Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad who has said the following: “I once asked abu ‘ Abd Allah (a.s.), about a man who takes wudu’ (ablution) and water enters in his throat. He (the Imam) said, ‘If his wudu’ (ablution) is for an obligatory Salat (prayer) there is not anything on him, but if it is for an optional Salat (prayer); he is required to make its Qada’ (compensatory fast).”’

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Faddal from ‘Ammar who has said the following: “Abu ‘ Abd Allah (a.s.), has said that ‘Amir al-Mu’minin (a.s.), would keep in custody a procrastinating debtor; then command to distribute his assets among his creditors proportionate to their shares, and if he (the debtor) disagreed, he (the Imam) sold his assets, then distributed it among his creditors.’”

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from ibn ‘Udhaynah from Zurarah who has said the following: “I once said to abu Ja‘far (a.s.), ‘I pray to Allah to keep you well, a man has divorced his wife in Hayd (menses)-free period, in the presence of two just witnesses before going to bed with her. He (the Imam) said, ‘When she experiences Hayd (menses) for the third time her waiting period is complete and she is lawful for marriage/ I then said, ‘I pray to Allah to keep you well, people of Iraq narrate from Ali (a.s.), who has said that he has the right to go back to her before she takes Ghusl (bath) for the third Hayd (menses). He (the Imam) said, ‘They have spoken a lie.’”

Humayd ibn Ziyad has narrated from al-Hassan ibn Muhammad ibn Sama‘ah from Muhammad ibn al-Hassan ibn Ziyad al-‘Attar from Muhammad ibn al-Nu’aym al-Sahhaf who has narrated the following: “Muhammad Ibn Abi ‘Umayr Bayya‘ al-Sabiriy died and he made a will to me. He left behind his wife and no other heirs. I wrote to the virtuous servant (of Allah) about it and he (the Imam) wrote to me the answer that said, ‘Give one-fourth to the woman (his wife) and deliver the rest to us.’”

Ahmad ibn Muhammad has narrated from Ali ibn al-Hassan from Ja’far ibn Muhammad ibn Hakim from Jamil ibn Darraj from Muhammad ibn Muslim who has said the following: “Abu Ja‘far (a.s.), has said, ‘The debt of an absent person is paid from his assets when enough proof is presented to prove his indebtedness. His assets are sold to make necessary payments in his absence and he faces the proof against him. One who has presented proofs receives payments upon providing guarantee and security, if he does not want to wait.’”

It is narrated from the narrator of the previous Hadith from al-Hassan ibn Muhammad from Muhammad ibn Sukayn and Ali ibn abu Hamzah from Mushma‘il and ibn Ribat from Mushma‘il all of them from abu Basir who has narrated the following: “Abu Ja‘far (a.s.), once read for me (from the book) on the issue of ordained shares of inheritance the following: ‘A woman dies and leaves behind her husband,’ he (the Imam) said, ‘The entire legacy belongs to him. If a man dies and leaves behind his wife, he (the Imam) said that one- fourth belongs to her and the rest belongs to the Imam.’”

Ali has narrated from his father from ibn Bukayr and Jamil ibn Darraj and ‘Umar ibn ‘Udhaynah from Zurarah who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘A woman divorced becomes stranger to her husband at the time of her experiencing the first drop of blood of Hayd (menses) for the third time (after divorce).’ I then said that Rabi‘ah al-Rai’y also is of the opinion that she becomes stranger as soon as she experiences the first drop of blood.’ He (the Imam) said, ‘It is not true. It is not his opinion but is something that has reached him from Ali (a.s.).”’

A number of our people have narrated from Sahl ibn Ziyad from al-Rayyan ibn al-Salt from Yunus who said: “One who is fasting in the month of Ramadan can brush his teeth whenever he wants; but if one rinses his mouth during the time of obligatory prayers, and water enters his throat, there is nothing upon him, and he can complete his fast. And if one rinses his mouth in a time other than the time of obligatory prayers, and water enters his throat, one must repeat it (fast again). And it is better for the one fasting not to rinse his mouth.’”

He (the Imam) said, ‘He has the right to go back to her as long as she has not seen blood discharge because of Hayd (menses) for the third time (after divorce).”’

4. A number of our people have narrated from Sahl ibn Ziyad and Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad all from Ali ibn Mahziyar who has narrated the following: “Once Muhammad ibn Hamzah al-‘Alawiy wrote to abu Ja‘far, al-Thaniy (a.s.), and asked, ‘One of your Mawla made a will to me about a hundred dirham and I heard him say, ‘Everything that belongs to me is for my Mawla.’ He died and left it but did not instruct to give anything from it. He has two women of whom one is in Baghdad whose address I do not know at this time and the other is in Qum; so what do you command me about the one hundred dirham?’ He (the Imam) wrote to him saying, ‘Find out how you can give from these dirham to the two wives of the man. Their rights in it is one-eighth if he has left any children but if he has not left any children, then it is one-fourth; and give the rest as charity to whomever you know is needy and deserving of charity, by the will of Allah.’”

Humayd ibn Ziyad has narrated from ibn Sama‘ah from ‘Abd Allah ibn Jabalah from Jamil ibn Darraj and Safwan ibn Yahya from ibn Bukayr and Ja‘far ibn Sanaa ‘ah from ibn Bukayr and Jamil all of them from Zurarah who has said the following: “Abu Ja‘far (a.s.), has said, ‘With the first blood that she sees because of Hayd (menses) for the third time after divorce she becomes stranger to him.’” Humayd ibn Ziyad has narrated from ibn Sama‘ah from Safwan from ibn Muskan from Zurarah a similar Hadith.

Al-Husayn from Muhammad has narrated from Mu‘alla’ ibn Muhammad from al-Hassan ibn Ali from Aban ibn ‘Uthman from ‘Abd al-Rahman ibn abu ‘Abd Allah who has said the following: “I once asked abu ‘Abd Allah (a.s.), about the case of a woman who is divorced; when can she get the control of her affairs? He (the Imam) said, ‘It happens when she sees Hayd (menses) for the third time after divorce.’ I then asked, ‘What happens if blood discharge begins earlier in her Hayd (menses)-free period?’ He (the Imam) said, ‘If blood discharge is before ten days it is part of the previous Hayd (menses), thus he has the control of the affairs but if it is after ten days then it is of the third Hayd (menses) and she gets control of her affairs.’”

Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from certain persons of his people, I think he is Muhammad ibn ‘Abd Allah ibn Hilal or Ali ibn al-Hakam from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has said the following: “I once asked abu Ja‘far (a.s.), about the case of a man who divorces his wife and about when she becomes stranger to him. He (the Imam) said, ‘It is when blood of the third Hayd (menses) appears. She gets control of her own affairs.’ I then asked, ‘Can she marry in that condition?’ He (the Imam) said, ‘Yes, but she must not allow him to approach her before she is clean of blood of Hayd (menses).’

It is narrated from the narrator of the previous Hadith from Safwan from Musa ibn Bakr from Zurarah who has said the following: “I once asked abu Ja‘far, ‘Alayhi al-Salam, ‘I have heard that Rabi‘ah al-Ra’iy says, “When a divorced woman experiences Hayd (menses) for the third time after divorce she becomes stranger to him and that the Hayd (menses)-free period is between the two Hayd (menses)” and he thinks that it is his own opinion.’ Abu Ja‘far, ‘Alayhi al-Salam, said, ‘What he has said, by my life is not true because he has taken it from Ali, ‘Alayhi al-Salam.’ I then asked, ‘What Ali, ‘Alayhi al-Salam, has said about it?’ He (the Imam) said that he (Imam Ali) would say, ‘When she sees blood of the third Hayd (menses) (after divorce) her waiting period expires and he has no way to her and that Hayd (menses)-free period is between two Hayd (menses). She cannot marry before taking Ghusl (bath) for the third Hayd (menses) (after divorce).’ “Al-Hassan ibn Muhammad ibn Sama‘ah has said that Ja‘far ibn Sama‘ah would say, ‘A divorced woman becomes stranger to him with the first drop of blood of Hayd (menses) for the third time after divorce. It is not lawful for her to marry until she takes Ghusl (bath) because of Hayd (menses) for the third time after divorce.’ Al-Hassan ibn Muhammad ibn Sama‘ah has said that she becomes stranger with the first drop of blood because of Hayd (menses) for the third time after divorce and thereafter if she wants to marry she can do so or not to do so. Ali ibn Ibrahim has said that she can marry if so she wants or not to do so but if she marries he must not go to bed with her before Ghusl (bath).”’
