact that Allah has made it unlawful because with it he cannot maintain precaution.’ I then asked, ‘Will he because of such ignorance be excused on the Day of Judgment?’ He (the Imam) said, ‘Yes, when her waiting period is complete he is excused if he marries her.’ I then asked, ‘What happens if one knows and the other is ignorant?’ He (the Imam) said, ‘The one who knowingly has done it can never return to his companion.’”

Ali ibn Ibrahim has narrated from his father, from al-Nawfaliy from al-Sakuniy who has said the following: “Abu ‘Abd Allah (a.s.), has said that the Messenger of Allah has said, ‘If a Muslim strikes his hand against his thigh due to suffering and sorrow, it causes his deeds to become void and fruitless.’”

Al-Husayn ibn Muhammad has narrated from Mu‘alla’ ibn Muhammad from al-Hassan ibn Ali from Aban ibn ‘Uthman from abu Basir who has said the following: “One of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhim al-Salam, has said, ’If one swears three times, one immediately after the other and they are true, he has committed Jidal (swearing) and he owes one animal offering. If one swears one false swearing, he has committed Jidal (swearing) and he owes one animal offering/”

سَأَلْتُهُ عَنِ الْمَرْأَةِ الْحُبْلَى يَمُوتُ زَوْجُهَا فَتَضَعُ وَ تَزَوَّجُ قَبْلَ أَنْ تَمْضِيَ لَهَا أَرْبَعَةُ أَشْهُرٍ وَ عَشْراً فَقَالَ إِنْ كَانَ دَخَلَ بِهَا فُرِّقَ بَيْنَهُمَا ثُمَّ لَمْ تَحِلَّ لَهُ أَبَداً وَ اعْتَدَّتْ بِمَا بَقِيَ عَلَيْهَا مِنَ الْأَوَّلِ وَ اسْتَقْبَلَتْ عِدَّةً أُخْرَى مِنَ الْآخَرِ ثَلَاثَةَ قُرُوءٍ وَ إِنْ لَمْ يَكُنْ دَخَلَ بِهَا فُرِّقَ بَيْنَهُمَا وَ اعْتَدَّتْ بِمَا بَقِيَ عَلَيْهَا مِنَ الْأَوَّلِ وَ هُوَ خَاطِبٌ مِنَ الْخُطَّابِ.

4. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a woman who is pregnant and her husband dies. She gives birth and marries before the passing of four months and ten days. He (the Imam) said, ‘If he has gone to bed with her, they must be separated from each other and she will be unlawful for him forever. She must complete the remaining of her waiting period and complete another waiting period from the end of that for three cycles of menses, but if he has not gone to bed with her, they must separated from each other and she must complete the remaining of her waiting period and he then is one of the people who can propose to her for marriage.’”

مَا مِنْ عَبْدٍ يُصَابُ بِمُصِيبَةٍ فَيَسْتَرْجِعُ عِنْدَ ذِكْرِهِ الْمُصِيبَةَ وَ يَصْبِرُ حِينَ تَفْجَأُهُ إِلَّا غَفَرَ اللَّهُ لَهُ مَا تَقَدَّمَ مِنْ ذَنْبِهِ وَ كُلَّمَا ذَكَرَ مُصِيبَتَهُ فَاسْتَرْجَعَ عِنْدَ ذِكْرِ الْمُصِيبَةِ غَفَرَ اللَّهُ لَهُ كُلَّ ذَنْبٍ اكْتَسَبَ فِيمَا بَيْنَهُمَا.

5. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from ‘Abd Allah ibn Sinan from Ma’ruf ibn Kharrabuz who has said the following: “Abu Ja’far (a.s.), has said, ‘Whoever of the servants (of Allah) after suffering a misfortune, upon recalling any of his suffering and sorrow, acknowledges it and exercises patience, if it befalls him suddenly, Allah forgives his past sins. Whenever thereafter upon recalling any of his suffering sorrow acknowledges it (saying ‘to Allah we belong and to Him we return’), Allah forgives his sins that may have taken place in between (the two occasions of recalling).”’

Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan from ‘Abd Allah ibn Muskan from abu Basir who has said the following: “I once asked him (the Imam) (a.s.), about a man who in the state of Ihram wants to do something and says to his friend, ’By Allah, you must not do it.’ He says, ’By Allah, I certainly want to do it.’ He opposes him several times. What does the swearing one owe? He (the Imam) said, ‘No, by this he meant to respect his brother. That which involves expiation is when Allah is disobeyed thereby.’”

A number of our people have narrated from Sahl ibn Ziyad and Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad all from Ahmad ibn Muhammad from ibn abu Nasr from ‘Abd al-Karim from Muhammad ibn Muslim who has said the following: “I once asked abu Ja’far (a.s.), about the case of a woman who was pregnant and her husband died. She gave birth and married before the passing of four months and ten days. He (the Imam) said, ‘If the one who has married has gone to bed with her, they must separate from each other and she is not lawful for him forever. She must complete the remaining of her first waiting period and complete another waiting period in future for three cycles of menses; but if he has not gone to bed with her, they must separate from each other and she must complete the remaining of her waiting period. He then is one of those who can propose to her for marriage.’”

Ali has narrated from his father from Ibn Abi ‘Umayr from Dawud ibn Razin who has said the following: “Abu ‘Abd Allah (a.s.), has said that if one recalls his suffering a misfortune even after a long time and says, ‘To Allah we belong and to Him we return, all praise belongs to Allah Lord of the worlds; O Lord, grant me favors for my suffering a misfortune and replace my losses with something better,’ his reward for this is equal to that he deserved upon suffering it the first time.”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad and Muhammad ibn al-Husayn from ‘Uthman ibn ‘Isa from Sama‘ah and ibn Muskan from Sulayman ibn Khalid who has said the following: “I once asked him (the Imam) (a.s.), about the case of a man who married a woman during her waiting period. He (the Imam) said, ‘They must separate from each other; and if he has gone to bed with her he must pay mahr (dower) for making his going to bed with her lawful. They must separate from each other and she is not lawful for him forever. If he has not gone to bed with her she does not have any mahr (dower).”’

A number of our people have narrated from Sahl ibn Ziyad and Muhammad ibn Yahya from Ahmad ibn Muhammad from ibn Mahbub from Ishaq ibn ‘Ammar who has said the following: “Abu ’Abd Allah (a.s.), has said that, O Ishaq, do not count a misfortune in which you were granted patience, thus you deserved reward from Allah, the Most Majestic, the Most Glorious. A misfortune is that in which due to acting impatiently, one is deprived of rewards for that suffering.”

7. Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan from and Ali ibn Ibrahim has narrated from his father all from Ibn Abi ‘Umayr from Jamil ibn Darraj from abu ‘Abd Allah (a.s.), and Ibrahim ibn ‘Abd al-Hamid from abu ‘Abd Allah, and abu al-Hassan, recipients of divine supreme covenant, who has said the following: “Abu ‘Abd Allah, and abu al-Hassan, ‘Alayhim al-Salam, have said, ‘If a man (1) divorces a woman then remarries her, then (2) he divorces and the same husband marries her, then (3) divorces her and another man marries her then this man divorces her and the first man marries her then the first husband divorces her in the same way up to three times, she thereafter becomes unlawful for him forever.’”

فِي رَجُلٍ نَكَحَ امْرَأَةً وَ هِيَ فِي عِدَّتِهَا قَالَ يُفَرَّقُ بَيْنَهُمَا ثُمَّ تَقْضِي عِدَّتَهَا فَإِنْ كَانَ دَخَلَ بِهَا فَلَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا وَ يُفَرَّقُ بَيْنَهُمَا وَ إِنْ لَمْ يَكُنْ دَخَلَ بِهَا فَلَا شَيْ‌ءَ لَهَا قَالَ وَ سَأَلْتُهُ عَنِ الَّذِي يُطَلِّقُ ثُمَّ يُرَاجِعُ ثُمَّ يُطَلِّقُ ثُمَّ يُرَاجِعُ ثُمَّ يُطَلِّقُ قَالَ لَا تَحِلُّ لَهُ‌ حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ‌ فَيَتَزَوَّجُهَا رَجُلٌ آخَرُ فَيُطَلِّقُهَا عَلَى السُّنَّةِ ثُمَّ تَرْجِعُ إِلَى زَوْجِهَا الْأَوَّلِ فَيُطَلِّقُهَا ثَلَاثَ مَرَّاتٍ عَلَى السُّنَّةِ فَتَنْكِحُ زَوْجاً غَيْرَهُ فَيُطَلِّقُهَا ثُمَّ تَرْجِعُ إِلَى زَوْجِهَا الْأَوَّلِ فَيُطَلِّقُهَا ثَلَاثَ مَرَّاتٍ عَلَى السُّنَّةِ ثُمَّ تَنْكِحُ فَتِلْكَ الَّتِي لَا تَحِلُّ لَهُ أَبَداً وَ الْمُلَاعَنَةُ لَا تَحِلُّ لَهُ أَبَداً.

9. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Ali ibn abu Hamzah from abu Basir who has said the following: “About the case of a man who marries a woman during her waiting period, abu ‘Abd Allah (a.s.), has said, ‘They must separate from each other and she must complete her waiting period. If he has gone to bed with her he must pay mahr (dower) for his going to bed and they must separate from each other. If he has not gone to bed with her then she has no mahr (dower). He (the narrator) has said, ‘I then asked him (the Imam) about the case of a man who divorced then returned to his wife then divorced and then returned then divorced.’ He (the Imam) said, ‘She is not lawful for him until she marries another man and who divorces her according to the Sunnah then she returns to her first husband who divorces her three times according to the Sunnah then she marries another man then she marries. Such woman is the one who becomes unlawful for him forever and because of al-Mula‘inah (condemnation) also she becomes unlawful for him forever.”’

10. Sahl has narrated from al-Hassan ibn Ali from al-Fudayl ibn Muyassir who has said the following: “We were in the presence of abu ‘Abd Allah (a.s.), when a man came and complained before him about a misfortune that he had suffered. Abu ‘Abd Allah (a.s.), said, ‘If you exercise patience, you will be rewarded and if you do not exercise patience, Allah’s system of working of things will apply to you without change and you will be counted a sinner.’”

Ali ibn Ibrahim has narrated from his father from Safwan from Ishaq ibn ‘Ammar who has said the following: “I once said to abu Ibrahim (a.s.), ‘It is narrated to us from your father that if a man marries a woman during her waiting period she becomes unlawful for him forever.’ He (the Imam) said, ‘That is the case if he knows about it, but if he is ignorant he must separate from her and she must complete the waiting period then he can marry her anew.’”

11. Al-Husayn ibn Muhammad has narrated from ‘Abd Allah ibn ‘Amir from Ali ibn Mahziyar from al-Hassan ibn Muhammad ibn Mahziyar from al-Qutaybah al-A’sha’ who has said the following: “Once I visited abu ‘Abd Allah (a.s.), to also visit his son who was ill. I met him at the door and he was sorrowful and depressed. I asked, ‘May Allah keep my soul in service of your cause, how is your child?’ He replied, ‘By Allah, he is about to die.’ He then went inside the house and after a while came back to us, he looked bright and without any sign of depression. I had a longing that this can be a sign of the recovery of the child and I asked, ‘May Allah keep my soul in service of your cause, how is the child?’ He replied, ‘He just passed away.’ I then asked, ‘May Allah keep my soul in service of your cause, I found you, when the child was still alive, so much depressed and sad but now, when the child is dead, I see you have changed so much with brightness. How is all this happened?’ He replied, ‘We, the family of the Holy Prophet, cry (to Allah) for help before the fall of misfortune but once the command of Allah is issued, we accept it and submit ourselves to His command.’”

Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Al-Husayn ibn al-Mukhtar from ‘Ala’ ibn Kamil who has said the following: “Once, I was sitting with abu ‘Abd Allah (a.s.), when someone inside the house began to cry loudly. Abu ‘Abd Allah (a.s.), stood up and then sat down saying, ‘To Allah we belong and to Him we return,’ and continued his Hadith until he finished and then said, ‘We love to enjoy the wellbeing of our own selves, our children and our properties. If the systems of the working of things bring something upon us, then we have no right to love anything other than what Allah loves to happen to us.”

14. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from ibn Faddal from Yunus ibn Ya’qub from certain persons of our people who have said the following: “Once a group of people came to visit abu Ja’far (a.s.), to find out how one of his children suffering from illness was doing. They found him deeply concerned, grieved and restless. The narrator has said that they said, ‘By Allah, if something happens to him (the child), we are afraid we will see something from him (the Imam) that we will not like to see.’ The narrator has said that within a short time they began to hear weeping and crying for him. On the other hand, the Imam came to them, relaxed, free of concerns and totally changed from his previous conditions. They said, ‘May Allah keep our souls in the service of your cause, from seeing your condition we were afraid that if something happens, we may see things that will cause us a great deal of sorrow.’ The Imam then said to them, ‘We love to enjoy the wellbeing of whatever we love, but when the command of Allah comes we submit ourselves to what He loves.’”

قَالَ أَبُو عَبْدِ اللَّهِ ع‌ إِذَا أَحْرَمْتَ فَعَلَيْكَ بِتَقْوَى اللَّهِ وَ ذِكْرِ اللَّهِ كَثِيراً وَ قِلَّةِ الْكَلَامِ إِلَّا بِخَيْرٍ فَإِنَّ مِنْ تَمَامِ الْحَجِّ وَ الْعُمْرَةِ أَنْ يَحْفَظَ الْمَرْءُ لِسَانَهُ إِلَّا مِنْ خَيْرٍ كَمَا قَالَ اللَّهُ عَزَّ وَ جَلَّ فَإِنَّ اللَّهَ عَزَّ وَ جَلَّ يَقُولُ- فَمَنْ فَرَضَ فِيهِنَّ الْحَجَّ فَلا رَفَثَ وَ لا فُسُوقَ وَ لا جِدالَ فِي الْحَجِ‌ وَ الرَّفَثُ الْجِمَاعُ وَ الْفُسُوقُ الْكَذِبُ وَ السِّبَابُ وَ الْجِدَالُ قَوْلُ الرَّجُلِ لَا وَ اللَّهِ وَ بَلَى وَ اللَّهِ وَ اعْلَمْ أَنَّ الرَّجُلَ إِذَا حَلَفَ بِثَلَاثِ أَيْمَانٍ وِلَاءً فِي مَقَامٍ وَاحِدٍ وَ هُوَ مُحْرِمٌ فَقَدْ جَادَلَ فَعَلَيْهِ دَمٌ يُهَرِيقُهُ وَ يَتَصَدَّقُ بِهِ وَ إِذَا حَلَفَ يَمِيناً وَاحِدَةً كَاذِبَةً فَقَدْ جَادَلَ وَ عَلَيْهِ دَمٌ يُهَرِيقُهُ وَ يَتَصَدَّقُ بِهِ وَ قَالَ اتَّقِ الْمُفَاخَرَةَ وَ عَلَيْكَ بِوَرَعٍ يَحْجُزُكَ عَنْ مَعَاصِي اللَّهِ فَإِنَّ اللَّهَ عَزَّ وَ جَلَّ يَقُولُ‌ ثُمَّ لْيَقْضُوا تَفَثَهُمْ‌ وَ لْيُوفُوا نُذُورَهُمْ‌ وَ لْيَطَّوَّفُوا بِالْبَيْتِ الْعَتِيقِ‌ قَالَ أَبُو عَبْدِ اللَّهِ مِنَ التَّفَثِ أَنْ تَتَكَلَّمَ فِي إِحْرَامِكَ بِكَلَامٍ قَبِيحٍ فَإِذَا دَخَلْتَ مَكَّةَ وَ طُفْتَ بِالْبَيْتِ وَ تَكَلَّمْتَ بِكَلَامٍ طَيِّبٍ فَكَانَ ذَلِكَ كَفَّارَةً قَالَ وَ سَأَلْتُهُ عَنِ الرَّجُلِ يَقُولُ لَا لَعَمْرِي وَ بَلَى لَعَمْرِي قَالَ لَيْسَ هَذَا مِنَ الْجِدَالِ إِنَّمَا الْجِدَالُ لَا وَ اللَّهِ وَ بَلَى وَ اللَّهِ.

Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from and Muhammad ibn ‘Isma‘il has narrated from al-Fadl ibn Shadhan from Safwan ibn Yahya and ibn abu ‘Umayr all from Mu‘awiyah ibn ‘Ammar who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘When you assume the state of Ihram you must maintain piety before Allah. You must speak of Allah very often, talk very little unless it is for good reasons, of the completion of al-Hajj and al-‘Umrah is safeguarding one’s tongue except in what is good. Allah, most Majestic, most Glorious, has said, “Those who make al-Hajj obligatory upon themselves must take notice that there is no sexual relation, lying, abusing and swearing in al-Hajj.” [2:197] Swearing means to say, “No, by Allah, yes, by Allah.” One must take notice that when a man swears three times at one place in the state of Ihram, he has committed al-Jidal (swearing), and he must offer an animal offering and give it as charity. For swearing only once which is a lie, he has committed al-Jidal (swearing), he must offer an animal offering and give it as charity.’ He (the Imam) has said, ‘Avoid boastfulness and you must stay away from sins in disobedience to Allah; Allah, most Majestic, most Glorious, says, “Then you must remove the dirt away from you, fulfill your vows and perform Tawaf around the free House.’” [21:28] Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘It is of al-Tafath (dirt) to speak improper words. When you enter Makkah, perform Tawaf around the House and speak nice words, it will be expiation (for speaking improper words).’ I asked him (the Imam) about the man who says, ‘No, I swear by my life, yes, by my life.’ He (the Imam) said, ‘That is not swearing. Swearing is saying, ‘No, by Allah, yes, by Allah.’”
