إِنْ كَانَ قَوَّمَهَا عَلَيْهَا يَوْمَ تَزَوَّجَهَا فَإِنَّهُ يُقَوَّمُ الْعَبْدُ الْبَاقِي بِقِيمَتِهِ ثُمَّ يُنْظَرُ مَا بَقِيَ مِنَ الْقِيمَةِ الَّتِي تَزَوَّجَهَا عَلَيْهَا فَتَرُدُّ الْمَرْأَةُ عَلَى الزَّوْجِ ثُمَّ يُعْطِيهَا الزَّوْجُ النِّصْفَ مِمَّا صَارَ إِلَيْهِ.

‘If a woman marries for a woman as mahr (dower) who grows with her whereby her price increases or reduces, then he divorces her before going to bed with her. She must give back half of the price of the day it was given to her regardless of any increase or decrease.’”

If it is not proved then she must commence her ‘Iddah (waiting period) from the time she is informed.’”

“Abu ‘Abd Allah (a.s.), has said, ‘When a woman receives the news of the death of her husband, she must begin counting her waiting period and mourning for him.’”

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا وَ هُوَ غَائِبٌ مَتَى تَعْتَدُّ فَقَالَ يَوْمَ يَبْلُغُهَا وَ ذَكَرَ أَنَّ رَسُولَ اللَّهِ ص قَالَ إِنَّ إِحْدَاكُنَّ كَانَتْ تَمْكُثُ الْحَوْلَ إِذَا تُوُفِّيَ زَوْجُهَا وَ هُوَ غَائِبٌ ثُمَّ تَرْمِي بِبَعْرَةٍ وَرَاءَهَا.

“One of you would wait for one year, when her husband died and he was absent, hold back her carnal desires and throw it behind her.’””

إِنْ مَاتَ عَنْهَا زَوْجُهَا يَعْنِي وَ هُوَ غَائِبٌ فَقَامَتِ الْبَيِّنَةُ عَلَى مَوْتِهِ فَعِدَّتُهَا مِنْ يَوْمِ يَأْتِيهَا الْخَبَرُ أَرْبَعَةُ أَشْهُرٍ وَ عَشْراً لِأَنَّ عَلَيْهَا أَنْ تُحِدَّ عَلَيْهِ فِي الْمَوْتِ أَرْبَعَةَ أَشْهُرٍ وَ عَشْراً فَتُمْسِكَ عَنِ الْكُحْلِ وَ الطِّيبِ وَ الْأَصْبَاغِ.

‘When a woman’s husband who is absent dies and evidence is established about it, then her waiting period is counted from the day the news reaches her up to four months and ten days. She must begin mourning for him for four months and ten days, thus, she must stay away from musk, kohl, perfumes and dyes.’”

قَالَ: الْمُتَوَفَّى عَنْهَا زَوْجُهَا الْحَامِلُ أَجَلُهَا آخِرُ الْأَجَلَيْنِ‌ إِذَا كَانَتْ حُبْلَى فَتَمَّتْ لَهَا أَرْبَعَةُ أَشْهُرٍ وَ عَشْرٌ وَ لَمْ تَضَعْ فَإِنَّ عِدَّتَهَا إِلَى أَنْ تَضَعَ وَ إِنْ كَانَتْ تَضَعُ حَمْلَهَا قَبْلَ أَنْ يَتِمَّ لَهَا أَرْبَعَةُ أَشْهُرٍ وَ عَشْرٌ تَعْتَدُّ بَعْدَ مَا تَضَعُ تَمَامَ أَرْبَعَةِ أَشْهُرٍ وَ عَشْرٍ وَ ذَلِكَ أَبْعَدُ الْأَجَلَيْنِ.

“He (the Imam) (a.s.), has said, ‘The waiting period for a pregnant widow is the one which ends last. If she is pregnant when four months end but her child is not yet born, then her waiting period ends when the child is born. قَضَى أَمِيرُ الْمُؤْمِنِينَ ع فِي امْرَأَةٍ تُوُفِّيَ عَنْهَا زَوْجُهَا وَ هِيَ حُبْلَى فَوَلَدَتْ قَبْلَ أَنْ تَنْقَضِيَ أَرْبَعَةُ أَشْهُرٍ وَ عَشْرٌ فَتَزَوَّجَتْ فَقَضَى أَنْ يُخَلِّيَ عَنْهَا ثُمَّ لَا يَخْطُبَهَا حَتَّى يَنْقَضِيَ آخِرُ الْأَجَلَيْنِ فَإِنْ شَاءَ أَوْلِيَاءُ الْمَرْأَةِ أَنْكَحُوهَا وَ إِنْ شَاءُوا أَمْسَكُوهَا فَإِنْ أَمْسَكُوهَا رَدُّوا عَلَيْهِ مَالَهُ.

“Abu Ja‘far (a.s.), has said that ’Amir al-Mu’minin issued a judgment in the case of a pregnant widow who gave birth before the end of four months and ten days and married. The judgment said that she must be left alone and no one must propose to her for marriage until the longer of the two periods of time ends; and the

It is narrated from the narrator of the previous Hadith from Safwan ibn Yahya from ibn Muskan from Muhammad ibn Muslim who has said the following: “I once asked abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a pregnant widow who after childbirth marries before the end of four months and ten days. لَا. - وَ رُوِيَ أَيْضاً أَنَّ نَفَقَتَهَا مِنْ مَالِ وَلَدِهَا الَّذِي فِي بَطْنِهَا[1]. رَوَاهُ.

“About the case of a pregnant widow abu ‘Abd Allah (a.s.), has said that she does not have the right to receive maintenance.’” It is also narrated that her maintenance is from the assets of the child in her womb. [So he has narrated].

سَأَلْتُهُ عَنِ الْمَرْأَةِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا أَ تَعْتَدُّ فِي بَيْتِهَا أَوْ حَيْثُ شَاءَتْ قَالَ بَلْ حَيْثُ شَاءَتْ إِنَّ عَلِيّاً ع لَمَّا تُوُفِّيَ عُمَرُ أَتَى أُمَّ كُلْثُومٍ فَانْطَلَقَ بِهَا إِلَى بَيْتِهِ.

’It is wherever she wants; Ali (a.s.), brought ’Umm Kulthum to his home when ‘Umar died.’”

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ امْرَأَةٍ تُوُفِّيَ زَوْجُهَا أَيْنَ تَعْتَدُّ فِي بَيْتِ زَوْجِهَا تَعْتَدُّ أَوْ حَيْثُ شَاءَتْ قَالَ بَلَى حَيْثُ‌ شَاءَتْ ثُمَّ قَالَ إِنَّ عَلِيّاً ع لَمَّا مَاتَ عُمَرُ أَتَى أُمَّ كُلْثُومٍ فَأَخَذَ بِيَدِهَا فَانْطَلَقَ بِهَا إِلَى بَيْتِهِ.

who said: “I once asked Abu 'Abdillah (a.s.) about a woman whose husband has passed away: where should she observe her waiting period, in her husband's house or wherever she wishes? He said: "Yes, wherever she wishes." Then he said: "When Umar died, Ali (as) came to Umm Kulthum, took her hand, and led her to his house.

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا أَ تَخْرُجُ إِلَى بَيْتِ أَبِيهَا وَ أُمِّهَا مِنْ بَيْتِهَا إِنْ شَاءَتْ فَتَعْتَدُّ فَقَالَ إِنْ شَاءَتْ أَنْ تَعْتَدَّ فِي بَيْتِ زَوْجِهَا اعْتَدَّتْ وَ إِنْ شَاءَتِ اعْتَدَّتْ فِي أَهْلِهَا وَ لَا تَكْتَحِلُ وَ لَا تَلْبَسُ حُلِيّاً.

سَأَلْتُ عَنِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا فَقَالَ لَا تَكْتَحِلُ لِلزِّينَةِ وَ لَا تَطَيَّبُ وَ لَا تَلْبَسُ ثَوْباً مَصْبُوغاً وَ لَا تَبِيتُ عَنْ بَيْتِهَا وَ تَقْضِي الْحُقُوقَ وَ تَمْتَشِطُ بِغِسْلَةٍ[1] وَ تَحُجُّ وَ إِنْ كَانَتْ فِي عِدَّتِهَا.

“I once asked abu Ibrahim (a.s.), about the case of a woman whose husband dies. He (the Imam) said, ‘She must not use kohl for beautification or perfume and must not wear colorful dress, spend the night somewhere else. She can pay off rights, use hair clip and go for al-Hajj even though she is in her waiting period.’”

6. Humayd has narrated from ibn Sama‘ah from ibn Ribat from ibn Muskan from abu al-‘Abbas who has said the following: “I once asked abu Ibrahim (a.s.), about the case of a woman whose husband dies. He (the Imam) said, ‘She must not use kohl for beautification, perfume or colorful dresses. She must not go out of her hou
