لَا بَأْسَ بِالرَّجُلِ يَمُرُّ عَلَى الثَّمَرَةِ وَ يَأْكُلُ مِنْهَا وَ لَا يُفْسِدُ قَدْ نَهَى رَسُولُ اللَّهِ ص أَنْ تُبْنَى الْحِيطَانُ بِالْمَدِينَةِ لِمَكَانِ الْمَارَّةِ قَالَ وَ كَانَ إِذَا بَلَغَ نَخْلَةٌ أَمَرَ بِالْحِيطَانِ فَخُرِقَتْ لِمَكَانِ الْمَارَّةِ. - مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ الْحَسَنِ بْنِ مَحْبُوبٍ عَنْ خَالِدِ بْنِ جَرِيرٍ عَنْ أَبِي الرَّبِيعِ الشَّامِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ع نَحْوَهُ إِلَّا أَنَّهُ قَالَ وَ لَا يُفْسِدُ وَ لَا يَحْمِلُ.

1. Ali ibn Ibrahim has narrated from his father from ’Isma‘il ibn Marrar from Yunus from ‘Abd Allah ibn Sinan who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘It is not harmful if a man passes by fruits and eats from them but does not destroy them. The Messenger of Allah prohibited building walls in al-Madinah because of people passing by.’ He (the Imam) said, ‘When dates ripened, he (the Messenger of Allah) would command to make openings in the walls for the people passing by.’” Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Hassan ibn Mahbub from Khalid ibn Jarir from abu al-Rabi’ al-Shamiy from abu ‘Abd Allah (a.s.), a similar Hadith except that he (the Imam) said, ‘. . . does not destroy and does not carry.’”
